The first commercial dispute settled by the WTO under the Sanitary and Phytosanitary Agreement concerned the disagreement between the European Communities and the United States over the European import ban on meat and meat products derived from cattle to which hormones have been administered for growth promotion purposes. The purpose of this paper is twofold: First, we analyse the WTO's approach to the notion of risk in the use of hormones and the role this played in reaching its decision to declare the EC ban on hormone-treated beef imports inconsistent with its obligations under the Sanitary and Phytosanitary Agreement. Second, we discuss the way in which the precautionary principle has been dealt with in the settlement of this conflict. We then show how this dispute has paved the way to a debate on the concept of protectionism to be applied in this kind of dispute. Jurors are supposed to rely on the judge's instructions for verdict selection. However, recent research indicates that people have constructed naive representations of crimes that conflict with the judge's instructions and that influence decision making. The present research explored potential solutions to this conflict. Two experiments revealed that the problem cannot be circumvented by avoiding people's prior knowledge; subjects activated and used their prior knowledge of crimes even when the crime name was withheld. Experiment 3 demonstrated that a supplementary instruction to disregard prior knowledge was also ineffective. Experiment 4 revealed that a supplementary instruction designed to revise subjects' existing representations did improve decision accuracy. These experiments indicate that the conflict between people's prior knowledge and the law cannot easily be avoided or disregarded, but its impact can be reduced by revising people's existing concepts. 相似文献
