The seductive quality of central human capabilities: sociological insights into Nussbaum and Sen's disagreement

Abstract

In an era when relativism and questions of modernity have unsettled the premises and goals of the development project, there is a seductive quality to the universalism of Nussbaum's capabilities approach. We query Nussbaum's philosophically based contribution and raise epistemological concerns about her commitment to a list of central human capabilities. We argue that attention to state forms and practices, as well as unequal power relations, must be incorporated into analyses of capability and development. This leads us to support Sen's advocacy of deliberative democracy as a productive space for collectivities and individuals to strive for social justice and equity. Such a focus is necessarily attentive to multiple forms of inequality and domination and is best understood by engaging historically specific analyses of state formations.     

Stature estimation of 3-10-year-old children from long bone lengths

Estimation of stature in adult forensic cases with available long bones of the limbs is routine, but such estimation is less common in subadult cases. Long bones from subadult cases are often used to estimate age, but in some instances stature may be helpful or even critical for identification. Few published regression equations exist for consultation in such cases. Data from the longitudinal growth study conducted by the Child Research Council in Denver in the mid-1900s are utilized to produce dual-sex and single-sex regression equations for the six long bones of the limbs (humerus, radius, ulna, femur, tibia, and fibula) and for the combined femur+tibia length. All measurements are from radiographs and are of diaphyseal length. Examples show that similar results can be obtained using a two-step process of "ballpark" estimation from published tables of the Denver data, but these new regressions allow a one-step standard error estimate for the means. Regressions are further compared with those previously published by Finnish researchers, which are generally broadly comparable. More routine stature estimation in subadult cases is encouraged both as an aid to possible identification and as a test of the available regression equations.

The population of coloured textile fibres in domestic washing machines.

A population survey was carried out to analyse examples of the coloured fibre population that may be expected to exist in both front- and top-loading domestic washing machines during Spring, in Sydney, Australia. White cotton T-shirts were washed both individually, and with a normal household wash load, then taped to recover extraneous fibres transferred during the wash cycle. Twelve thousand one hundred and seventy-eight fibres were classified according to length, colour and generic class. Cotton fibres were most prevalent (69.4%), followed by man-made fibres (24.2%). The most common colour/generic class combinations were black/grey cotton (27%), blue cotton (20%) and red cotton (15.6%). Other combinations generally represented under 2% of the total fibre population. Two thirds (65.9%) of the recovered fibres were under 2 mm in length, the proportion of fibres decreasing with increasing fibre length. Variations in machine type did not affect the distribution of fibres with respect to fibre type, colour or length.     

LEGAL CONSUMERS AS COPRODUCERS

Although the extent of unbundling among private legal practitioners in the changing Australian marketplace remains uncertain, there is a shift in thinking about the appropriate role of consumers in accessing everyday legal services. This is evident in the delivery of legal services other than those provided by private practitioners, where the consumer's role in legal service delivery arrangements is gradually being transformed. Among those institutions that are responding positively, if not inevitably, to the rising tide of legal self-helpers is the Family Court of Australia. The court's activities in attempting to meet the needs of its pro se consumers is simultaneously creating opportunities for unbundled legal service delivery, at least for those lawyers willing to seize these opportunities. It would appear that family law disputes, together with the large numbers of voluntary and involuntary legal self-helpers that these disputes generate, is fertile terrain for the development of alternative forms of legal service delivery.     

Fatty Acid Profiles for Differentiating Growth Medium Formulations Used to Culture Bacillus cereus T‐strain Spores

Microbial biomarkers that indicate aspects of an organism's growth conditions are important targets of forensic research. In this study, we examined fatty acid composition as a signature for the types of complex nutrients in the culturing medium. Bacillus cereus T‐strain spores were grown in medium formulations supplemented with one of the following: peptone (meat protein), tryptone (casein protein), soy protein, and brain–heart infusion. Cellular biomass was profiled with fatty acid methyl ester (FAME) analysis. Results showed peptone cultures produced spores enriched in straight‐chained lipids. Tryptone cultures produced spores enriched in branched‐odd lipids when compared with peptone, soy, and brain–heart formulations. The observed FAME variation was used to construct a set of discriminant functions that could help identify the nutrients in a culturing recipe for an unknown spore sample. Blinded classification tests were most successful for spores grown on media containing peptone and tryptone, showing 88% and 100% correct identification, respectively.     

Autism behind bars: a review of the research literature and discussion of key issues

Individuals with autism spectrum disorder (ASD) may experience difficulties coping at all levels of involvement in the criminal justice system. Questions remain, however, regarding the presence and type of difficulties faced by individuals with ASD in the context of incarceration within prison settings. Despite the potential impact for community safety and concerns regarding justice, these issues have received very little academic attention. The research that does exist is generally limited by poor methodology and small sample sizes. The current paper provides a brief review and discussion of the limited extant literature regarding the experiences of prisoners with ASD with the view to summarising areas of difficulties potentially faced by such individuals. It is hoped that this brief review may highlight the need for academic attention in order to inform practice and policy regarding the criminal justice response to this potentially vulnerable population.     

Taiwan's Presidential and Legislative Elections

Taiwan's newly-elected president, Ma Ying-jeou, is determined to relax the tension that has gripped the Taiwan Strait for more than a decade. His positions during the election campaign were calculated to reassure both the Beijing government and the Taiwanese people. On the one hand, he made it clear that he would remove barriers to improved relations and reach out to the Chinese leadership. At the same time, he was equally clear in his commitment to protecting Taiwan's interests. Ma's positions strike a balance between preserving Taiwan's de facto political independence and moving toward a more constructive relationship with the mainland. This approach enjoys widespread popular support in Taiwan. Still, the devil is in the details, and implementing Ma's ideas will require cooperation from Beijing, and from other political actors within Taiwan itself.
