Entgeltlicher Verzicht auf eine Mietoption als einkommensteuerpflichtige sonstige Leistung

Durch den Verzicht auf die Ausübung einer nicht im Rahmen einer betrieblichen T?tigkeit erworbenen Mietoption werden steuerpflichtige sonstige Einkünfte erzielt, wenn der Verzicht auf die Optionsausübung zu keiner Minderung des Verm?gens des Optionsberechtigten führt, also keine im Privatverm?gen des Berechtigten eingetretene Verm?gensminderung ausgeglichen wird.     

Werbungskosten ab Vermietungsabsicht (auch bei ursprünglich selbst bewohnter und noch leerstehender Wohnung)

Ist der endgültige Entschluss, eine Wohnung zu vermieten durch ernste und nachhaltige Vermietungsbemühungen belegt, so liegen (vorab entstandene) Werbungskosten auch für die Zeit vor, in der die zun?chst selbst bewohnte Wohnung noch leer steht.     

Überdurchschnittlich großes Arbeitszimmer (ca 150 m<Superscript>2</Superscript>)

Der Einwand der Amtsbeschwerde, ein repr?sentatives Arbeitszimmer (Haush?lfte) im Ausma? von etwa 150m², das auch für Besprechungen verwendet wird, sei kein Arbeitszimmer, ist unberechtigt. Für die AfA ist beim Arbeitszimmer auf die tats?chliche Nutzungsdauer abzustellen. Die lit e (1,5% AfA) ist beim Arbeitszimmer unanwendbar, weil dieses nicht der Erzielung von Einkünften aus Vermietung und Verpachtung dient.     

Auch der Rechtsnachfolger des ausgeschlossenen Wohnungseigentümers kann die Ausschlussbestimmung nicht mit Individualantrag bekämpfen

Auch einem Rechtsnachfolger eines aus der Miteigentümergemeinschaft ausgeschlossenen Wohnungseigentümers steht kein Recht zu, mittels Individualantrages die Ausschlussbestimmung (auf Grund derer der Ausschluss erfolgt ist) beim VfGH zu bek?mpfen.     

Sex determination from os sacrum by postmortem CT

Sex determination in forensic practice is performed mostly on sexually dimorphic bones, including pelvic bones such as the os sacrum. Postmortem CT scan provides an easy and fast method for depicting and measuring bone structures prior to elaborate autopsy preparations. To develop a simple and objective method for sex determination in postmortem CT, metric data were evaluated from CT images of the pelvic-associated os sacrum of 95 corpses (49 men and 46 women) from the Canton of Bern, Switzerland. Discriminant function analysis of the data showed that the best accuracy in determining sex was 76.8% and 78.9% with two different observers. It is concluded that measuring the os sacrumin postmortem CT for sex determination has moderate accuracy and should only be applied in combination with other methods.     

Gas at postmortem computed tomography - An evaluation of 73 non-putrefied trauma and non-trauma cases

Postmortem computed tomography (PMCT) has become an important complement in investigating forensic cases allowing an accurate detection of gas accumulations. The present study investigated the presence and distribution of gas in a large number of non-putrefied cases of traumatic and non-traumatic deaths. Furthermore the possibility of pneumobilia secondary to blunt abdominal trauma was studied. Retrospectively, 73 cases, underwent a whole-body PMCT prior to autopsy. These were divided into four groups: penetrating trauma (20 gunshot cases, 13 stabbing cases), blunt abdominal trauma (20 cases) and a control group of 20 non-trauma cases. Exclusion criteria were visible signs of decomposition. Each group was screened for gas accumulations in the vascular system, internal organs, soft tissues and body cavities. Gas accumulations were present in 98% of the trauma cases, compared to 80% of the control group. The most affected structures and/or organs in the trauma group were soft tissues, vessels and the liver. In most cases of the trauma group gas was associated with open injuries and lacerations of vessels. Furthermore, in the gunshot group gas was frequently seen in the intracranial cavity. Pneumobilia occurred in one case of the blunt trauma group; in that control group gas was also seen, but less frequently. Gas accumulation showed a strong association with traumatic events, but even the majority of non-trauma cases showed gas accumulations. Despite the exclusion of cases with visible decomposition signs, a putrefactive origin of gas was assumed in some cases. Gas accumulations are a frequent finding in PMCT with a higher incidence in (open) trauma cases. Even though a differentiation between putrefactive and traumatic gas accumulations is still difficult, knowledge of the circumstance surrounding the case may help identify the origin of gas.     

Applicability of DNA analysis on adhesive tape in forensic casework

Adhesive tape is commonly used in crimes and is often the subject of forensic evaluation. DNA analysis of adhesive tape can provide DNA profiles of suspects. The object of this study was to evaluate the applicability of DNA analysis on adhesive tape samples in forensic casework. We retrospectively reviewed all cases involving adhesive tape or similar items received by our institute for DNA analysis during the past 11 years. From 100 forensic cases reviewed, 150 adhesive tape samples were examined. A total of 98 DNA profiles were obtained from these samples. Sixty-two of the profiles provided feasible case-relevant information. In conclusion, DNA profiling of adhesive tape samples can be useful in a variety of forensic cases.     

Vorsteuerabzug bei Vorsorgewohnung

§ 6 Abs 2 UStG 1994 (idF Abg?G 1998); § 12 Abs 1 UStG 1994: Die Berechtigung zum Vorsteuerabzug ist im Hinblick auf einen beabsichtigten steuerpflichtigen Grundstücksumsatz nicht anders zu behandeln als im Fall einer geplanten steuerpflichtigen Vermietung. Bei nachweislicher Absicht einer Option zur Steuerpflicht beim Verkauf von Wohnungen steht demzufolge das Recht des Vorsteuerabzuges im Zeitpunkt des Vollzuges der Leistung zu. Aussagen in Gesetzesmaterialien, die keinen Niederschlag im Gesetzeswortlaut gefunden haben, sind unbeachtlich.
