FAMILY COURTS-20 YEARS AFTER REFORM

The Rt. Hon. Dame Elias discusses the changes the people of Australia and New Zealand have seen and can expect from their respective family courts. She goes on to say that if judges of the family court are to play a more positive role in society, they need to stay abreast of what is happening with current legal trends as they relate to the "best interest of the child" standard, equal rights (especially between genders), and changing international trends in family law. The Chief Justice also addresses problems concerning lack of legal aid funding and an increase in unrepresented litigants. The Chief Justice explains that these issues and problems can best be dealt with through legislative reform as well as family court reform. Where there is an influx of additional resources better preparing judges to deal specifically with those seeking justice in the family court, these additional resources should also lead to a greater general understanding of current trends in the community. Chief Justice Elias asserts that without community support, these issues cannot be resolved.     

MEDIATION IN THE FAMILY COURT OF AUSTRALIA

The chief justice of the Australian Family Court discusses the use of mediation in the Family Court of Australia. He traces the legislative origin and the basic purposes of the service. Of particular interest is the differentiation between mediation, conciliation, and the court process. The limitations are also discussed, especially the use of mediation in domestic violence situations.     

Civil Service Law in the People's Republic of China: A Return to Cadre Personnel Management

Despite the outward appearance of depoliticization, the civil service in China today is actually being repoliticized. This paper compares the 1993 Provisional Regulations on State Civil Servants with the Civil Service Law approved by the Standing Committee of the National People's Congress of the People's Republic of China (PRC) in April 2005 . The 2005 reform formalized what had been a historical pattern—the Communist Party holds tight control over leadership change and management at various levels. The Civil Service Law has turned the Communist Party of China into a political institution that has become the source of both civil service empowerment and control. Although civil service reform in China differs markedly from approaches adopted elsewhere, China is clearly expanding its political control to ensure greater leverage over the bureaucracy. In this regard, China is in line with the global trend. That said, civil service reform in China has focused on structural elements and formal reorganizations, whereas most industrialized democracies have engaged in a dialectic between individualist and corporate responses to managerial questions. An understanding of the Chinese ability to adopt reforms—while strengthening its traditional hold—provides key perspectives not only on the world's largest nation and a rapidly emerging force in global political and economic relationships but also on the Chinese experience with important public sector reforms that have occurred in many other countries over recent decades.

我国农村经济的发展长期处于资金短缺的状态。当前解决农业资金需求问题,一方面要加大政府对农业的支出,另一方面也应该改进财政支农资金使用方法,发挥金融杠杆的作用,引导更多的社会资金投入农业经济。
