The necessity to control environmental externalities is almost invariably given as justification for command-and-control regulation and other forms of state intervention in related markets. When even mentioned, common law remedies that protected environmental rights for centuries are quickly dismissed as either being unworkable or ineffective. A review of the common law experience indicates that the rule of law can be effective in protecting environmental rights. Indeed, it is quite possible that common law was too effective, which led to special interest demand for statute law. The rule of politics may be more attractive to rent seekers than the rule of law and markets. 相似文献

This paper examines the temporal relationship between revenues and expenditures for the forty-eight contiguous states over an annual period 1942 to 1992. Using an error-correction model, we find that the tax-spend hypothesis is supported for twenty-four states. The spend-tax hypothesis is valid for eight states while the fiscal synchronization hypothesis is supported for eleven states. Manipulative mixed messages from candidates to voters affect what governments are entitled to do in office. A party that wins an election gains a 'mandate to rule'. But there is a second type of mandate: a 'policy mandate' to enact specific policy proposals central to the winning party's campaign. Mixed-message politics in general can undermine policy mandates, and the use of 'dog whistle politics' - telling one group of voters one thing, while allowing or encouraging another group to believe another - makes the inferring of policy mandates especially problematic. Referendums provide only a partial remedy to dog whistle politics. Winning a clear policy mandate means forgoing dog whistle politics, despite the short term electoral advantage they may deliver. 相似文献

Recent highly publicized traffic accidents involving older drivers have led to renewed interest in state policies and administrative practices that award and renew drivers’ licenses in the American states. Because the probability of traffic accidents is linked to the medical conditions that are more prevalent among the elderly, and because the number of older drivers is expected to rise over the next several decades, one might expect that this will be an increasingly important policy issue. This article discusses variations that are observed across states in law and administrative practice. A longitudinal analysis of data on crashes involving elderly drivers in fifteen states indicates that crash rates are directly related to the length of the renewal cycle for older drivers and inversely related to the stringency of testing at renewal. It is also likely that states requiring physicians to report conditions that would impair driving will experience lower crash rates. A secondary analysis of policy impacts on the licensing rates is not conclusive, a finding that is attributable to inaccuracies in the reported numbers of licensed drivers. 相似文献

In the 1970s Washington State lost a series of legal cases related to Native Americans. These cases exemplify the need for knowledge of federal Indian law-but such knowledge, out of context, is insufficient. Key aspects of federal Indian law are hard to accept because of conflicting stories that Americans already believe. The authors discuss the importance of stories and review commonly believed stories that block acceptance of federal Indian law. They then discuss basic principles of Indian law and distill four questions to help determine tribal jurisdiction. The authors review the Marshal trilogy—three Supreme Court cases that set the foundations of modern Native American law—and show how the legal principles play out in an analysis of three contemporary court cases. 相似文献

Many governmental results-based management systems have not produced the expected positive effects. This article analyzes the reasons for this common disappointment by looking at three components of results-based management—results-specific information, capacities, and incentives—and concludes that incentives are often the least developed. It then synthesizes a simple framework for evaluating the efficacy of results-oriented incentives. To be successful, results-specific incentives must be tailored to fit four program characteristics: timeliness, political environment, clarity of the cause-and-effect chain, and tightness of focus. This framework suggests that some systems put too exclusive an emphasis on budgetary incentives and could be strengthened by emphasizing personnel-system rewards, especially those that look beyond business models. 相似文献

Community, demographic, familial, and personal risk factors of childhood depressive symptoms were examined from an ecological
theoretical approach using hierarchical linear modeling. Individual-level data were collected from an ethnically diverse (73%
African-American) community sample of 197 children and their parents; community-level data were obtained from the U.S. Census
regarding rates of community poverty and unemployment in participants’ neighborhoods. Results indicated that high rates of
community poverty and unemployment, children’s depressive attributional style, and low levels of self-perceived competence
predict children’s depressive symptoms, even after accounting for demographic and familial risk factors, such as parental
education and negative parenting behaviors. The effect of negative parenting behaviors on depressive symptoms was partially
mediated by personal variables like children’s self-perceived competence. Recommendations for future research, intervention
and prevention programs are discussed.

When does the Gender Difference in Rumination Begin? Gender and Age Differences in the Use of Rumination by Adolescents 总被引:1,自引:0,他引:1
A cross-sectional non-clinical sample of 1,218 adolescents, aged 10–17 years, completed measures of stress, rumination, and
depression to allow tests of the response style theory of S. Nolen-Hoeksema [J Res Adolesc 4:519–534, 1994] in adolescents,
in particular whether increasing levels of stress and rumination in early adolescence are predictive of the onset of the gender
difference in depression. Overall, females reported higher levels of stress, rumination, and depression than males. The onset
of the gender differences in stress and depression occurred at age 13 years, and for rumination one year earlier at 12 years.
Significantly, also from 13 years, rumination explained the gender difference in depression by showing that it significantly
mediated the effect of gender on depression. Gender moderated the rumination to depression relationship; specifically the
association was stronger for females than males. Developmental differences were noted in that rumination significantly mediated
between stress and depression earlier in the age range for females than males. Results supported many of the predictions of
Nolen-Hoeksema’s model of the emergence of a gender difference in adolescent depression.

The present study examines how exposure to relational aggression at school is associated with adolescents’ perceptions of,
and participation in, a hostile school environment. Participants were 1,335 African American and European American adolescents
in grades 7 through 12 (52% female, 49% African American). Results indicate that exposure to relational aggression is associated
with several components of adolescents’ perceptions of the school climate. Adolescents exposed to high levels of relational
aggression perceived their school to be less safe, and were less pleased with the general social atmosphere at school. Moreover,
for males, but not females, exposure to relational aggression was associated with carrying a weapon to school. Implications
and suggestions for future research are discussed in terms of working toward safer school environments for adolescents.

We explore the impact of social institutions on economic performance in Jamaica through a reinterpretation of the plantation
economic model. In its original form, the plantation model fails to develop a causal link between the plantation legacy and
persistent underdevelopment. Despite its marginalization, the model remains useful for discussions on growth and development.
Consequently, we offer a reappraisal using the causal insights from Kenneth Sokoloff and Stanley Engerman. We use two examples
to demonstrate how inequality encourages the formation of institutions that are inconsistent with growth, and an empirical
analysis to confirm the hypothesized relationship between inequality, institutions, and economic development. Since inequality
is expected to influence growth indirectly, we use a structural specification, which follows William Easterly’s recent test
of Sokoloff and Engerman’s argument. Our reliance on a time-series specification is unique. We demonstrate that the expectation
that, on average, inequality and growth is negatively related and that institutions may compromise growth are accurate for
Jamaica, the most cited Caribbean nation in the current discourse. Our results carry several policy implications, including
support for the recent calls in Jamaica for political restructuring. However, both the paucity of similar studies and the
importance of the implications for sustainable growth and development demand further analyses.
