A manner of death may be ruled undetermined by the forensic pathologist when there is insufficient information about the circumstances surrounding the death to make a ruling. The aim of our study was to retrospectively analyze a series of autopsy cases that were classified as undetermined manner of death after complete investigations. In all, 48 cases were examined. In 23 cases (48%), the cause of death was determined. The most frequent cause of death was toxic death (n = 11). More than one manner of death was deemed conceivable for most cases (n = 39). The most frequent and the most probable manner of death was accident (n = 37). Homicide was not excluded in about 23% of the cases. Our study showed that the manner of death may remain undetermined despite an established cause of death, and even when two or more conceivable causes of death are considered. Our study pointed out that undetermined manner of death covers a wide range of situations and that homicide may be underestimated.  相似文献

Recently, as different projects aiming to define and reinforce property rights in the fashion industry have been elaborated and discussed, a lot of papers have been dedicated to the question of property rights in this industry. Our paper considers the problems from a specific point of view; it focuses on the relation between property rights and creativity. If property rights allow the allocation of the majority of standard industrial goods without any special difficulty, however, when they are applied to creative goods, new problems arise. Then, for us, the persistence of a low system of IPRs in the fashion industry does not mainly derive from its efficiency but from the characteristics of the inputs that are used in the creative production process. They constitute strong constraints for defining, entitling, legitimating, enforcing, valuating and exchanging property rights. Thus, the different economic actors develop different kinds of strategic behaviour in order to obtain earnings and can try to protect copyrights, trademarks, new assets, old assets (heritage), private or collective assets, and so on. The institutional characteristics of this specific industry—such as the models of management, the type of ownership, the size of the firms, … lead to different historical models of management through IPRs. Peculiarly, the financial groups that integrate fashion into the new luxury industries currently try to implement new IPRs and to move towards a stronger system of IPRs but the management model of the street fashion puts an obstacle to this project.  相似文献

When developing concepts for protecting children and youth who live in institutions, the perspective of the addressees has so far been insufficiently taken into account. This study aims to compare the assessment of children, youth, and caregivers in institutions with regard to group atmosphere, participation, and sense of safety. A combined quantitative and qualitative approach compares the assessment of children or youth and caregivers in child and youth welfare institutions, boarding schools, and clinics through the use of an online questionnaire and group discussions that address the topics safety, group atmosphere, and participation. The quantitative questionnaire included 233 youth age 14 years and up and 490 caregivers; 87 children or youth between the ages of 11 and 18 years and 73 caregivers were part of the qualitative group discussion. The questionnaire showed that youth and caregivers assessed the sense of security in principle as positive. With regard to group atmosphere and participation, youth tended to see these aspects in a positive light, but almost all youth-aged participants viewed these specific categories more critically than did the adult caregivers. The results from the group discussions make clear that children, adolescents, and caregivers often underestimate the real dangers. The existing sense of security in institutions may be the result of underestimating real dangers. Implications for the implementation of protection concepts are drawn.  相似文献

Résumé  L’édition spéciale que le lecteur tient entre ses mains est la toute première édition de la Revue Internationale de Sémiotique Juridique en langue fran?aise. Elle lui propose un éventail d’analyses représentatives des différentes conceptions de la linguistique juridique ou jurilinguistique comme la dénomme nos collègues canadiens. Elle est dédiée au Doyen Cornu, qui fut, comme l’indique le Professeur Beauchard dans son hommage, une des personnalités juridiques les plus reconnues en France pour ses travaux dans le domaine de la langue et du droit. Les articles sélectionnés dégagent l’essentiel de la linguistique juridique: ils soulignent certains aspects de recherches déjà avancées (Gémar, Goltzeberg) et d’autres débats encore peu explorés (Mattila, Lenoble-Pinson), permettant ainsi au lecteur de situer les enjeux actuels de la linguistique juridique tout en lui révélant les perspectives à venir.  相似文献

Abstract:  The examination of skull sexual dimorphism has been the subject of numerous morphologic and craniometric studies, but the disadvantage of these studies is that they are dependent on the experience of the operator and involve subjectivity. In 1996, a team from Taiwan refined the methods enabling the sex of an individual to be determined using cephalometric plots made from lateral teleradiography. To validate their work using a European population, 114 dry skulls (59 men and 55 women) were examined. Cephalometric plots were made on lateral teleradiography with an orthodontic software and 18 cephalometric variables were analyzed. Sex was determined with 95.6% accuracy using the 18 variables discriminant function. A subset of eight variables was selected and could predict sex with the same accuracy. In conclusion, it can be said that skull-sexing methods using lateral teleradiography seem always suitable but the most indicative variables could differ relative to the ethnic population concerned.  相似文献

Sommaire: Plusieurs gouvernements ont mis en place des processus de réformes qui se traduisent par un processus de changement visant la modernisation de l'État. Ces processus cornportent une dimension axiologique influencée par la Nouvelle gestion publique. Considérant la réforme comme un phénomène psychosocial et culturel, cet article expose la perception d'acteurs clés vis‐à‐vis des processus de changement qu'implique la modernisation de la fonction publique quebecoise (Loi sur l'administration publique). Cette recherche, basée sur vingt entrevues réalisées auprès de direc‐teurs des ressources humaines de ministères et organismes, démontre que les perceptions de la réforme sont diverses et que l'influence de la politique dans les réformes se situe davantage dans les objectifs que dans le design. En plus de faire ressortir les principales initiatives et quelques obstacles au changement, la recherche illustre que la perception qu'ont les drh sur la nature réelle des changements est variable, et permet de les regrouper sous trois catégories. Enfin, cette recherche présente différents types de cultures témoignant de l'importance d'ajuster les modes d'implémentation pour le succès des réformes. Elle illustre l'importance de soigner la mise en cruvre des réformes plutôt que d'essayer de définir un modèle idéal. Un regard sur l'avenir vient enfin compléter cette étude. Abstract: Many governments have implemented reform processes that lead to modernizing the state. These experiences involve a value dimension influenced by new public management. Stating administrative reform as a cultural and psychosocial phenomenon, this article exposes the perception that key actors have of the change processes entailed by the Quebec public administration's modernization (Loi sur l'administration publique). This research, based on twenty interviews of human resources directors from ministries and public organizations, shows that the perceptions of the reform are diverse and that the political influence of the reforms appears more in the objectives than in the design. In addition to showing the principal facilitating initiatives and a few obstacles to change, the research illustrates that the human resources directors' perception of the changes' actual nature is variable and permits grouping them into three categories. Finally, this research presents different types of cultures, showing the importance of adjusting implementation modes for the reforms' success. It illustrates the importance of taking care of the implementation rather than trying to define an ideal model. A look at the future completes the study.  相似文献
