配偶权相关问题探讨——从婚外情现象谈夫妻忠实义务

配偶权是夫妻双方享有的重要的身份权,也是我国婚姻立法中一项颇受争议的权利。虽然在2001年新修正的《婚姻法》及其解释中涉及到配偶权所应包含的具体权利义务,但立法中并没有明确规定配偶权的概念,配偶权制度的法律体系也没有完整地建立起来。现实生活中,婚外情现象的普遍性极大地伤害了配偶一方,侵害配偶权的表现及如何救济就成为本文的重点。以突出法律的公平和正义,维护婚姻关系和社会秩序的稳定。

Still lying abroad? On the institution of the resident ambassador

What explains the persistence and proliferation of the resident ambassador? Why is the role apparently important both to the conduct of international affairs and to the work of governments? I do not try to propose a new theory of ambassadors, but I do offer conclusions about the nature of living in a globalized society of states where the economic logic of markets and the political logic of communities are at cross-purposes. It is a world in which we depend on institutions to help us maintain order and stability. Ambassadors are one of those institutions. At one level they are the concrete day by day reproduction of the society of states. At another level they act on behalf of the members of their community, helping that community to maintain its strength and cohesion by doing what needs to be done, abroad. An increase in the intensity of interactions among states, therefore, seems to lead to an increase in diplomatic representation facilitated rather than impeded by the new technologies of transportation and communications. Ambassadors are still lying abroad, it seems, because changes in technology have brought 'abroad' much closer to home while the myriad effects of globalization have made much more of abroad relevant to people and their governments. Far from being in decline, the resident ambassador seems likely to continue flourishing.     

The impact of police charges in incidents of wife abuse

The present study addressed the impact of an urban police force laying criminal charges in cases of wife abuse. Follow-up data from battered women and from police officers were collected to identify the long-term consequences of this police policy that began in 1981, including any negative or unintended side effects. Results indicated that the policy resulted in a dramatic increase in police-laid charges (2500%), and a shift from the Family to the Criminal Division of Provincial Court. Based on interview data, victims did not decrease their requests for police service (a feared side effect) and reported a significantly higher level of satisfaction with police service in this area. A significant reduction in police calls and victim-reported violence was associated with police intervention, especially when charges were laid. Paradoxically, police officers' attitudes about the policy were more negative than the actual positive changes that they helped to produce. Considerations for future research and professional training are outlined.     

论中国法、伊斯兰法和印度法对东南亚的影响

东南亚地区是一个具有相当特殊性的法域,古老的习惯法、古代中国法、伊斯兰法、印度法在这一地区混合,其情形十分复杂、混乱。概括起来,有如下特点:中国作为东亚和东南亚文明的轴心,中国古代法对所有东南亚国家均产生了普遍、深远的影响,但越南、新加坡等国受古代中华法系的影响要大一些;马来西亚、印度尼西亚和文莱等以信仰伊斯兰教为主的国家及菲律宾南部地区则受伊斯兰法的影响较大;三是在地理位置上靠近印度的缅甸、柬埔寨、老挝和泰国则受印度法的影响较大。     

对《妇女研究论丛》杂志图书评介栏目的思考——以2000-2011年的数据为例

本文结合《妇女研究论丛》"读书与思考"、"图书推介"栏目2000-2011年的统计数据,对该杂志的图书评介栏目进行了梳理和探析,多年来,该杂志在图书评介栏目方面进行了积极的探索,但还存在一些不足,如自然来稿比例低,所评图书的典型性有待提高、结构有待优化,编辑部与读者、潜在作者之间的良性互动有待加强,系统化、多层次的合作办刊机制需进一步完善等。建议进一步提高所评图书的典型性,优化图书评介的结构,增强与读者、潜在作者之间的沟通与互动,完善多层次、立体化的保障机制使包括图书评介在内的栏目进一步发挥活力。     

NGO话语与民间妇女组织的自我认同

本文以西方主流NGO话语在本土的传播为路径,通过研究民间妇女组织的相关文献资料,归纳分析民间妇女组织领导者和参与者对自己组织的思考和社会角色定位,即他们的自我认同.分析认为,民间妇女组织自我认同在最近几年发生转变,即从关注妇女事业的民间妇女组织向关注公民社会发展的妇女NGO转变,这一转变与西方主流NGO话语在本土的系统传播密切相关.
