The target article is a critique of the movement toward using structured risk assessment tools to inform decisions about sentencing. In this commentary, I analyze (a) the conditions under which it may be more or less fair to use well-validated risk assessment tools in this manner and (b) the extent to which doing so is likely to exacerbate, ameliorate, or have no effect on existing racial and other biases in sentencing. I recommend a policy-relevant research agenda that would specifically test whether and how adding well-validated risk assessment tools to the routine sentencing process alter the severity or nature of sentences. This agenda would also evaluate the extent to which these tools are implemented in “real world” settings faithfully enough to bridge the usual divide between science and practice.  相似文献

As the correctional population continues to increase, probation agencies struggle to adequately supervise offenders with unique needs, including those with mental disorder. Although more than 100 U.S. probation agencies have implemented specialty mental health case-loads, little is known about their practices. Based on detailed observations of 83 audio-taped meetings, we examined interactions between probationers and officers in a prototypic specialty agency, focusing on the extent to which practices comport with evidence-based risk reduction principles. We found that specialty officers (a) more frequently discussed probationers' general mental health than any individual criminogenic need, (b) chiefly questioned, directed, affirmed, and supported (rather than confronted) probationers, and (c) relied more heavily on neutral strategies and positive pressures (e.g., inducements) rather than negative pressures (e.g., threats of incarceration) to monitor and enforce compliance. Implications for "what works" to promote community integration for probationers with mental disorder are discussed.  相似文献

Assessing an inmate’s risk for recidivism may become more challenging as the length of incarceration increases. Although the population of Long-Term Inmates (LTIs) is burgeoning, no risk assessment tools have been specifically validated for this group. Based on a sample of 1,144 inmates released in a state without parole, we examine the utility of the Level of Service Inventory-Revised (LSI-R) in assessing risk of general and violent felony recidivism for LTIs (n = 555). Results indicate that (a) the LSI-R moderately predicts general, but not necessarily violent, recidivism, and (b) this predictive utility is not moderated by LTI status, and is based in part on ostensibly dynamic risk factors. Implications for informing parole decision-making and risk management for LTIs are discussed.

Offenders with antisocial traits are relatively likely to attempt suicide, largely because they are more likely to have high negative emotionality and low constraint. Among 682 male offenders, we tested whether negative emotionality, low constraint, and also substance use problems mediated any relationship between antisocial personality disorder (ASPD) and psychopathy on the one hand, and suicide-related behavior (SRB) and ideation on the other. ASPD and the impulsivity/lifestyle features of psychopathy weakly predicted SRB. High negative emotionality and low constraint (but not substance use) mediated the relation between ASPD and SRB. Impulsivity/lifestyle features of psychopathy retained an independent predictive effect. Self-report psychopathy measures added unique predictive variance to the Psychopathy Checklist—Revised. We discuss implications for suicide risk assessment and prevention.

Although considerable research on psychopathy has been conducted over the past 30 years, relatively few studies have examined key issues related to potential ethnic differences in this constellation of socially maladaptive personality traits. Given recent sociopolitical and scientific developments, an issue of considerable debate is whether Black individuals possess "more" traits of psychopathy than do Whites. To address this issue, a meta-analysis of differences between these groups' scores on the Psychopathy Checklist--Revised (PCL-R; Hare, 1991) was performed, using 21 studies (N = 8,890) of correctional, substance abuse, and psychiatric samples. Blacks exceeded Whites by an average of less than 1 point on the PCL-R total score. Effect sizes for core interpersonal and affective traits of psychopathy (Factor 1) were sufficiently homogeneous to clearly interpret, although other features manifested statistically significant heterogeneity. Our finding that Blacks and Whites do not meaningfully differ in their levels of core psychopathic traits is consistent with community-based findings for self-report measures of psychopathy and clinical diagnoses of antisocial personality disorder.  相似文献

Individuals with psychopathy typically are viewed as incurable cases that should be diverted from treatment settings to environments where their behavior can be monitored and controlled. The prevailing clinical conviction that psychopaths are untreatable has crucial implications, given the scarcity of mental health care resources, the number of legal contexts that call for assessment of treatability, and the explosion of research on psychopathy and violence risk over recent years. Based on a sample of 871 civil psychiatric patients (including 195 potentially psychopathic and 72 psychopathic patients), this study explores the relations among psychopathy, receipt of outpatient mental health services in real-world settings, and subsequent violence in the community. The results suggest that psychopathic traits do not moderate the effect of treatment involvement on violence, even after controlling statistically for the treatment assignment process. Psychopathic patients appear as likely as nonpsychopathic patients to benefit from adequate doses of treatment, in terms of violence reduction. We interpret these results in light of prior research with offenders and analyze their implications for future research, policy, and practice.  相似文献

There is growing support for the disaggregation of psychopathy into primary and secondary variants. This study examines whether variants of psychopathy can be identified in a subsample (n = 116) of juvenile offenders with high scores on the Youth Version of the Psychopathy Checklist (PCL:YV). Model-based cluster analysis of offenders’ scores on the PCL:YV and a measure of anxiety suggested a two-group solution. The derived clusters manifested expected differences across theoretically relevant constructs of abuse history, hostility, and psychiatric symptoms. Compared with low-anxious primary variants, high-anxious secondary variants manifested more institutional violence, greater psychosocial immaturity, and more instability in institutional violence over a 2-year period, but similar stability in PCL:YV scores.  相似文献
