Dagher redux: searching for the missing pieces

The most relevant question for any joint venture is, when does the relationship become a jointventure and not simply a price-fixing cartel? With respect to this question, this Article juxtaposes Texaco, Inc. v. Dagher, 126 S. Ct. 1276 (2006), against years of contrary precedent. In Dagher, the Court altered the seemingly settled foundation of antitrust law by changing its view on past holdings and abandoning the ancillary effects doctrine. The Article provides an outline of key holdings prior to Dagher, as well as a discussion of the issues that can arise as joint ventures are formed. Additionally, the authors examine how the decision altered the foundation of joint venture law in the United States. In particular, the Article exposes several important antitrust concerns relating to joint ventures that the Supreme Court did not address in Dagher. Perhaps the most perplexing issue of Dagher is whether the venture at issue would have survived analysis under the Federal Trade Commission's "continuum" approach.

Narrative Inquiry and the Search for Connectedness: Practitioners and Academics Developing Public Administration Scholarship

Maintaining a vibrant field of public administration requires ongoing efforts to link the worlds of academic researchers and practitioners. We suggest that research itself, traditionally pursued by academics, is a promising mechanism for making this connection. In particular, researchers and practitioners in public administration can do research together in a way that enhances mutual learning, draws on the strengths of each to create useful knowledge of high quality, appreciates and tolerates of each others' worlds, styles, and contributions. Using research to promote connectedness means rethinking the roles that practitioners and academics play in generating knowledge in the field. In our project, insights from the assumptions and practices of narrative inquiry helped us to identify three research roles for practitioners: as sources of knowledge, as producers of knowledge, and as active consumers who inform the research process.     

Pharmacogenomics as an aspect of molecular autopsy for forensic pathology/toxicology: does genotyping CYP 2D6 serve as an adjunct for certifying methadone toxicity?

Pharmacogenomics, applied as an aspect of molecular autopsy, may be used as an adjunct for certifying methadone fatalities. Methadone is metabolized by cytochrome P-450 (CYP) 1A2, 3A4, and 2D6. We hypothesized that methadone toxicity may be partially due to CYP 2D6 *3, *4, and *5 variant alleles, resulting in poor drug metabolism. A retrospective analysis was performed on covariables and risk factors of 21 methadone cases from the Milwaukee County Medical Examiner's Office (1998-2000). PCR genotyping showed: one heterozygous for 2D6*3, two homozygous for 2D6*4, five heterozygous for 2D6*4, and one heterozygous for both 2D6*3 and *4. This limited number of cases showed that the prevalence of poor metabolizer was higher but not significantly different from that of a control group (n = 23) (P > 0.05, Fisher Exact Test). Thus, CYP 2D6 mutations may not yet be directly associated with methadone toxicity. However, pharmacogenomics, complementing other case findings, served as an adjunct in interpreting methadone toxicity of poor and intermediate metabolizers.     

Background correction in forensic photography. I. Photography of blood under conditions of non-uniform illumination or variable substrate color--theoretical aspects and proof of concept

The combination of photographs taken at two or three wavelengths at and bracketing an absorbance peak indicative of a particular compound can lead to an image with enhanced visualization of the compound. This procedure works best for compounds with absorbance bands that are narrow compared with "average" chromophores. If necessary, the photographs can be taken with different exposure times to ensure that sufficient light from the substrate is detected at all three wavelengths. The combination of images is readily performed if the images are obtained with a digital camera and are then processed using an image processing program. Best results are obtained if linear images at the peak maximum, at a slightly shorter wavelength, and at a slightly longer wavelength are used. However, acceptable results can also be obtained under many conditions if non-linear photographs are used or if only two wavelengths (one of which is at the peak maximum) are combined. These latter conditions are more achievable by many "mid-range" digital cameras. Wavelength selection can either be by controlling the illumination (e.g., by using an alternate light source) or by use of narrow bandpass filters. The technique is illustrated using blood as the target analyte, using bands of light centered at 395, 415, and 435 nm. The extension of the method to detection of blood by fluorescence quenching is also described.     

From Machiavelli to Ms: differences in male-female power styles

While the concept of power has always been a concern to students of political science and public administration, it has been examined only peripherally in the last few years. Recent work by McClelland has indicated that power may be a very important variable in explaining managerial behavior and organizational effectiveness. Starting with a definition of power provided by McClelland, this paper develops a conceptual framework for analyzing power-related behavior in an organizational setting. The framework is then applied to a problem area of particular interest to the authors--the question of whether or not women managers can be expected to behave differently than their male counterparts because of possible differences in their orientations toward power. We conclude that differences in power needs will not impede the effectiveness of female managers, but women may be at a disadvantage in the work environment due to possible differences in the way they express these needs.     

Digital media and political opposition in authoritarian systems: Russia’s 2011 and 2016 Duma elections

The ability of authoritarian regimes to maintain power hinges, in part, on how well they are able to manipulate the flow of information to the masses. While authoritarian states have had success controlling traditional media, the growth of social media over the last decade has created new challenges for such regimes. The Russian experience offers an example of how an authoritarian regime responds to this potential threat. Because of the massive demonstrations surrounding the 2011–2012 Duma elections, the ruling Russian government suspected that social media provided a significant impetus for the demonstrations. Social media, through its dissemination of opposition blogs, could have helped drive negative attitudes about the governing party. As such, the government responded by employing strategies to tighten their grip on the digital flow of information. We use survey data to demonstrate that exposure to blogs via social media at the time of the demonstrations led many to believe that the elections were fraudulent. Ultimately, we contend that Russian fears concerning the importance of social media for the fomenting of opposition movements is well grounded. Social media can drive support for opposition in an autocratic state.
