Das neue Raumordnungsgesetz

Zum Jahreswechsel wurde das neue Raumordnungsgesetz verkündet, zur Jahresmitte wird das Gesetz in vollem Umfang in Kraft treten. Trotz mancher Verbesserungen im Detail ist es dem Gesetzgeber jedoch nicht gelungen, die rudiment?re Rolle des Bundes in der Raumentwicklungspolitik nennenswert aufzuwerten. Insgesamt best?tigt das in v?lligem Konsens von Bund und L?ndern ausgehandelte Gesetz die Befürchtung, dass die durch die F?deralismusreform 2006 geschaffenen L?nderabweichungsrechte die f?deralen Verantwortlichkeiten keineswegs entflechten, sondern vielmehr bereits im Gesetzgebungsverfahren einen kompromisshaften Konsens von L?ndern und Bund erzwingen.

Self-enforcing norms and efficient non-cooperative collective action in the provision of public goods

We show how norms can solve the distributional conflict inside a group in an anarchic environment and yield efficient coordination of collective action in a conflict with an external competitor. The equilibrium of the fully non-cooperative game with finite horizon has two interesting features. First, one of the players assumes a central role that resembles the role of the ??big-man?? in some primitive stateless societies. Second, the group members?? contributions to collective output and the payments from the big-man to these members seemingly look like reciprocal behavior, even though they are driven by narrowly selfish preferences.     

Die Durchsetzbarkeit des wasserwirtschaftlichen Maßnahmenprogramms

Zusammenfassung  Die europ?ische Wasserrahmenrichtlinie sieht zur Erreichung ihrer Umweltziele die Erstellung umfassender Ma?nahmenprogramme vor, die bis 2009 festzusetzen und deren Inhalte anschlie?end umzusetzen sind. Nach einem aufwendigen Planungs- und Kommunikationsprozess liegen mittlerweile zahlreiche Ma?nahmenprogramme im Entwurf vor. Damit richtet sich der Blick zunehmend auf die Frage, ob und wie die ehrgeizigen Ziele und Ma?nahmen tats?chlich realisiert werden k?nnen. Der vorliegende Aufsatz diskutiert die verfügbaren Mechanismen zur Umsetzung des Ma?nahmenprogramms und zeigt, dass dieses gegenüber dem Bürger zwar keine fl?chendeckende Verbindlichkeit beansprucht, dass jedoch namentlich im Bereich der Gew?sserunterhaltung sowie für die Erteilung und Modifikation wasserrechtlicher Genehmigungen Instrumente zur Verfügung stehen, die aus rechtlicher Sicht eine hinreichende Durchsetzbarkeit des Ma?nahmenprogramms gew?hrleisten. Dennoch ist gegenüber dem optimistischen Ziel eines in jeder Hinsicht “guten Gew?sserzustands” bis zum Jahr 2015 Skepsis angezeigt.

The consolidation of post‐autocratic democracies: A multi‐level model

The mainstream of theoretical and empirical ‘consolidology’ speaks of consolidated and non‐consolidated democracies. This crude dichotomy does not allow for more differentiated judgments about the stage of consolidation of newly democratized political systems. To overcome this shortcoming, a multi‐level model of democratic consolidation is proposed, consisting of four interdependent levels. The particular configuration of each has specific impact on the consolidation of the other levels. The four levels are: constitutional, representative, behavioural, and civic cultural consolidation. This model helps us to understand why new democracies survive or collapse, to identify the degree to which they are consolidated and the levels on which they are most vulnerable to internal and external shocks. It helps us to locate the parts of the political system where reforms should be implemented, or stopped or reversed in order to consolidate and stabilize a new democratic regime.     

China,globalisation and the World Trade Organisation

This article claims that membership of the WTO will help industrialisation, rather than make China more dependent. Hedley Bull's realist paradigm helps to understand why China joined this organisation, any counter arguments are wishful thinking. Friedrich List's ideas for self-reliant industrialisation were used successfully by Mao Zedong, but globalisation has changed development strategy. Globalisation, if handled wrongly can make China jobless, voiceless, rootless, ruthless and futureless. If handled right, it can strengthen independence, sovereignty and self-reliance. The Chinese government needs stable external, as well as internal economic conditions. There are benefits for the vast majority of Chinese, but there are also possible disadvantages. David Ricardo's “comparative advantage” has not really helped Less Developed Countries, on the other hand, China should not become a crumbled “Somalia,” this means that China has to engage with globalisation, and this means also the WTO. After all, agency does exist and globalisation is a “two-edged sword.”
