The Rise of Linguistic Philosophy and Pragmatic Turn in Jurisprudence Research on Hart’s Jurisprudence Under Language Game

Linguistic turn from epistemology to linguistic philosophy constitutes the most important philosophy thinking foundation in 20th century western Jurisprudence. Under the background of this kind of theory current of thought H.L.A. Hart, the master of western Jurisprudence, succeeded in applying the theory of language game advocated by Wittgenstein into the research of Jurisprudence and caused the pragmatic turn of 20th century western Jurisprudence. Hart’s methodology is one of the most precious resources in Chinese Jurisprudence research, so our Jurisprudence research should learn and benefit from it.     

Haben BBodSchG und BBodSchV unmittelbar zulassungsmodifizierende Wirkung?

Das OVG Koblenz hat sich kürzlich zum Verh?ltnis einer bergrechtlichen Betriebsplanzulassung zu der “neuen” Bodenschutzgesetzgebung ge?u?ert. Im Kern ging es darum, ob für ein Verfüllvorhaben in einer Lavagrube die in einem (vor Verabschiedung des BBodSchG erlassenen) bergrechtlichen Zulassungsbescheid in Verweis genommenen Grenzwerte einer Verwaltungsvorschrift oder die strengeren Werte der BBodSchV gelten. Das OVG Koblenz hat grundlegend entschieden, dass dem BBodSchG und der BBodSchV unmittelbar zulassungsgestaltende Wirkung zukomme. Diese Entscheidung überzeugt nicht.     

Random Coefficient Models for Time-Series-Cross-Section Data: Monte Carlo Experiments

These models allow forunit to unit variation in the model parameters. The heart ofthe article compares the finite sample properties of the fullypooled estimator, the unit by unit (unpooled) estimator, andthe (maximum likelihood) RCM estimator. The maximum likelihoodestimator RCM performs well, even where the data were generatedso that the RCM would be problematic. In an appendix, we showthat the most common feasible generalized least squares estimatorof the RCM models is always inferior to the maximum likelihoodestimator, and in smaller samples dramatically so. Die Politische Vierteljahresschrift im Urteil der Profession: Ergebnisse einer Umfrage unter den Mitgliedern der DVPW

The authors present results from a survey conducted among members of the German Political Science Association (?Deutsche Vereinigung für Politische Wissenschaft“, DVPW) pertaining to the usage and evaluation of the Politische Vierteljahresschrift in the context of other national and international political science journals. The results show that 50 years after its inception the PVS is an accepted part of the profession in Germany. Its articles are widely read, although mostly in a selective manner, differentiated by subdisciplines. As a place for publishing research findings it is of interest for almost all respondents. The journal’s evaluations are overall positive. From the perspective of its addressees the PVS fulfils its professional mission. However, in some respects its performance is seen as improvable.     

Die Berücksichtigung von Belangen des Bodendenkmalschutzes in bergrechtlichen Planfeststellungsverfahren mit Umweltverträglichkeitsprüfung

Bei der Durchführung von Bergbauvorhaben im Tagebau kann es zu vielf?ltigen r?umlichen Nutzungskonflikten kommen. St?rkere Aufmerksamkeit genie?en zunehmend F?lle, in denen Bodendenkmale in der in Aussicht genommenen Abbaufl?che liegen. Dabei ist fraglich, inwieweit Belangen des Bodendenkmalschutzes in bergrechtlichen Planfeststellungsverfahren mit Umweltvertr?glichkeitsprüfung (UVP) Rechnung getragen werden kann und muss, wobei sich dieser Beitrag auf die Rahmenbetriebsplanzulassung mit UVP beschr?nkt. Eine rechtliche Analyse ergibt zun?chst, dass Bodendenkmale Gegenstand der UVP sein müssen, gleich ob sie formal unter Schutz gestellt sind oder nicht. In der praktischen Bew?ltigung solcher Nutzungskonflikte hat die Bergbeh?rde sodann verschiedene Gestaltungsm?glichkeiten, die im Folgenden anhand der jüngeren Rechtsprechung und Literatur dargestellt werden. Insbesondere ist die Bergbeh?rde unter den gegebenen Voraussetzungen befugt, eine eventuelle „Rettungsgrabung“ auf Kosten des Vorhabentr?gers anzuordnen.
