保险人放弃告知义务之效力

告知义务制度是保险法最重要的制度之一,我国保险法第十六条第一款规定:“订立保险合同,保险人就保险标的或者被保险人的有关情况提出询问的,投保人应当如实告知。”依据本款,投保人应当履行告知义务。然而,实务中,有时由于投保人处于强势地位,保险人会对投保人的告知义务履行作出妥协。例如,实务中,有保险人与投保人以特约条款约定.     

同伴关系与初中女生校园欺凌行为的关系：嫉妒的中介作用

为考察同伴关系、嫉妒与初中女生校园欺凌行为的关系,采用青少年同伴关系量表、中学生校园欺凌行为量表、自我报告嫉妒量表对724名初中女生进行调查。结果显示：（1）同伴关系、嫉妒、校园欺凌行为之间两两显著正相关,同伴关系显著正向预测初中女生校园欺凌行为;（2）嫉妒在同伴关系与初中女生校园欺凌行为之间起部分中介作用。研究证实同伴关系对初中女生校园欺凌行为的影响,并揭示了嫉妒的中介作用。     

市政公用事业政府监管体制改革的几点思考

由于公用事业所具有的特征,决定了引入民营化、市场化机制并不是让政府放弃责任,不是简单的依赖市场让企业放任自流,而需要政府通过监管来控制企业行为,引导企业经营活动符合公共利益.可以说,完善的监管制度是公用事业民营化、市场化得以运作的重要的基础.     

Determination of multiple drugs of abuse in human urine using dispersive liquid–liquid microextraction and capillary electrophoresis with PDA detection

A new method was developed for pre-concentration and determination of multiple drugs of abuse in human urine using dispersive liquid–liquid microextraction (DLLME) and capillary electrophoresis (CE) with photodiode array detection. The method was based on the formation of tiny droplets of an organic extractant in the prepared sample solution using water-immiscible organic solvent (chloroform) dissolved in water-miscible organic dispersive solvent (isopropyl alcohol). The organic phase, which extracted eight drugs of abuse from the prepared urine solution, was separated by centrifugation. The sedimented phase was transferred into a small volume CE auto-sampler vial with 10 µL of 1% HCl methanol solution and evaporated to dryness. The residue was reconstituted in lidocaine hydrochloride (internal standard) aqueous solution and introduced by electrokinetic injection into CE. Under the optimum conditions, acceptable linear relationship was observed in the range of 3.0–500 ng/mL with the correlation coefficient (r) of 0.9982–0.9994 for spiked urine samples. The limit of detection (LOD) (S/N = 3) was estimated to be 1.0 ng/mL. A recovery of 75.7%–90.6% was obtained for spiked samples. The mean relative error (MRE) was within ±7.0% and the relative standard deviation (RSD) was less than 6.9%. The proposed DLLME-CE procedure offers an alternative analytical approach for the sensitive detection of drugs of abuse in real urine samples.

A Mad Mission

The pandemonium in coronavirus origins-tracing led by the U.S. intelligence community has culminated in a somewhat subdued ending. On October 29, the Office of the Director of National Intelligence released "a declassified assessment on the origins of COVID-19," said to be an update of its previous report issued in August. Nevertheless, the content proved basically the same as that of its predecessor, determining that "the inquiry remains inconclusive on the origins of COVID-19," while pointing the finger at China for not "sharing information."

Reputation management by Chinese universities: Primary profile and comparative features

In this study, we analyse data from 176 Chinese universities to examine the use of reputation symbols on official websites. We find that Chinese universities prefer professional and performative symbols more than moral symbols. Reputation symbols are mainly observed in teaching, research, history and strategy categories, whereas their use in internal operations and the external environment is limited. A comparison with samples from the United States and Nordic countries indicates that their universities differ in the use of reputation symbols, with relatively high emphasis on professional and moral symbols, respectively. This difference can be attributed to divergent national cultures, higher education regimes and globalization. Here, we discuss the implications of our findings on reputation management by universities in a globalized world.     

论国际贸易体制中的安全例外再平衡

受2008年国际金融危机持续发酵的影响,国际社会中部分国家出现了明显的国家安全泛化甚至"商业化"倾向,并已在国际贸易法领域得以部分落实。在WTO争端解决机制面临严重危机、上诉机构成员正常换届受阻的背景下,2016年以来安全例外条款被频频援引,案件呈现"井喷"状态。2019年4月,WTO争端解决机构对"俄罗斯货物过境案"作出专家组报告,首次针对GATT第21条(安全例外)作出具体解读,其可能对在审的十数个涉安全例外条款的案件带来重要影响。结合本案专家组报告,在分析GATT第21条文本规定和目前实践失衡的基础上,提出从安全例外实践中秉持高度克制原则、对经济安全等非传统安全事项进行差异性保护、善意解读及完善援引安全例外条款启动程序要求等方面对可能的安全例外滥用进行再平衡。     

大学生集群行为的发生机制及其疏导策略

大学生集群行为既有一般集群行为的特点,又具有高度集中、易被诱发、易被引导的年龄特征。宏观微观环境因素、大学生群体自身特点、诱导事件的直接诱因、互联网和新媒体等行为动员手段,综合形成大学生集群行为的发生发展机制。建构高权威的校园媒体、发挥舆论领袖作用、加强预防预警和应对等,是引导大学生理性集群、避免消极演化的有效策略。
