The necessity to control environmental externalities is almost invariably given as justification for command-and-control regulation and other forms of state intervention in related markets. When even mentioned, common law remedies that protected environmental rights for centuries are quickly dismissed as either being unworkable or ineffective. A review of the common law experience indicates that the rule of law can be effective in protecting environmental rights. Indeed, it is quite possible that common law was too effective, which led to special interest demand for statute law. For nearly a hundred years, to many foreigners “Peking” meant the foreign legation quarter and its colourful western inhabitants. The article gives details of the extraordinary life they led a stone's throw from the Emperor's palace in a city that remained virtually untouched by the modern world. After the Boxer Rising of 1900, the legation quarter became a Treaty Port with its own laws and administration. That status continued through the First World War and beyond. But just as the foreigners were at last beginning to value Peking's uniqueness, the end was in sight. Modern Russia is a revisionist, if not a revanchist, nation-state. It seeks to end the efficacy of the post-World War II institutionalized rules-based international order, which was created and maintained by the U.S.-led Western alliance. This article proposes a new approach to investigating the substance of lawmaking. Only a very small proportion of bills become law in the U.S. Congress. However, the bills that do become law often serve as vehicles for language originating in other bills. We investigate “text reuse” methods as a means for tracing the progress of policy ideas in legislation. We then show how a focus on policy ideas leads to new insights into the lawmaking process.
