认罪认罚从宽的类型化与制度体系的再梳理

"认罪认罚"在实体法、程序法、证据法及恢复性司法等不同的论域中具有不同的理论意涵,具体而言,可区分为四种不同类型的认罪认罚从宽,分别为:刑事实体法层面的认罪答辩、程序简约化层面的认罪答辩、作为证据补强的认罪答辩以及被告人与被害人的刑事和解.我国的认罪认罚从宽制度事实上将"认罪"作为程序繁简分流的唯一关键要素,而未区分程序面向的认罪认罚从宽和实体面向的认罪认罚从宽.这导致立法、理论与实践出现了不同维度的混同.实践表明,程序面向的认罪认罚有进一步完善的空间,实体面向的认罪认罚作为程序机制意义不大,协商性司法是重要的繁简分流程序机制,但并非唯一,可考虑设立更多类型的特殊程序,提高诉讼效率,节约司法资源.     

共有人优先购买权的发生及制度价值

共有人优先购买权在长期的历史发展中已形成一种交易习惯,作为民事特别优先权制度,它具有着悠久的渊源和历史根基。由于我国法律对共有人优先购买权规定比较模糊笼统,操作性不强,才导致了纠纷的大量出现。共有人优先购买权有利于减少冲突的发生,促进交易秩序的安全稳定,有利于对共有财产的保护。规定具体的共有人优先购买权制度,不但可以降低交易成本,还可以稳定交易秩序。在现阶段,我国有必要保留共有人优先购买权制度,并对该制度进行完善。

本文对沃勒斯坦世界体系理论的价值和缺陷进行了尝试性的评价.沃勒斯坦世界体系的来源离不开马克思列宁理论的奠基作用.沃勒斯坦在继承合理内核的基础上发展了世界体系理论.世界体系理论的特征笔者概括为对马列的继承、对核心--半边缘--边缘的划分、世界体系的历史周期性和资本积累利润四个方面.之后思考了沃勒斯坦对资本主义分析的深刻性、三个地带的划分、批判西方中心论、体系的历史周期性和对新体系或新秩序构建问题.

用ELISA和PCR检测异常妊娠妇女弓形虫感染

为了解兰州市妊娠妇女近年弓形虫感染情况 ,探讨异常妊娠与弓形虫感染的关系 ,分别采用ELISA和PCR检测了异常妊娠妇女血清中TOX IgM和TOX DNA。结果 ,1 3 5例异常妊娠妇女血清TOX IgM和TOX DNA阳性率分别为 1 1 .1 1 % (1 5 /1 3 5 )和 1 2 .5 9% (1 7/1 3 5 ) ,总阳性率为 1 3 .3 3 % (1 8/1 3 5 ) ,组间无显著差异 (P >0 .0 5 )。异常妊娠史妇女与妊娠期无异常孕妇的血清TOX IgM阳性率分别为 1 1 .1 1 % (1 5 /1 3 5 )和 6.0 2 % (3 2 /5 3 2 ) ,组间差异显著 (P <0 .0 5 ) ,相对危险度为1 .85。调查结果显示 ,兰州市弓形虫血清抗体阳性率较 1 994年略有上升 ,弓形虫感染的孕前检查应联合应用ELISA和PCR为宜。
