“Reason of state” is a concept that is rarely used in contemporary legal and political philosophy, compared to everyday parlance; “public reason,” in contrast, is ubiquitous, especially in liberal philosophy, as a legitimacy‐conferring device. In this article it is argued that the unpopularity of the notion of “reason of state” is partly due to its notorious ambiguity. Three different usages of the notion can be identified: a “thin” usage (where “reason of state” is equivalent to the common good); an “ironical” usage (where it is used pejoratively to denounce it as a pretext for application of illegitimate or illegal means); and a “pre‐emptive” usage (where “reason of state” functions as a legitimate second‐order exclusionary reason used to override otherwise mandatory first‐order rules of action). It is argued that only the “thin” usage is helpful in a by‐and‐large liberal‐democratic context. The article then discusses the main dilemmas related to the concept of public reason, especially in its most influential, Rawlsian interpretation, and defends the concept against common critiques. Finally, the two concepts of “reason of state” and public reason are compared, and it is argued that a “thin” usage of “reason of state” is functionally equivalent to public reason, and that both resonate with the theory of “input democracy” (focusing, as it does, on the legitimacy of reasons—or motivations—for applying coercive rules to individuals). The article also identifies a problematic feature of “reason of state”: its emphasis on the state as a privileged interpreter of such reasons and/or as identifying the pool of actors within which the “constituency” of public reason is ascertained. There are good reasons to resist both of these consequences: the former because of its potentially authoritarian consequences, the latter because of reasons provided by cosmopolitan political conceptions.  相似文献

Prediction of visible traits from genetic data in certain forensic cases may provide important information that can speed up the process of investigation. Research that has been conducted on the genetics of pigmentation has revealed polymorphisms that explain a significant proportion of the variation observed in human iris color. Here, on the basis of genetic data for the six most relevant eye color predictors, two alternative Bayesian network model variants were developed and evaluated for their accuracy in prediction of eye color. The first model assumed eye color to be categorized into blue, brown, green, and hazel, while the second variant assumed a simplified classification with two states: light and dark. It was found that particularly high accuracy was obtained for the second model, and this proved that reliable differentiation between light and dark irises is possible based on analysis of six single nucleotide polymorphisms and a Bayesian procedure of evidence interpretation.  相似文献

One of the stages of dealing with biological material submitted to forensic laboratories is species identification. The aim of the present work was to validate and assess the possibility of applying sequence analysis of the region coding cytochrome b as a method of species identification in the field of forensic science. DNA originating from individuals from major phyla of vertebrates was isolated by the organic method from various specimens. Extracted DNA was subjected to PCR and direct cycle sequencing using a universal pair of primers. The validation process, performed according to TWGDAM recommendations, revealed that the technique is a very sensitive and reliable method of species identification allowing analysis of tiny amounts of material and also degraded material, and can be useful in the field of forensic genetics. The case example presented here, concerning the determination of species origin of biological evidence collected from fatal road accident, confirms that analysis can be carried out even when there is no reference sample, and the sequences obtained can be assessed through analysis of their similarity to sequences for cytochrome b present in DNA databases.  相似文献

Psychological models of forming impressions about other people assume that this process is strictly connected with social categorization. Therefore, it is clear that the results of many studies show that the evaluations of other people are based on two crucial and separable criteria: morality and competence. Obviously morality and competence are two fundamental and distinct dimensions of the perception of politicians. These dimensions substantially influence voters’ behavior toward politicians and are clearly visible both in the preelection polls as well as in the scientific analyses concerning forming the images of politicians. The evaluations of politicians on the morality and competence dimensions are central in forming the interpersonal attitudes in which the dominant elements are affect and respect toward the evaluated person. Consequently, affect and respect are crucial factors in establishing the support of candidates for political offices. The morality and competence dimensions trigger the causal structures in the voter's mind in which formed attitude creates affect and respect, which determine voting behavior.  相似文献

The article presents the conception of positioning politicians based on a three-stage approach to political branding. The main assumption is that a political brand—and politician's image as its crucial component—is conceptualized as consisting of a node in memory to which a variety of associations are linked. These associations—positive, negative, or neutral—must be shared with other rival candidates as well as with an prototypical ideal candidate, understood as a model and standard of comparison while developing detailed marketing strategies. One of the most valuable methods that has been used to measure these associations is associative overlap technique developed by Szalay. This measure is based on free verbal associations and it expresses the degree of similarity among objects (words, persons, groups) based on the number of similar responses (associations) they elicit in common. The first stage of branding, candidates’ positioning in various segments of voters, focuses on such affinity between politicians and is based on multidimensional scaling techniques. At the second stage, mutual relationships between particular elements (positive and negative, common and distinctive), of which a politician's image consists, are defined. The third level of political branding links the results of positioning to voters’ decisions. This framework of branding political candidates is presented on the basis of empirical research focused on Polish presidential candidates’ perception and evaluation in the 2005 presidential election. The results of the performed research show that it is not only the strengthening of politicians’ positive features but also neutralizing the negative ones that contributes to his higher expected quality.  相似文献

The development of a nucleic acid extraction method based on magnetic separation has opened up possibilities forl automation of DNA extraction. The BioRobot M48 is one of robotic stations applicable to automated DNA extraction in forensics. However, each new method should be thoroughly validated before application to routine casework. Our aim was to compare the effectiveness of the currently utilized organic/Microcon 100 based extraction procedure and magnetic extraction with BioRobot M48. The DNA concentration of DNA extracts obtained from different kinds of typical forensic material was evaluated followed by amplification with the SGM Plus or Identifiler kit and capillary electrophoresis using ABI 3100 Avant. We can conclude that BioRobot M48 is a very effective instrument for DNA extraction from most specimens and can be successfully applied in forensic laboratories.  相似文献
