A number of police cooperation strategies have developed around the Southern Chinese seaboard, which encompasses the coastal provinces of Mainland China, Taiwan, and the Special Administrative Regions of Hong Kong and Macau. Cooperation mechanisms in the region encompass intelligence sharing strategies and establishment of the Electronic Communal Information Sharing Platform (ECISP), common investigations, regular meetings, practitioner exchanges, and training. Although conducted on a regular basis, these cooperation strategies mostly lack a formally binding legal basis, relying purely on informal practitioner efforts at best supported by Memoranda of Understanding. Due to their historical independence all police forces involved in cooperation at the Southern Chinese seaboard have had to establish strategies to overcome legal, organisational and cultural differences. This region could therefore be compared to cooperation networks between sovereign nation-states in other regions. The historical development of Greater China’s highly informal, practitioner driven approach to cooperation is reminiscent of early forms of cooperation between the police agencies of states that are now members of the European Union (EU). This paper explores the development of both informal and formal strategies established among police agencies around the Southern Chinese seaboard and compares them with the EU to enhance the historical, political and legal understanding of the two regions.  相似文献

With the elections of 2012, the main party driving the Islam debate in the Netherlands was sidelined. The new government of Liberals and Social Democrats is trying to re-bury the contentious issue, not least because Islam-related questions have had a confusing effect on their parties. Nonetheless, with societal concerns lingering, the topic is likely to reappear. In the Netherlands, the wariness towards (Islamic) immigration is not rooted in fears of ethnic or religious competition. Instead, it tends to receive serious political attention only when cloaked as a defence of secularist and liberal values. As such, curbing Islamic practices is presented as a way to protect a (self-promoted) image of the Netherlands as a non-judgemental and tolerant place. The paradox remains that that self-image was traditionally meant to include minorities, not to exclude them.  相似文献

Indonesia has been haunted by the “spectre of communism” since the putsch by military officers on 1 October 1965. That event saw the country's top brass murdered and the military attributing this putsch to the Communist Party. The genocide that followed was triggered by a campaign of sexual slander. This led to the real coup and the replacement of President Sukarno by General Suharto. Today, accusations about communism continue to play a major role in public life and state control remains shored up by control over women's bodies. This article introduces the putsch and the socialist women's organisation Gerwani, members of which were, at the time, accused of sexual debauchery. The focus is on the question of how Gerwani was portrayed in the aftermath of the putsch and how this affects the contemporary women's movement. It is found that women's political agency has been restricted, being associated with sexual debauchery and social turmoil. State women's organisations were set up and women's organisations forced to help build a “stable” society, based on women's subordination. The more independent women's groups were afraid to be labelled “new Gerwani ” as that would unleash strong state repression. This article assesses the implications of these events for the post-1998 period of Reformasi and reviews some recent analyses of 1965, state terrorism and violence and reveals blind spots in dealing with gender and sexual politics. It is argued that the slander against Gerwani is downplayed in these analyses. In fact, this slander was the spark without which the bloodbath would not have happened and would not have acquired its gruesome significance.  相似文献

The Netherlands’ Ministry of Security and Justice has agreed on performance targets with the country’s police departments. Introducing the targets created a shift to controlling performance in team management focus. This empirical study of police teams in Utrecht in the Netherlands (N = 134) focuses on the influence of leadership style, gender and psychosocial team factors when teams are required to achieve agreed performance objectives. We address calls in the literature for more research into (objective) measures relating to effective police leadership and existing (police) management practices. Gender homogeneity, a combination of charismatic, empowering and transactional leadership styles, and team members’ awareness of team achievements were found to be relevant. The practical implications of these results are discussed.  相似文献

This paper examines the composition of supervisory boards of 41 large German banks in 1999–2010. We find that the supervisory board structure reflects both outside control by major shareholders and inside control by other stakeholders. The largest group among non-employee board members is made up of bank managers. The high proportion of former executives and German board representation indicates significant inside control. The chairpersons of banks controlled by banks are less likely to be former executives of the same bank than are the chairpersons of banks controlled by non-banks. Over time, representation of industrial and insurance companies on banks’ supervisory boards has decreased and the representation of banks and foreign shareholders has increased.  相似文献

This paper sought the opinion of 200 Nigerians on their willingness to cooperate with the police during the Boko Haram crisis. Public perceptions of police effectiveness during the crisis, residence location, gender and religious affiliation were used as moderators. Data was analysed using an explanatory factor analysis and structural equation modelling. Results indicated a strong association between perceived effectiveness and willingness to report to the police with respondents who question the effectiveness of the police being less likely to be willing to report criminal activity about Boko Haram. Further to this, the impact of religion on willingness to report was at least partially mediated by perceived effectiveness of the police with the results showing that Christian respondents perceived the police as less effective. Females and those living in the north were significantly less willing to report criminal activity to the police. The findings are discussed in relation to the BH crises and directions for future research are given.  相似文献

Theory of Change (ToC) is an emerging methodology in the practice of development programmes, often contrasted with the dominant logical framework. This article reviews current debates around ToC before identifying five aspects that are appreciated in practice. It appears that these aspects mostly cover areas where the logical framework is not – or is no longer – meeting the needs of practitioners. Subsequently, the article analyses experiences in ToC training for NGO staff and concludes that ToC can address shortcomings of the logical framework – if only by going back to some of the roots of the logical framework.  相似文献

The paper at hand analyses how the Chinese Trademark Office (CTMO) and the Chinese Trademark and Adjudication Board (TRAB) implement Article 10 cipher 8 paragraph 1 of the Chinese trademark law. This provision prohibits the use-and hence the registration-of certain words and devices as trademarks which are "detrimental to socialist morals or customs" or "have other unhealthy influences". The paper primarily intends to concretize this open-end provision for practitioners by giving examples of signs which have been rejected by the competent authorities in the past but may also deliver some amusing insights into Chinese conventions for Non-Chinese readers.  相似文献

Abstract

Guideline judgements in English sentencing have been subjected to little scrutiny by non-lawyers. In this paper, the writers examine one guideline judgement, R v. Oliver and Others, which concerns the sentencing of offences involving indecent photographs and pseudo-photographs of children. Ten post-Oliver cases where a sentence was appealed are analysed and the results reported. The writers find the guideline's internal logic wanting, with shortcomings reflected in the patchy and non-obvious inferences made in appellate judgements of cases of the kind covered in Oliver. The writers propose flowcharting as a heuristic device in the development of guideline judgements, and possibly as a form of representation of judgements parallel to text-based formulations.  相似文献

In a single experiment with 5- and 6-year-old children, we examined whether the changes that children make in response to cross-examination style questioning vary as a function of delay and/or persist in subsequent interviews. Children visited the local police station; 1–3 days later they were interviewed in a direct examination format. Either 1–3 days or 8 months later, children were interviewed in a cross-examination format designed to persuade them to change their original responses. One week following the cross-examination interview, the direct examination questions were repeated. Relative to direct examination scores, the accuracy of children's reports decreased significantly during cross-examination, irrespective of delay. When children were interviewed again 1 week after cross-examination, however, their responses (and their accuracy levels) were very similar to those observed during the direct examination interview. That is, during cross-examination, children made changes to their earlier testimony even when their memory for the event remained intact.  相似文献
