Legislation would be a Samuelsonian public good if the cost of creating legislation is not a function of the number of people covered by the legislation. A straighforward test of Samuelsonian publicness is undertaken by estimating the cost of producing legislation as a function of population and other variables, using cross-sectional data from the states of the United States for the years 1965, 1975, and 1985. The empirical results indicate that while legislation does have some degree of publicness, legislation is mostly a private good, and that it has been becoming increasingly less public over time. 相似文献

The concept of autonomy has acquired a plurality of meanings in international relations; this article analyzes the distinct uses given to this term in Latin America and its relationship to theoretical contributions from outside the region. The authors propose a far-reaching reconceptualization of autonomy appropriate to Latin America's new circumstances in the global context. They argue that these new circumstances favor the shift from autonomy as traditionally defined to what they call relational autonomy, a construct based on contributions from classical political theory, political sociology, gender studies, social and philosophical psychology, and the theory of complex thought. 相似文献

This article explores the strategic interests of China and the US in the North Korean issue. It examines their different perceptions of North Korea. For China, North Korea is needed as a friendly buffer state as well as a political ally. As the lone superpower and lynchpin of international security, the US wants to stop unpredictable North Korea from further developing its nuclear capabilities. The article then explores the shared goal of both great powers in promoting stability on the Korean peninsula and in preventing nuclear proliferation. Globalization, the rising of an economy outside the paradigm of government by nation-states, has created new opportunities for transnational corporate crime, defined broadly here as avoidable harms inflicted across national borders for purposes of economic gain. The authors reexamine theories of corporate criminal liability in the transnational context and applaud the recent French codification of corporate criminal liability in terms broad enough to encompass the new economic realities.
