Identity and world order in India’s post-Cold War foreign policy discourse

This article examines the dominant conception of world order in India’s post-Cold War foreign policy discourse. Drawing on a poststructuralist, discourse-theoretical framework, I argue that the discourse uses foreign policy and world order as sites for the (re-)production of India’s identity by placing India into a system of differences that constitutes ‘what India is’. The article shows that India’s foreign policy discourse frames world order in accordance with India’s own national experiences and thus seeks to upheave India’s identity to a position from where it can represent the universal: a global political community. This notion of Indian Exceptionalism constitutes the affective dimension of the discourse that obscures the absence of an extra-discursive foundation on which national identities could be grounded by endowing the Self with an imaginary essence and seemingly unique qualities.     

The political economy of fertility

This paper studies the political economy of fertility. Specifically, I argue that fertility may be a strategic choice for ethnic groups engaged in redistributive conflict. I first present a simple conflict model where high fertility is optimal for each ethnic group if and only if the economy’s ethnic diversity is high, institutions are weak, or both. I then test the model in a cross-national dataset. Consistent with the theory, I find that economies where the product of ethnic diversity and a measure of institutional weakness is high have increased fertility rates. I conclude that fertility may depend on political factors.

Die Entstehung eines Bergbauabfallrechts – Rechtsfragen der Umsetzung der Bergbauabfallrichtlinie 2006/21/EG

Zusammenfassung Für die Bewirtschaftung bergbaulicher Abf?lle existierten bisher auf EG-rechtlicher Ebene keine spezifischen Regelungen, sondern es galt allgemein die Abfallrahmenrichtlinie. Nach Katastrophen wie denen von Aznal Cóllar, Baia Mare und Baia Borsa wurde dies als Regelungsdefizit empfunden, so dass die Europ?ische Kommission Mitte 2003 eine sektorale Abfallrichtlinie vorschlug. Die Richtlinie über die Bewirtschaftung von Abf?llen aus der mineralgewinnenden Industrie wurde am 15.3.2006 verabschiedet. Damit wurde der Grundstein für ein eigenst?ndiges Bergbauabfallrecht gelegt. Ziele der Richtlinie sind die Erh?hung des Sicherheits- und Umweltschutzniveaus durch die Reduzierung der Gef?hrlichkeit und Menge bergbaulicher Abf?lle, den Vorrang der Verwertung, die erzeugungsortnahe Behandlung und die sichere Beseitigung. Diese Ziele sollen erreicht werden durch Festlegung EU-einheitlicher Mindestanforderungen. Eine gewisse Privilegierung bergbaulicher Abf?lle gegenüber dem Deponierecht erscheint dem europ?ischen Gesetzgeber dabei aufgrund der bergbaulichen Sondersituation gerechtfertigt, da zur Bodenschatzgewinnung zwangsl?ufig Bodenmaterial verlagert werden muss und typischerweise Nebengestein anf?llt, das auch gef?hrliche Abf?lle enthalten kann. Gegenw?rtig wird daran gearbeitet, die Richtlinie in nationales Recht umzusetzen. Geplant sind sowohl bergrechtliche (in Gestalt einer ?nderung der ABBergV und der UVPV-Bergbau) als auch abfallrechtliche Regelungen (vorwiegend im Rahmen des Deregulierungsvorhabens “integrierte DepV”). Dieser Beitrag zeigt die systematischen Besonderheiten des Bergbauabfallrechts auf und beleuchtet einige zentrale Umsetzungsfragen für das nationale Berg- und Abfallrecht.     

"I am flying to the stars"--suicide by aircraft in Germany

In 2006, 67 persons were killed in aircraft accidents in Germany and involving German aircrafts abroad. In spite of extensive investigation of each aircraft accident, there are no reliable data as to the number of suicides by aircraft. We report on a 50-year-old man who committed suicide by willfully crashing his Beech "Sierra" aircraft minutes after take off from an airport close to the town of Rendsburg, Germany. Before killing himself, the intoxicated pilot had sent an SMS announcing his suicide plans to a friend. The findings of the medico-legal investigation and the results of a review of aircraft accident reports by the German Federal Bureau of Aircraft Accidents Investigation (BFU) regarding suicidal plane crashes are presented.
