正Itraveled around Asia for business as CEO and business director together with my buyers between 1980 and 1993,in particular the annual trade fairs in China's mainland and Taiwan. In subsequent years I have returned to visit the same countries and the region privately in order to maintain acquaintances and to deepen my knowledge of Chinese culture.     

Perspektiven des künftigen österreichischen und europäischen Zivilrechts

Dieser Beitrag befasst sich einleitend mit dem ABGB, das international untersch?tzt und unzureichend beachtet wird. Dem ABGB, wie den anderen nationalen Kodifikationen, wird nunmehr freilich ein Konkurrent erstehen: ein Gemeinsames Europ?isches Kaufrecht, für das die Europ?ische Kommission jüngst einen Entwurf vorgelegt hat. Nach einem überblick über die Genese dieses Entwurfs bietet der Beitrag in seinem Hauptteil eine erste kritische Einsch?tzung. Er weist darauf hin, dass der Entwurf lückenhaft ist und unter einer Reihe inhaltlicher M?ngel leidet; auch eine Revision des acquis communautaire, die diesen Namen verdient, hat bislang nicht stattgefunden. Eine Analyse des Entwurfs wird dadurch erschwert, dass vielfach nicht erkennbar ist, warum seine Verfasser bestimmte Entscheidungen getroffen haben. Die praktischen Erfolgschancen des Gemeinsamen Kaufrechts sind skeptisch zu beurteilen. Das liegt nicht zuletzt an seinem in dreifacher Hinsicht eingeschr?nkten Anwendungsbereich und an den überkomplexen Regeln zu seiner Wahl. Auch sind die allgemeinen Rahmenbedingungen eher ungünstig, denn weder die Sprachenfrage noch das Problem einer einheitlichen Auslegung ist befriedigend gel?st. Zudem stützt sich die Kommission auf eine ungeeignete Rechtsgrundlage.     

The political economy of the green technology sector: A study about institutions, diffusion and efficiency

This paper discusses aspects related to the green technology sector (GT sector) in Germany. In a first step institutional reforms enabling diffusion of green technologies are analyzed. Cost arguments are also taken into account. In a second step a theoretical model developed by Tanguay et al. (Public Choice 120:1–27, 2004) is modified in order to evaluate the efficiency of the institutional setting in a political economy framework. The model is able to show that command and control policies (CCPs) are accompanied by cost-inefficiencies depending on the political weight of technology related interests groups. We further come to the result that relatively high marginal production costs may generate suboptimal high diffusion of a certain GT j. For relatively low marginal production costs policy induced demand may also be too low.     

Medical and legal aspects of genital mutilation and circumcision part I: female genital mutilation (FGM)

Female genital mutilation (FGM) is considered to be against the law and against morality not only in Western countries, although a woman of age and able to consent may sometimes think differently. The procedure may have serious physical and emotional consequences for the girl or woman. Nevertheless there are attempts to justify the procedure with medical and hygienic pseudoarguments, ideology, freedom of religion, cultural identity and social adequacy. Outside the Western world, some people claim that religion and culture alone justify the practice. In Germany, parents can lose the right to determine the residence of their daughter, if she is faced with the risk of genital mutilation in order to prevent that the child or girl is taken to her home country. Genital mutilation as a gender-specific threat is recognized as a reason to grant asylum or prevent deportation. Proposals to make genital mutilation a separate punishable offence are presently discussed by the legislator.     

From alcohol to liquid ecstasy (GHB)--a survey of old and modern knockout agents. Part 1: historic and classic knockout agents

Alcohol has been the most important knockout drug in history and literature and continues to play an essential role up to now. Blunt force to the head in the form of a knockout punch is another mechanism leading to a transient loss of consciousness. Diethyl ether and chloroform are among the classical knockout substances. Although they have meanwhile been replaced by modern sedatives and hypnotics, their use is still observed in isolated cases.     

More than wishful thinking: Causes and consequences of voters’ electoral expectations about parties and coalitions

Accurate expectations about the outcome of elections play a central role in psychological and economic theories of voting. In the paper, three questions about voters’ expectations are investigated. First, we identify and test several factors that influence the overall accuracy or quality of voters’ expectations. Second, the phenomenon of “wishful thinking” is tested and confirmed for expectations about the electoral performance of individual parties and coalitions. Finally, two mechanisms how expectations might influence voting behavior are identified and tested. Based on surveys from Austria and Germany, the results suggest that voters not only rely on expectations to avoid casting “wasted” votes for parties without electoral chances, but that they are able to engage in fairly sophisticated strategic coalition voting.     

社会创新过程及其面临的局限

识别社会需求、解决社会问题是社会创新过程中的一个重要环节,同时也是社会创新过程面临的陷阱和局限所在。结合社区发展规划的案例以及社会需求和问题表现特征的分析发现,在需求和问题分析过程中,问题标准的不恰当性、问题主体参与不足、忽视需求和问题原因表现出的二重性、参与主体的缺失等会导致社会需求识别出现偏差,同时这些偏差将进一步影响社会创新的低效,以及易使社会创新方案局限在项目的操作层次。     

Issues in Juvenile Program Implementation: A Case Study

Both adult and juvenile justice agencies seek to offer quality programs, but implementing a new program can be a difficult and daunting task. The purpose of this paper is to highlight the issues and concerns faced by one jurisdiction as a result of attempting to implement a new curfew check program. The goal is to share specific issues with general underlying solutions that may be utilized in other jurisdictions. An examination of the records of 79 juvenile offenders assigned to the program provides the information for this discussion. Results indicate that some basic assumptions of the program designers were incorrect, and that constant monitoring and the centralization of tasks were keys to program sustainability.     

Die Rückabwicklung nach Widerruf von Verbraucherverträgen

Eine Revision des acquis communautaire im Bereich des Verbrauchervertragsrechts ist h?ufig angekündigt, aber bislang nicht durchgeführt worden. Im Rahmen einer kleinen Arbeitsgruppe untersucht der Verfasser dieses Beitrags, wie eine derartige Revision aussehen k?nnte, die sich nicht nur auf eine rechtstechnische Harmonisierung des im Laufe der Jahre entstandenen Regelungsgeflechts beschr?nkt, sondern überprüft, welche Sonderregeln aus welchen Gründen vor dem Hintergrund des allgemeinen Zivilrechts erforderlich sind. Im vorliegenden Beitrag wird dies Untersuchungsprogramm für den Bereich der Rückabwicklung nach Widerruf von Verbrauchervertr?gen durchgeführt. Als Folie dienen dabei die allgemeinen Regeln über die Rückabwicklung fehlgeschlagener Vertr?ge, die in der Neuauflage der UNIDROIT Principles of International Commercial Contracts enthalten sein werden.
