L'impact du mode de scrutin sur l'élection des femmes à l'Assemblée fédérale Suisse (1995‐2003)

Cet article analyse l'impact du système électoral sur l'élection des femmes à l'Assemblée fédérale (1995‐2003). La littérature a souvent mis l'accent sur l'importance du système proportionnel en vue de l'amélioration de la représentation des femmes au Parlement en se concentrant souvent uniquement sur le taux de femmes élues. Dans cet article, nous argumentons qu'il est nécessaire d'étudier les trajectoires des candidats et de prendre en compte à la fois les candidats hommes et femmes. Nous montrons que l'effet women‐friendly du système proportionnel au Conseil national semble davantage jouer au niveau de la stratégie de désignation des candidats et des candidates que lors de leur élection, et ce particulièrement pour les partis politiques du centre et de droite.     

The state of nature in the shadow of contract formation: Adding a missing link to J.M. Buchanan's social contract theory

The social contract theory of J.M. Buchanan provides no clear-cut answer on the question which one of the multitude of possible Pareto-efficient contracts is chosen by individuals who shape a contract in an (imaginary) state of nature. This deficiency is remedied in this paper by adding the Nash-bargaining theory. It seems to be in line with at least part of Buchanan's reasoning. Whereas for Buchanan the configuration of contract depends unilaterally on the natural equilibrium of the state of nature, we are able to show that the parties' (rational) contractual expectations have repercussions for their behavior in the state of nature. That is why the location of the natural equilibrium proves to be heavily dependent on the chosen bargaining theory. The implication is that assessing the legitimacy of a given constitutional order or contract (on the basis of the natural equilibrium) depends on the particular bargaining theory chosen to solve the underlying constitutional distribution problem. HIV/AIDS in prisons: recent developments

In a report released on 20 November 2002, entitled Action on HIV/AIDS in Prisons: Too Little, Too Late--A Report Card, the Canadian HIV/AIDS Legal Network concluded that despite repeated studies and nearly ten years of recommendations for urgent and pragmatic action, the response of Canadian governments to HIV/AIDS, HCV, and injection drug use in prisons remains inadequate. Only a few weeks later, the House of Commons Special Committee on Non-Medical Use of Drugs released its report, which contained a number of recommendations to the Correctional Service of Canada. Although the Committee avoided talking about needle exchange programs in prisons, it did recommend them! Meanwhile, in Ireland, not even condoms or bleach are provided.     

Fatal outcome of poisoning with the benzodiazepines flunitrazepam and diazepam

On a wintry day a 29-year-old woman was found dead beside her car showing head injuries and signs of hypothermia. Several empty packets of sedative and hypnotic drugs were lying inside the car. Toxicological analysis revealed the presence of flunitrazepam (heart blood of the left and right chamber 0.033 mg/L each), norflunitrazepam (left heart blood 0.029 mg/L, right heart blood 0.027 mg/L), 7-amino-flunitrazepam (left heart blood 0.090 mg/L, right heart blood 0.104 mg/L), diazepam (left heart blood 0.395 mg/L, right heart blood 0.386 mg/L), nordazepam (left heart blood 0.112 mg/L, right heart blood 0.115 mg/L) and temazepam (left heart blood 0.034 mg/L, right heart blood 0.033 mg/L). Neither alcohol nor other drugs were found. It was concluded that benzodiazepine intake led to a disturbance of consciousness. Whether the woman died in this situation due to the icy temperature as a result of hypothermia or whether she died or would have died solely due to benzodiazepine overdosage could not be clarified.     

Accidental drowning due to tropane alkaloid abuse

The cause of drowning deaths in good swimmers may be difficult to solve. After homicide, suicide and other kinds of immersion deaths have been ruled out, not only alcohol and narcotics, but also other psychotropic substances such as thornapple and angel's trumpet should be taken into consideration--at least in adolescents and young adults. The article reports on an accidental death by drowning under the influence of tropane alkaloids after consumption of a decoction of the flowers of angel's trumpet.     

Hemopericardium caused by endocarditis ulcerosa: an unusual cause of sudden death in adolescence

The authors report on the case of a 18-year-old student who died suddenly and unexpectedly of a pericardial tamponade after perforated ulcer-polypous endocarditis of the aortic valve. The detection of aerococcus urinae--which usually causes urinary tract infection--on the inflamed aortic valve demonstrates an unusual pathogenetic chain linking complexes of findings in the urogenital system and the heart.     

Religiöse Pluralität im nationalen Verfassungsstaat

This article is intended to provide a both functionalist and institutionalist understanding of current conflicts regarding a binding cultural core, religious plurality and multiculturalism, which would allow for an explanation of the corresponding historical process. In order to attain this goal, the functional differentiation and institutional shaping of politics is systematically reconstructed with a special focus on the differentiation of religion and politics, church and state, the handling of religious plurality and the political inclusion of religious minorities. The argument unfolds in the following four steps: (1) emergence of the state’s monopoly of power and the separation of spiritual and worldly power (functionalism I); (2) nation state and popular sovereignty as historical forms of the functional differentiation of politics (functionalism II); (3) the constitution as civil religion of politics organized in state form (institutionalism I); and (4) historical forms of civil religion and the institutionalization of religious plurality (institutionalism II).
