Engineers versus managers: experts,market-making and state-building in Putin's Russia

Abstract

Market-making and state-building are mutually reinforcing processes. This paper documents the role played in these processes by two groups of experts in Russia's electricity sector: technical experts and managerially trained experts. I develop two arguments: (1) a shift in the relative power positions of these two groups was a constitutive element of the marketization and liberalization of the electricity sector. The victory of the managerial experts made assets legible and therefore ‘value-able’. (2) the paper demonstrates that the promotion of managerial experts at the expense of technical experts was a deeply political transformation, as it involved the replacement of a well-established, well-connected group of incumbent political actors. More specifically, I show how the promotion of managerial experts at the expense of technical experts helped the federal government of President Putin eliminate one of the main challengers to its ability to regulate economic activity from the centre – regional governors.

§ 285 Abs 1 StPO l?sst ausdrücklich nur eine (einzige) Ausführung der Nichtigkeitsbeschwerde zu. Wird im Fall der neuen Ausl?sung der Ausführungsfrist infolge neuerlicher Urteilszustellung nach Protokollberichtigung (§ 271 Abs 7 letzter Satz StPO) oder Urteilsangleichung innerhalb dieser Frist eine (neue) Ausführung der Nichtigkeitsbeschwerde eingebracht, ist letztere die einzig wirksame. Die frühere (vor Urteilsneuzustellung eingebrachte) Ausführung wird durch die Neueinbringung gegenstandslos und damit unbeachtlich. Nur wenn der Nichtigkeitswerber die Einbringung einer neuen Ausführung unterl?sst oder sich mit der – nicht einer eigenst?ndigen Ausführung gleichkommenden – Erkl?rung begnügt, die bereits eingebrachte Ausführung aufrechtzuerhalten bzw blo? auf diese zu verweisen, beh?lt die frühere (sodann weiterhin einzige) Ausführung Wirksamkeit. In der Ausführung der Nichtigkeitsbeschwerde enthaltene Verweise auf andere Rechtsmittelschriften sind unbeachtlich.     

The right of withdrawal in the treaty of Lisbon: a game theoretic reflection on different decision processes in the EU

The ways of decision-making within the EU have significantly changed in the last decades: The rule of unanimity has been more and more substituted by majority voting in order to speed up decision-making processes in a Union of 27 heterogeneous member states. A third possibility is now offered by the Lisbon Treaty including a constitutional right of withdrawal. A member state encountering a loss in its benefits caused by a decision made by majority voting may now demand compensating transfers by using the right of withdrawal. It might threaten to leave the EU if the compensation is denied. Hence, does this mean that member states now have regained a negotiation power comparable to the right to veto? Using a game theoretic approach we investigate the amount of compensating transfers to be offered under majority decisions with exit option compared to decisions requiring unanimity.     

EXCLUSIONARY PRICING AND CONSUMERS HARM: THE EUROPEAN COMMISSION'S PRACTICE IN THE DSL MARKET

The assessment of exclusionary abuses by dominant firms is byno means an easy task. This is particularly true for pricingabuses, as there is no clear-cut way of distinguishing a pricecut that is abusive from one that instead is pro-competitive.We argue that there are several shortcomings in the way theEuropean Commission as assessed exclusionary pricing abusesin two important decisions concerning Internet access servicemarkets: Deutsche Telekom AG and Wanadoo Interactive. Firstof all, in computing downstream costs to apply the price squeezetest the incumbent's economies of scale and unavoidable costsshould be factored in, as the test is only meant to establishwhether an as-efficient competitor has been unlawfully foreclosed.Secondly, since the price squeeze test provides only for a necessarycondition for predation to occur, it is also necessary to provethat the recoupment of initial losses is a plausible scenarioso that the conduct under examination may indeed turn out tobe harmful to consumers. This is all but a trivial task, asthere are some sources of endogeneity that may cause a radicalchange in the underlying market structure. Particularly, inmarkets at early stage of development, entry barriers that mayfacilitate the recoupment of initial losses ex-ante may causea change such that market structure no longer supports recoupmentex-post.     

Medical care of individuals residing in substance abuse and recovery homes: an analysis of need and utilization

The current study examined medical care need and utilization patterns among a substance abusing and recovering population (n = 876), investigating factors such as employment and drug use categories (e.g., pharmaceutical use, cocaine use, heroin use, alcohol use). It was found that those who were unemployed needed and utilized greater medical care than those who were employed. Results indicated that heroin, cocaine, and/or alcohol use was not predictive of medical care need or utilization, whereas pharmaceutical drug use was predictive of medical care need and utilization. Trauma and risky use of substances were not significant predictors of medical care need or utilization whereas the suicide severity composite was significant. Potential implications for misuse of medical services (e.g., to obtain pharmaceutical drugs of use) and federal medical care expenditure allocation are discussed.     

Mixed fatal poisoning caused by taking L-methadone and chloral hydrate

A 42-year-old female drug user who was enrolled in a methadone maintenance program was found dead in her apartment. Cause of death was an intoxication with chloral hydrate and L-methadone. Trichloroethanol (TCE), the primary metabolite of chloral hydrate, was quantified by solid phase microextraction (SPME) and GC/MS in heartblood (27 micrograms/ml) and urine (338 micrograms/ml). D- and L-methadone were differentiated by chiral HPLC, which showed that only L-methadone had been taken. The quantitation of L-methadone and its metabolite EDDP was carried out by GC/MS from heartblood (1300 ng/ml and 86 ng/ml, respectively), urine (5239 ng/ml and 4960 ng/ml, respectively) and gastric contents (159 ng/ml and 122 ng/ml, respectively). The concentrations of both--trichloroethanol and methadone--were in toxic ranges.
