Summary An effort that began as an experimental alternative to small claims court for consumer cases has fostered the application of alternative dispute resolution to many other conflicts in Massachusetts. The Attorney General's Face-to-Face Mediation Program, unique in the country, has proven to be an effective local resource to citizens of the state for resolving consumer disputes. The influence of the program has been felt outside the Attorney General's office as well as within.In the two years since this report was written, the Attorney General's Face-to-Face Mediation Program has shown a steady increase both in referrals and in quality of service. Today, all but one of the seven remaining mediation programs is running at or near capacity. In 1988, 84 percent of the approximately 700 cases that were mediated reached agreement, and 96 percent of those agreements were upheld.

Abstract: There has been a continued loss of wetlands in Ontario as pressurcs from conflicting land uses escalate. This paper examines the manner in which the Ontario Municipal Board has treated the issue of wetlands protcction in hearings on land-use disputes in the provinw. Bastul on a review of nine wetlands caws dating from 1980 to 1993, the decision-making process of the Ontario Municipal Board was examined with regard to wetlands prokxtion. Analysis of the cases revealed a number of issues: the lack of relevant information at hearings; the role of policy and legislation in thc decision-making process; the use of negotiation and mediation in the hearing process; and the significance of private property rights versus the public interest in wetlands protection. This paper dismsses these issues in the context of the role of the Ontario Municipal Board in the planning and management of wetlands in Ontario. This article reconsiders Victorian images of mermaids and sirens through a detailed examination of two images: Frederic Leighton's Lieder ohne Worte (1861, oil on canvas, Tate Britain) and Edward Burne-Jones's The Depths of the Sea (1886, oil on canvas, private collection). It demonstrates that the themes of water, music and femininity were entwined in the Victorian imagination, by setting these two paintings within the context of Victorian artistic, literary and cultural production. It shows that musical images were prevalent in the emerging Aesthetic movement. Musical subjects freed artists and audiences from the conventions of narrative interpretation, and allowed them instead to concentrate on exploring mood and colour. Pictures of mermaids add a further twist to the Aesthetic preoccupation with music. This article reveals that mermaids made explicit the underlying connection between musical performance and sensuality. It also suggests that the idiosyncratic depiction of the mermaid by Burne-Jones and the ambiguous sexuality of Leighton's figures could be read as symptomatic of changing conceptions of desire. It argues that these images embodied the shift from ardour to libido. In other words, love was no longer described as burning and fixed, but as fluid and shifting. This transformation in the way desire was theorised was most urgently presented in Freud's Three Essays on Sexuality (1905). However, this article suggests that the same ideas were being made visible in Aesthetic art and writing from the mid-nineteenth century. 相似文献

Before its reversion to Chinese sovereignty in July 1997, Hong Kong was preoccupied with safeguarding its autonomy while China insisted on keeping separate the two political systems of Hong Kong and the mainland. Toward these ends, everyone focused on Hong Kong's own governing councils and ignored its future status within China's congress system. Not until the December 1997 deadline approached for naming Hong Kong's delegation to the March 1998 meeting of China's new Ninth National People's Congress, did the full implications of this oversight become apparent. Hence, the institutional channels whereby the two systems must interact are actually rooted in the reforming structure of China's congress system. Delegate selection in Hong Kong revealed a new ‘bridging’ function whereby the two legislative systems are linked through the old organization tactic of concurrent membership. The bridging function also illuminates previously unheralded features of Hong Kong's new post‐1997 government, as a replica and appendage of China's people's congress network. 相似文献
