论农村社会保障法律制度构建中的政府责任——基于社会法视阈

农村社会保障法律关系错综复杂,政府、社会及农民在农村社会保障中既有相应的权力(利),也要履行一定的义务。行政法、经济法和社会法各自具有独特的法律价值和调整对象,本文分别基于这三个法域检视农村社会保障法律制度构建中的政府责任,考察农村社会保障法律制度构建中政府责任的越位和缺位,反思政府在构建农村社会保障法律制度中所发挥的主导和基础作用,提出在社会法视阈下政府应定位在承担法律制度构建、财政支撑和监督管理之责任。

台湾南北区域产业经济发展失衡之多层面多因素分析——以PAM理论架构为视角

区域产业经济发展失衡不仅是发展中国家或地区的顽症，同样也是发达国家或地区的难题。本次研究以台湾地区南北产业经济发展为例，打破以往的“单层面研究”，创新性地引入公共事务管理整合（PAM）架构，采用深度访谈、参与式观察、实地调研、文献阅读等多种方式，层层抽丝剥茧，展开对台湾南北软环境、硬环境、自然资源（条件面）的差异性研究，进一步探析条件面上的差异对台湾南北部的民众、政府官员、专家学者在事实判断、价值判断、个体与群体的兼顾联结（本质面）上的影响，以及对台湾南北经济、社会、政治等宏观影响（现象面）。研究发现，台湾南北产业经济发展失衡的根本原因并非表面的政府与政策失灵，而是受民情文化（条件面）、公民认知（本质面）、社会政治（现象面）等深层次、多因素的影响。在两岸交流进入加速阶段的时代背景下，文章最后建设性地提出改善两岸关系的新启示。

从合宪性推定到权力谦抑主义——香港“郑家纯等诉立法会”案中的解释方法与司法哲学

香港"郑家纯等诉立法会"案的判决涉及"香港立法会的调查委员会是否有权传召当事人"这一颇具争议的问题。针对当事人提出的"立法会调查委员会越权"的主张,在进入司法审查后,法院面对的是如何选择具体的方法来进行审查。虽然从文本来看,香港《基本法》并没有明确赋予立法会的调查委员会以传召当事人的权力,但法院采取合宪性推定方法,认为《基本法》没有禁止立法会通过调查委员会来行使证人传召权,并判决立法会的调查委员会不存在越权情形。这种对立法机关持谦抑姿态的方法论在一定程度上超越了形式文本,在本质上建基于《基本法》架构下国家不同权力间的关系维度,具有宪法上的正当性,并且对当下中国宪法方法的建构具有启示意义。当然,香港立法会调查权的行使必须以《基本法》为依据,以香港特殊的行政主导制为基础,这又从另一面体现了立法权对行政权的谦抑。
