In forensic science, scientific problem-solving is characterized by the recognition of traces as part of iterative reasoning processes to assign meaning to those traces in order to interpret and reconstruct events. Through a set of fundamental principles, the Sydney Declaration presents a foundation of forensic science through the lens of a scientist. The distinction between a scientist and a technician may require clarification—where a prototypical technician follows a prescribed set of ‘standard operating procedures’ and may be limited in the interpretation of the resultant data, the scientist utilizes knowledge, skills, experience and imagination to identify the issue at hand and develop lines of inquiry for testing and interpretation. This case report draws on the Sydney Declaration in order to highlight the importance of learning about events from careful consideration of both obvious and less obvious traces. A case involving the assault of a police officer is examined to illustrate the use of the Principles: the problem originally defined by investigators at the scene and later by prosecutors resulted in incorrect analysis and interpretation of traces, hampering efforts at an accurate reconstruction of events. This exercise serves to demonstrate that in order to engage in scientific problem-solving, it is necessary to apply observation and reasoning in forensic investigations in order to yield an outcome that can be clearly articulated. The overarching goal is to support the drive to improve forensic science practice, education, and research through a case illustrating the value of the principles of the Sydney Declaration.  相似文献

ABSTRACT

Restorative justice is an approach to incidents of harm involving a high level of support and accountability for people who cause harm. To date, there is neither federal regulation nor commonly applied standard of care for re-entry to campus by a student who has been found responsible for sexual misconduct. Restorative justice re-entry circles represent a promising approach to the reintegration of students, taking into account the needs of the individual survivor, the student who violated policy, and the safety concerns of the campus community. Using a case study, this article outlines an example of a re-entry circle at a university in the United States and discusses the lessons learned with regard to concerns about the student’s mental health status, issues of race and racism on campus, and the role of a trauma-informed approach to circle practice in incidents involving a complex interplay of mental health, social status, and race on campus.  相似文献

Carol Morgan has proposed (Women's History Review, 6[3], 1997) that in future, rather than concentrating their efforts on studying gender conflict, labour historians should research men and women's mutual struggle in the workplace. She cautions those who ignore the implications of local labour markets, regional variations and change over time in order to maximise women's subordinate role at the point of production. These are important considerations. But in her critique, Morgan probably gives insufficient weight to the conclusions of earlier writers. Her case studies on cotton and chain-making have been previously well-researched and the rationale for investigating two such disparate trades is not fully developed. Morgan's arguments are also at variance with those historians who consider home and work to be separate but interconnected. Xenotransplantation - the transfer of living tissue between species - has long been heralded as a potential solution to the severe organ shortage crisis experienced by the United Kingdom and other 'developed' nations. However, the significant risks which accompany this biotechnology led the United Kingdom to adopt a cautious approach to its regulation, with the establishment of a non-departmental public body - UKXIRA - to oversee the development of this technology on a national basis. In December 2006 UKXIRA was quietly disbanded and replaced with revised guidance, which entrusts the regulation of xenotransplantation largely to research ethics committees. In this article we seek to problematize this new regulatory framework, arguing that specialist expertise and national oversight are necessary components of an adequate regulatory framework for a biotechnology which poses new orders of risk, challenges the adequacy of traditional understandings of autonomy and consent, and raises significant animal welfare concerns. We argue for a more considered and holistic approach, based on adequate consultation, to regulating biotechnological developments in the United Kingdom.  相似文献

Corrections officers play crucial roles in the functioning of correctional institutions. They create and maintain the social and security milieu within prisons and often have direct impact on the behavior of inmates through their daily contact with inmates. Studies showed, however, that the correctional work environment was fraught with stress. Many studies found that corrections officers experienced excessive stress, which manifested in physical illnesses, burnout, family problems, or their inability to perform their duties—compromising institutional safety and creating further stress for other staff. These studies were instrumental in instituting improvements in the correctional work environment; however, most were conducted in Western societies. To extend the knowledge of corrections officers' work environments, this study examined correctional work among officers in South Korea. Specifically, stress-related issues outlined in previous studies were examined here to assess their relevance and applicability in the South Korean society. Implications for policy and future endeavors are discussed.  相似文献
