The erosion of rights by past breach

Legal rights may erode as a result of past, uncontested, breach.In light of ongoing violations, the rightholder's lacklusterenforcement may result in the loss of the entitlement. The doctrinesof course of performance in contract law and adverse possessionin property law are prominent examples of this widespread erosionphenomenon. In analyzing the effects of such laws, the articleconfronts two conflicting intuitions. On the one hand, the 'licence'to continue breach prospectively encourages opportunism. Onthe other hand, the risk of erosion may reinforce the rightholder'smotivation to take antierosion measures, bolstering the credibilityof the threat to enforce, thus better preserving the entitlement.The article proves that these two effects of erosion rules alwaysbalance out. The same amount of value will be extracted fromthe rightholder, irrespective of the law's erosion doctrine.The article also demonstrates the limits of this 'irrelevance'claim and the factors that may lead to its collapse. It appliesthe analysis to offer new perspectives on various prominentlegal rules.     

The Need for a Stronger Definition: Recognizing Abandonment as a form of Elder Abuse Across the United States

Elder abuse is a growing public health problem in the United States and statistics show that each year, hundreds of thousands of elders are abused in some manner. This Note discusses elder abuse while focusing specifically on the occurrence of elder abandonment and how the majority of states do not recognize elder abandonment as a form of elder abuse in their statutes. Moreover, this Note proposes a model statute to be adopted by every state in an effort for elder abandonment to become more widely reported. Elder abandonment is an unfortunate phenomenon and those who contribute to elder abandonment should face criminal liability similar to those abusers who engage in elder neglect or other types of elder abuse. Furthermore, this Note emphasizes that there should be a greater focus on how caregivers can seek assistance in order to prevent elder abuse in the United States.     

The role of victim-offender relationship in women's sexual assault experiences

This study's goal is to identify differences in background, assault, and postassault factors according to the victim-offender relationship. A mail survey is conducted with more than 1,000 female sexual assault survivors (response rate 90%) recruited from college, community, and mental health agency sources. Stranger assailants are associated with a greater victim perceived life threat, more severe sexual assaults, and ethnic minority victims. Positive social reactions do not vary according to the victim-offender relationship, but stranger victims report more negative social reactions from others than do victims of acquaintances or romantic partners. Assaults by strangers and relatives are associated with more posttraumatic stress disorder (PTSD) symptoms than assaults by acquaintances and romantic partners. As expected, survivors' social cognitive responses to rape and social reactions from support providers are stronger correlates of PTSD symptoms than demographic or assault characteristics in general, but correlates vary across victim-offender relationship groups.     

Psychopathy Factors and Risk for Aggressive Behavior: A Test of the “Threatened Egotism” Hypothesis

The primary purpose of this study was to examine psychopathy within a model of aggressive behavior that encompasses narcissism and "threatened egoism." This model was advanced by Baumeister and his colleagues (e.g., R. F. Baumeister, L. Smart, & J. M. Boden, 1996; B. J. Bushman & R. F. Baumeister, 1998). We examined whether the threatened egotism model extends to the construct of psychopathy and whether the two factors underlying psychopathy exhibit different associations with aggression within this model. Self-report data, correctional officer and counselor reports, and disciplinary report information obtained for 98 male inmates provided partial evidence that psychopathic individuals tend to respond aggressively when confronted with an ego threat. Moreover, psychopathic individuals exhibited this pattern of aggression more strongly than did narcissistic individuals. These findings bear potentially useful implications for the understanding and treatment of aggression in forensic populations.     

Tissue distribution of mirtazapine and desmethylmirtazapine in a case of mirtazapine poisoning

An ingestion of an unknown quantity of mirtazapine in a suicide attempt leading to death is described. Sertraline and amitriptyline have been co-ingested. Because mirtazapine is reported to be relatively safe in overdose, body fluids and tissues were investigated for both mirtazapine and desmethylmirtazapine by high-pressure liquid chromatography/tandem mass spectrometry following liquid-liquid extraction. The limit of detection was sufficiently low to also apply the assay in pharmacokinetic studies. The levels of amitriptyline and nortriptyline were very low (38 and 19 ng/mL femoral venous blood) and the amount of sertraline in blood taken from the femoral vein (880 ng/mL) was considerably lower than those seen in overdosage. Accumulation of mirtazapine and N-desmethylmirtazapine was evident in fluids and tissues involved in enterohepatic circulation and excretion. The concentration determined in a brain sample suggests a contribution of the metabolite to the drug's pharmacodynamic activity. Based on literature data, significant adverse or synergistic effects among the drugs detected as well as adverse reactions such as a serotonin reaction appeared less probable. Mirtazapine exhibits alpha(1)-antagonistic properties on the cardiac-vascular system and may cause hyponatraemia. In the face of the cardiac findings at autopsy and the lack of an apparent cause of death, these effects of mirtazapine may have initiated a process leading to death.     

Estimation of ethanol concentrations in biological media. Comparison of alkylnitrite and direct vapor-phase methods

Ethanol assays in the blood, saliva and urine were made according to two methods: alkylnitrite gas-liquid chromatography and direct vapor-phase method without thermostating. N-propanol was used as an internal standard. For saliva and urine the methods produced similar results. For blood, the direct vapor-phase method detected significantly lower level of ethanol compared to alkylnitrite one (p = 0.001). 24-h storage of the samples in refrigerator does not deviate the results. Recommendations are provided for most effective usage of each method.     

Extraction of nitrobenzene and its metabolite 3-aminohydroxybenzene from water solutions

The article presents the results of nitrobenzene and 3-aminohydroxibensene extraction from aqueous solutions by means of five organic solvents. The following factors influence on the extraction degree is shown: the nature of the extracting agent, aqueous phase pH, saturation of some extracting agents with water. The number of extractions for isolation of the necessary quantities of the compounds studied is calculated.     

Scene investigation, identification, and victim examination following the accident of Galaxy 203: disaster preplanning does work

Galaxy Airlines Flight 203 crashed following takeoff from Reno-Cannon International Airport on 21 Jan. 1985. Sixty-eight persons on board the aircraft perished in the initial crash and resultant fire which followed. Two victims expired as a result of crash injuries within subsequent days and one passenger survived. A community disaster response plan was in place and had been practiced by local government agencies before this incident. The successes of this preplanned response, as well as methods of actual recovery, identification, and examination of the victims is presented.
