The Supreme Court in 1973 in Roe v. Wade established that decision of first trimester abortion is left to the physician, exercising his best medical judgment, in consultation with the patient. During this period the state may not regulate abortion determination since there is no compelling state interest; therefore a physician performing abortion will be precluded from civil or criminal liability. In second trimester abortion the state has a compelling interest in the health of the mother and may regulate the procedure to protect maternal health; although a previable fetus may be able to survive the abortion, Roe v. Danforth definitively places the woman's right to an abortion above the life of the fetus during the previable stage; therefore the state cannot seek to safeguard the life or health of the fetus during the abortion. Third trimester abortion implies a viable fetus; thus, a compelling state interest in the potential life arises and the state may regulate and proscribe abortion except when necessary for the life and health of the mother. The determination of when viability has been achieved is a matter of judgment resting with the physician who has the choice of techniques and operating procedures which may or may not be fatal to the unborn. It is a question of either termination of pregnancy or destruction of the fetus. In this last case the legal responsibility placed upon the physician is very serious, and involving a risk of civil and criminal liability. Uncertainties as to the boundaries of legal abortion and the threat of criminal liability can only result in a reluctance among physicians to perform second and third trimester abortions, which is against the fundamental right to abortion guaranteed by the Constitution. The Supreme Court will have to elaborate upon the scope of the abortion right, whether it encompasses fetal destruction or only termination of pregnancy, because it directly affects the extent and quality of maternal and fetal care that must be rendered by a physician. If only termination of pregnancy is included the Court must resolve whether the woman's health interests predominate, or whether the physician can be required to enhance fetal survival. This study of a predominantly Hispanic sample of 92 male and 140 female college students examines both gender symmetry in intimate partner violence (IPV) and inconsistent relationships found in previous studies between sexist attitudes and IPV. Results indicate that although comparable numbers of men and women perpetrate and are victimized in their relationships with intimate partners, the path models suggest that women's violence tends to be in reaction to male violence, whereas men tend to initiate violence and then their partners respond with violence. Benevolent sexism was shown to have a protective effect against men's violence toward partners. Findings highlight the importance of studying women's violence not only in the context of men's violence but also within a broader sociocultural context. 相似文献

Psychiatric disorders of 142 parents of adolescents who were documented as physically abused during adolescence and 168 parents
of non-abused comparison adolescents were assessed. Fathers and mothers of physically abused adolescents exhibited higher
rates of Axis I diagnoses and co-occurring disorders, and had more impaired GAS scores than comparison parents. Fathers of
abused adolescents had greater lifetime incidence of Conduct Disorder and Substance Abuse/Dependence than comparison fathers.
Mothers of abused adolescents had more unipolar depressive disorders than comparison mothers. This study highlights the importance
of mental health assessments and interventions for parents of physically abused adolescents. Since onsets of parental psychiatric
disorders antedated the abuse, early recognition and treatment of parental disorders may contribute to prevention of the onset
and/or reoccurrence of adolescent physical abuse.

A growing concern among municipal officials across the United States is that their policymaking capacity is under attack by state legislatures who are increasingly likely to preempt those municipalities. However, determining the extent to which municipalities are preempted is challenging. We overcome this by surveying a large sample of municipal officials from across the United States. We find that officials from municipalities that are more ideologically distant from their state overall are more likely to report being preempted by their state government. Moreover, this pattern is driven by more liberal municipalities in both Republican and Democratic states reporting higher rates of preemption. Additionally, municipalities under unified state governments are more likely to report preemption, especially those under unified Republican control. These findings have important implications for the quality of representation in our federalist system and indicate that preemption is not just an issue between Republican states and liberal urban cities. 相似文献

This article presents an examination of post-conflict water resource management in East Timor through the United Nations Transitional Administration in East Timor (UNTAET) with the aim of contributing to our understanding of the opportunities and challenges inherent to the sustainable management of water resources in post-conflict countries and of gaining insight into its potential long-term benefits for sustaining peace. In order to measure ideology, political scientists heavily rely on the so-called left-right scale. Left and right are, however, abstract political concepts and may trigger different associations among respondents. If these associations vary systematically with other variables this may induce bias in the empirical study of ideology. We illustrate this problem using a unique survey that asked respondents open-ended questions regarding the meanings they attribute to the concepts “left” and “right”. We assess and categorize this textual data using topic modeling techniques. Our analysis shows that variation in respondents’ associations is systematically related to their self-placement on the left-right scale and also to variables such as education and respondents’ cultural background (East vs. West Germany). Our findings indicate that the interpersonal comparability of the left-right scale across individuals is impaired. More generally, our study suggests that we need more research on how respondents interpret various abstract concepts that we regularly use in survey questions. 相似文献

Discretion used to be considered a feature of individuals, but growing literature shows that it has collective features as well. To develop an understanding of the individual and cooperative work of inspectors in using discretion and the discretionary room granted to them, we compared two inspectorates: the Care Quality Commission (CQC) in England and the Joint Inspectorate for Youth (JIY) in the Netherlands. Our analysis reveals that inspectors engage with colleagues, managers, and stakeholders to include other perspectives, gain mandate, and broaden their repertoire. At the CQC, inspectors use their discretion collectively; on their own initiative, they involve others in balancing and interpreting rules to reach judgments. At the JIY, teamwork is central and regulatory teams are granted collective discretionary room. We argue that collective work permits both responsiveness and consistency. In studying the judgments of inspectors and other street‐level bureaucrats, it is vital to look at collective work and how it combines consistency and responsiveness. 相似文献

This cross-sectional study tests a conceptual financial socialization process model, specifying four-levels that connect anticipatory
socialization during adolescence to young adults’ current financial learning, to their financial attitudes, and to their financial
behavior. A total of 2,098 first-year college students (61.9% females) participated in the survey, representing a diverse
ethnic group (32.6% minority participation: Hispanic 14.9%, Asian/Asian American 9%, Black 3.4%, Native American 1.8% and
other 3.5%). Structural equation modeling indicated that parents, work, and high school financial education during adolescence
predicted young adults’ current financial learning, attitude and behavior, with the role played by parents substantially greater
than the role played by work experience and high school financial education combined. Data also supported the proposed hierarchical
financial socialization four-level model, indicating that early financial socialization is related to financial learning,
which in turn is related to financial attitudes and subsequently to financial behavior. The study presents a discussion of
how the theories of consumer socialization and planned behavior were combined effectively to depict the financial development
of young adults. Several practical implications are also provided for parents, educators and students. 相似文献
