Compulsory licensing and interim measures in Merck: a case for Italy or for antitrust law?

Legal context: This paper examines an important decision of the Italian CompetitionAuthority in a case concerning the compulsory licence of IPrights. The oddity of the case lies in the fact that the dominantposition of the defendant seemed to be due, rather than to thefact that the latter held certain IP rights, to a peculiar defacto situation. Key points: As a result, the competition authority did not apply the testthat is traditionally used in cases of abuses involving IP rights,but the plain ‘essential facilities’ doctrine. Practical significance: The case shows that the borderline between these two types ofabuses is a difficult one to draw, and more generally that thecomplex relationship between competition law and IP is in needof clarification. The paper also deals with the issue, raisedby the same case, of whether, in the absence of national provisionto this effect, national competition authorities have any powerto issue interim measures.     

Where the whole city meets: youth,gender and consumerism in the social space of the MEGA shopping mall in Aktobe,western Kazakhstan

ABSTRACT

The shopping mall entered Central Asia's commercial sector as a result of the economic transformation of post-Soviet space. Constructed near the centre of the city, the shopping mall overwrites the urban landscape, dominating it as a symbol of modernity. It functions as a gateway of global consumerist culture to the Eurasian steppe. Using the MEGA shopping mall in Aktobe, in western Kazakhstan, as an example, this article shows that the building acts as a stage for the construction of a new social and cultural space. This study focuses on the ways in which young women interact with the mall's spaces. The mall turns out to be a playground not only for children, but also for the whole younger generation, who come to this unique place to see and be seen. The mall became a hot spot of youth culture in the post-socialist worker's city by offering more than a mere shelter from dust and snow storms on the steppe. The available amenities made it a favourite place for meeting, consuming and dreaming. Young women especially are attracted to MEGA to experience the newest fashions and build social relationships.     

Does public criticism Erode trust in the police? The case of Jari Aarnio in the Finnish news media and its effects on the public’s attitudes towards the police

A significant part of the general public’s observations and image concerning the police comes through the mass media. It has been assumed that one factor affecting the level of trust is the way the media handles the police. This article describes the media uproar that arose in Finland in November 2013 about police misconduct, and its effects on the public trust in the police. Two hypotheses were tested in the study: (a) negative publicity always decreases trust, and so, too, in this case; and (b) a change in trust is affected by the public’s independent interpretation of the publicity battle, in which case criticism might also increase trust. The study materials comprise the news coverage concerning the uproar and four opinion surveys collected after it occurred. The first survey was conducted immediately after the press conference of the case in week 48/2013 and the other ones in three-week intervals. The results show that following the uproar, compared to the earlier results of the European Social Survey, trust in the police did not decrease—on the contrary, it increased slightly. Our results suggest that in this case a large part of the audience has taken, to use the term of Stuart Hall, the oppositional position when interpreting negative news about the police.
