Seals are traditionally used in the Far East Asia to stamp an impression on a document in place of a signature. In this study, an accuser claimed that a personal contract regarding mining development rights acquired by a defendant was devolved to the accuser because the defendant stamped the devolvement contract in the presence of the accuser and a witness. The accuser further stated that the seal ink stamped on the devolvement contract was the same as that stamped on the development rights application document. To verify this, the seals used in two documents were analyzed using micro‐attenuated total reflectance Fourier transform infrared spectroscopy and infrared spectra. The findings revealed that the seals originated from different manufacturers. Thus, the accuser's claim on the existence of a devolvement contract was proved to be false.  相似文献

This article argues that whilst concepts of law and justice can be seen as prominent in much science fiction, the role of lawyer is mostly absent. This article interrogates these absences and asks whether they can be traced back to contemporary concerns around professional ethics. Three potential absences are noted; firstly, justice is considered as immanent. In these fictional futures lawyers have become unnecessary due to the immediacy of the legal system. The second conceptualisation portrays lawyers as intertwined with corporate interests. In these speculative moments lawyers have become culturally indistinguishable from other types of corporate entities. The final science fictive texts highlight a desire for the lawyer-hero. In these texts justice is overwhelmingly absent and shows a continuing need for legal professionals. Each of these cultural moments presents important questions for current understandings of professional ethics and the regulatory systems in which they are based. A removal of lawyers from our shared understandings of the future is indicative of potential problems with perceptions of professional ethics in the present.  相似文献

In the past few years, scholars interested in neighborhoods and crime have turned their attention to the role of neighborhood organizations. Recently, (Kubrin, Squires, Graves, and Ousey, Criminology & Public Policy, 10(2), 437–466, 2011) examined the impact of payday lenders on neighborhood crime. They found that there is a significant relationship between payday lenders, and both violent and property crime rates. The current research builds upon their work by exploring banking options in the city of Norfolk, Virginia. Findings indicate that the presence of payday lenders is significantly related to property crime in 2010 and violent crime in 2010, though the findings for violent crimes are not robust. Also there is a mild suppression effect predicting violent crime rates once socioeconomic deprivation is controlled. Pawn shops are not significantly related to either property or violent crimes. Interestingly banks are significant positive predictors of both property and violent crimes. The difference between the findings here and those of (Kubrin, Squires, Graves, and Ousey, Criminology & Public Policy, 10(2), 437–466, 2011) are discussed.  相似文献

Integrating healthy relationship and marriage education (RME) into child welfare services is a relatively recent initiative. Guided by the theoretical work in child welfare training evaluation, the current study describes the development and testing of a new RME training for child welfare professionals. Based on data collected from 272 trainees, results from structural equation modeling indicate a linear association between learner attitudes and newly acquired knowledge and skills to perceptions of training usefulness, which, in turn, influenced implementation of RME skills with clients. Implications for the delivery and evaluation of programming, in general and specific to RME, are shared.  相似文献

Prior research shows that the effect of partisanship on social expenditure declined over time in Organisation for Economic Co‐operation and Development (OECD) countries. In this article, the author argues that the 2007/2008 recession resulted in the reemergence of partisan policy making in social spending. This was a result of mainstream parties needing to respond to the growing challenge from nonmainstream parties as well as demonstrating that they responded to the economic crisis by offering different policy solutions. Using a panel of 23 OECD countries, the author shows that since the Great Recession, partisan effects on social spending are once again significant. These effects are more likely to be observed where the salience of the Left–Right dimension is higher. In accordance with classic theories of economic policy making, left‐wing governments are more likely to increase social spending when unemployment is higher and right‐wing governments restrain social expenditure when the budget deficit is greater.  相似文献

Conflict resolution as an academic field was built by pioneers like John Burton on the idea that conflict resolution academics must accomplish three basic interlocking tasks: conduct cutting‐edge research, educate students, and make a positive contribution to the real‐world work of practitioners engaged in resolving actual conflicts. Over time and as the field has grown, so have the demands to produce research deemed rigorous enough according to increasingly competitive and rigid traditional standards and so too have the demands of teaching growing numbers of students. Research and teaching commitments thus diminish the time and support available to engage in practice. In this article, I consider those pressures within universities and also consider the options available to conflict resolution scholar–practitioners outside the traditional university  相似文献

The Murray–Darling Basin incorporates Australia’s three longest rivers and spans four states and one territory. It is important for an agricultural industry worth more than AUS$9 billion per year, but is also the life source and the spirit of the Indigenous Yorta Yorta people. Here, we address whether the interests of the Yorta Yorta people can encompass the common interest of the wider community in the Basin, and how the colonial legacy and climate change of the past century continue to influence the realization of the common interest moving forward. We find that shared regional governance with an agreed outcome supports the ongoing sustainability of the country and its people, but because of the legal history of Australia since colonization, recognition and mutual respect are no less important. Further, we note that the increasing climatic variability and changing climatic mechanisms that now exemplify the southeast of Australia corroborates the need for adaptive planning with longer time horizons. These lessons are supported by the customary law and practice of the Yorta Yorta people.  相似文献

ABSTRACT

This article explores how local resilience is realised in post-conflict reconstruction, by examining the redevelopment of Buddhist institutions in Cambodia. It firstly proposes three forms of resilience that were significant in the local level peacebuilding practice in the country – recovery, maintenance and transformation – and examines the process by which each form of resilience was materialised from the perspectives of local communities. Moreover, this study highlights two factors that determined the development of local resilience: ontological security and local leadership structure. Based on the empirical findings, this study discusses the conceptual and theoretical implications of such elements of resilient peacebuilding.  相似文献

Abstract

The volume that we introduce breaks with the prevalent tendency in International Relations (IR) scholarship to treat rising powers (such as China, Russia, India and Brazil) as unitary actors in international politics. Although a neat demarcation of the domestic and international domains, on which the notion of unitary agency is premised, has always been a myth, these states’ uneven integration into the global political economy has eroded this perspective’s empirical purchase considerably. Instead, this collection advances the concept of ‘state transformation’ as a useful lens through which to examine rising power states’ foreign policymaking and implementation. State transformation refers to the pluralisation of cross-border state agency via contested and uneven processes of fragmentation, decentralisation and internationalisation of state apparatuses. The volume demonstrates the significance of state transformation processes for explaining some of these states’ most important foreign policy agendas, and outlines the implications for the wider field in IR.  相似文献
