Keine Diebstahlsfähigkeit von Kennzeichentafeln

Durch ein in deren Wegnahme bestehendes Unterdrücken von Kennzeichentafeln (§ 49 KFG 1967) wird Diebstahl nicht begründet. Unter Diebstahl von Kennzeichentafeln iSd § 51 Abs 4 KFG 1967 ist deren strafrechtlich als Urkundenunterdrückung nach § 229 Abs 1 dritter Fall StGB zu beurteilende Wegnahme zu verstehen.     

UVS oder Strafjustiz: Wer kontrolliert die Kriminalpolizei?

Der VfGH hat am 16. 12. 2010 mit Erkenntnis VfGH G 259/09 ua wesentliche Teile der Einspruchsregelung des § 106 StPO als verfassungswidrig aufgehoben. Das hat unmittelbare Folgen für den Rechtsschutz im Ermittlungsverfahren. Diese Konsequenzen sollen im folgenden Beitrag kritisch beleuchtet werden. Au?erdem wird ein Ausblick auf m?gliche Regelungsmodelle de lege ferenda gegeben.     

Financing the UN development system and the future of multilateralism

This article seeks to accomplish four tasks. It explores the historical relationship between the financing instruments that dominated different phases of the evolution of the UN development system and the understanding of the concept of multilateralism. Bearing in mind this historical context, it seeks to analyse the defining characteristics of multilateral finance in the context of the UN, in particular the characteristics that make a financial instrument more or less multilateral. It then explores a number of new financial instruments and their possible impact on the future shape multilateralism takes in the UN system. The article concludes with some thoughts on financing for a new multilateralism. In order to go beyond the core/non-core stalemate, it is necessary to develop a new variable geometry based on function, which brings into play assessed, negotiated pledges, voluntary core and non-core instruments.     

Norms and niches: Voices in higher education

This article is based on observations that I made in 1998/99 in mother-tongue classes in a Danish university. I found that in the most frequently used methods of teaching either the teacher lectured, and accordingly the teacher was the key character, or students made presentations, in which case students were key characters. I understand this kind of teaching as a construction, and in my discussion I relate it to stage theory. In my view these lectures resemble a traditional dramatic play built on a conflict and on an interruptive form in the dialogues. But I have also observed another kind of teaching, an undramatic one in which the dialogues have a more associative form. These two forms of constructions are discussed in relation to the concepts "teaching" and "learning", and in relation to the categories "man"/"woman" and the code "masculine"/"feminine".     

Making Equality Diverse? Merged Gender Equality and Anti-Discrimination Measures in Norway

This article enquires into a shift in policy work related to equality and discrimination by examining to which extent gender equality has been complemented by a focus on ethnic discrimination in a report issued by the Norwegian Equality and Anti-Discrimination Ombud. The empirical analysis illustrates how the discrepancies between the report's intentions and its content reveal tough conditions for new categories of inequality in a country topping the international statistics on gender equality. The article argues that a substantial part of the report builds on political strategies the main aim of which has been to include women into public spheres and that such strategies do not correspond to intentions to include difference and diversity into the framework of the examined report.     

Entsicherte Verhältnisse – (Un)Möglichkeiten fürsorglicher Praxis

Starting point of the article are the upheavals of employment relationships in modern, post-Fordist societies. These are characterised by the increasing relevance of efficiency in social lives because of blurring boundaries between paid work and private life or growing processes of precariousness through uncertainties of social regulation. The author argues that these processes are accompanied by shifting conflicts between paid work and private care responsibilities, which are still oriented at the Fordist gendered division of work and gender classification but should not be seen as a simple repetition of those. By presenting three case studies from an empirical research project on the retail trade in Brandenburg and Berlin, specific problems of the reconciliation between paid work and private care as well as ways to solve these are analysed. The article ends with a discussion whether (often forced) changes in life style open some (often precarious) capabilities for questioning the gendered division of labour which has been formerly taken for granted.     

When Fairness is Especially Important: Reactions to Being Inequitably Paid in Communal Relationships

This article focuses on when justice is especially important to people and, in doing so, explores the social conditions under which the importance of justice may change in social interactions. More specifically, the authors examine how different types of relationships affect evaluations of equitable and inequitable situations. It is argued that when people are confronted with friends as interaction partners, as opposed to unknown others, they are motivated to attend to the needs of their friends (Clark & Mills, Journal of Personality and Social Psychology, 37, 12–24, 1979) and, therefore, they are not only concerned with their own outcomes, but also with their friends’ outcomes. As predicted on the basis of this line of reasoning, two experiments demonstrate that when people’s interaction partners are friends, people are indeed more satisfied with being underpaid and less satisfied with being overpaid compared to when their interaction partners are unknown others. In the discussion, it is argued that these findings suggest that justice is especially important to people when they are in communal relationships.
