Y-STR analysis on DNA mixture samples—Results of a collaborative project of the ENFSI DNA Working Group

The ENFSI (European Network of Forensic Science Institutes) DNA Working Group undertook a collaborative project on Y-STR typing of DNA mixture samples that were centrally prepared and thoroughly tested prior to the shipment. Four commercial Y-STR typing kits (Y-Filer, Applied Biosystems, Foster City, CA, USA; Argus Y Nonaplex, Biotype, Dresden, Germany; Powerplex Y, Promega, Madison, WI, USA; and DYSplex-3, SERAC, Bad Homburg, Germany) were used for the amplification of the mixture samples. The results of the study showed a striking inter-laboratory difference of kit performance as determined from the peak heights of the obtained Y-STR genotypes. Variation in quantity and quality of the shipped DNA can be excluded as reason for the observed differences because both samples and shipping conditions were found to be reproducible in an earlier study. The results suggest that in some cases a laboratory-specific optimization process is indicated to reach a comparable sensitivity for the analysis of minute amounts of DNA.     

Recovered memories of childhood sexual abuse: Current findings and their legal implications

Recent research on recovered memories of childhood sexual abuse has shown that there are at least two types of recovered memory experiences: those that are gradually recovered within the context of suggestive therapy and those that are spontaneously recovered, without extensive prompting or explicit attempts to reconstruct the past. By focusing on well‐known imperfections of human memory, we were able to find differing origins for these recovered memory experiences, with people recovering memories through suggestive therapy being more prone to forming false memories, and with people reporting spontaneously recovered memories being more prone to forgetting prior incidences of remembering. Moreover, the two types of recovered memory reports are associated with differences in corroborative evidence, suggesting that memories recovered spontaneously, outside of suggestive therapy, are more likely to correspond to genuine abuse events. In this paper, we summarize recent research on recovered memories and we argue that these scientific findings should be applied in the justice system, but also in clinical practice.     

Survival analysis: A survey

This paper is a survey of statistical methods used to analyze the length of time until a specified event occurs. These models have often been used to analyze the survival times (i.e., time until death) of medical patients, and so the term survival analysis is natural. In criminology, the main application of these models has been to analyze the time until recidivism, but many other applications are possible. The paper summarizes the statistical literature on survival analysis, and describes its applications in criminology. The methods are illustrated by an application to the prediction of time until recidivism for a sample of North Carolina prison releasees.     

Toxicological analysis after asphyxial suicide with helium and a plastic bag

A 23-year-old man was found on a raised hide in lying position, the head wrapped in a plastic bag connected with a helium gas cylinder by a polypropylene tube. The autopsy did not show any specific findings nor did the routine toxicological analysis reveal significant information regarding the cause of death (BAC 0.9 mg/g, diphenhydramine 0.81 μg/ml in heart serum). For the detection of helium in the lungs, gas samples from both lungs were collected by a method ensuring minimal dilution. Gas analyses were performed using a GC–MS with a split–splitless injector and a headspace syringe. As carrier gas the commonly used helium was replaced by nitrogen. Helium was found in clearly elevated concentrations in gas samples from both lungs. Therefore, suffocation by breathing helium enriched, and thus oxygen deficient atmosphere, can strongly be assumed as the cause of death.     

Flourishing retail in the post-soviet sphere? Potentials and constraints of small-scale retail activities in rural Kyrgyzstan

The demise of the USSR led to the collapse of its centrally organised retail system. With this collapse the supply of consumer goods dried up, especially in the remote parts of the former USSR. At the same time the advent of capitalism offered a new institutional framework for independent retail activities. In the Kyrgyz Republic, where the economic liberalisation followed strictly the Washington Consensus, a large number of small shops emerged in both urban and rural areas. This study analyses the reasons for this boom in retail start-ups as well as the constraints the mainly inexperienced merchants encounter. As will be shown, any success in retail activities depends greatly on the performance of other economic sectors. The main goal of starting a retail business is to minimize risks within the overall livelihood strategies of households in rural Kyrgyzstan.     

Verfassungsrechtliche Bedenken gegen die RHG Novelle 2009

Im Jahre 2009 wurde durch eine ?nderung des B-VG und des RHG die Kompetenz des RH zur Prüfung privatwirtschaftlicher Unternehmen auf Betriebe, welche durch den Bund „tats?chlich beherrscht“ werden, ausgeweitet. Der folgende Beitrag m?chte zeigen, dass es nicht m?glich ist, diesen neuen Tatbestand ausreichend abzugrenzen. Somit handelt es sich um einen unbestimmten Gesetzesbegriff, welcher Tatbestandsmerkmal einer Kompetenznorm ist. Dies stellt nach der hier vertretenen Ansicht einen Versto? des § 12 (1) RHG gegen Art 18 Abs 1 B-VG dar.     

Characteristics of Backspatter on the Firearm and Shooting Hand—An Experimental Analysis of Close‐range Gunshots

Contact and close‐range gunshot injuries can produce bloodstains on the shooting hand and weapon. In this study, backspatter was analyzed in experimental horizontal pistol shots into blood‐filled sponges. The shooting distances were set between 0 and 45 cm. With increasing shooting distance, there was a significant decrease in the degree of backspatter. Microspatter could be detected on the weapon and shooting hand up to a shooting distance of 40 cm. They were predominantly located on thumb and index finger as well as the radial dorsal aspects of the hand. Fine spray of microspatter combined with elongated droplets in the shape of exclamation marks was found at contact and 2‐cm distance shots. An angular calculation based on the shape of the bloodstains was possible up to a shooting distance of 2 cm. No bloodstains were detected beyond 45 cm.     

Erythrocytes in cervical lymph nodes of the human as a sequela of stasis and/or lymph drainage. Questionable diagnostic significance in strangulation and mechanical injuries of the head

Information on the diagnostic significance of follicular hemorrhage and/or presence of red blood cells in the lymph node sinus was obtained by microscopic investigation of the superficial and deep human cervical lymph nodes. Fifty cases were selected on the basis of the following criteria: (1) cases without strangulation or mechanical head trauma; (2) cases in which death occurred by strangulation without additional mechanical head trauma; (3) cases without strangulation but with mechanical head trauma; (4) cases with strangulation and mechanical head trauma. The usual degree of stasis and hemorrhages and the dilation of the veins and/or capillaries are not sufficient to discriminate between cases with and cases without strangulation. Moreover, erythrocytes, erythrophages, and siderophages were encountered in the lymph node sinus of both cases with and cases without mechanical head trauma. Neither follicular hemorrhage nor the presence of red blood cells in the sinus is therefore diagnostically significant in forensic pathology.
