A NEW DAWN FOR DEMOCRACY

The Hong Kong Special Administrative Region (SAR) concluded its seventh election of the Legislative Council (LegCo) on December 20. Ninety elected lawmakers from a total of 153 candidates, with different backgrounds and across the political spectrum, make up the first legislature established since the region's electoral system was improved in March. The election is considered momentous in the development of democracy with Hong Kong characteristics. Under the Basic Law of the Hong Kong SAR, the main functions of the LegCo are to enact laws, examine and approve budgets, taxation and public expenditure, and monitor the work of the government. It also has the power to endorse the appointment and removal of the judges of the Court of Final Appeal and the chief judge of the High Court.     

社会治安综合治理定义探析

社会治安综合治理一词,在中国共产党各级机关和中国各级政府文件中经常出现,已经成为时下中国社会热词之一。同时,社会治安综合治理,也是中国共产党和中国政府的一项重要社会政策和努力建设的社会管理工程。然而,长期以来,对于社会治安综合治理一词的内涵,人们却存在着相互差别很大的理解。这种状况不仅影响了学术界对社会治安综合治理制度进行研究探讨时的交流,更为严重的是,必然影响到对有关政策文件精神的领会和贯彻,从而影响社会治安综合治理系统工程的建设效果。在总结、评述目前各种对社会治安综合治理一词定义的基础上,给出了自己对社会治安综合治理一词的定义,即社会治安综合治理,是指在社会公众参与下,各级党和政府部门为维护社会政治稳定协调行动,运用各种合法有效措施防治严重治安违法行为和刑事犯罪活动的一项社会管理系统工程。     

A Comparison of Logistic Regression,Classification and Regression Tree,and Neural Networks Models in Predicting Violent Re-Offending

Previous studies that have compared logistic regression (LR), classification and regression tree (CART), and neural networks (NNs) models for their predictive validity have shown inconsistent results in demonstrating superiority of any one model. The three models were tested in a prospective sample of 1225 UK male prisoners followed up for a mean of 3.31 years after release. Items in a widely-used risk assessment instrument (the Historical, Clinical, Risk Management-20, or HCR-20) were used as predictors and violent reconvictions as outcome. Multi-validation procedure was used to reduce sampling error in reporting the predictive accuracy. The low base rate was controlled by using different measures in the three models to minimize prediction error and achieve a more balanced classification. Overall accuracy of the three models varied between 0.59 and 0.67, with an overall AUC range of 0.65–0.72. Although the performance of NNs was slightly better than that of LR and CART models, it did not demonstrate a significant improvement.

民事诉讼生成权利规制探析——以“人脸识别第一案”为切入点

2019年11月1日,媒体称之为"中国人脸识别第一案"的浙江杭州理工大学副教授郭兵起诉杭州野生动物世界案,正式在杭州市富阳区人民法院立案。近两年来新兴案件如"代孕子女监护权案""冷冻胚胎案"频发,社会对司法的期待很高,民事诉讼对于新兴权利的权利诉求要做出回应,而如何回应及回应的限度就涉及到对法官裁判的规制上面。从程序法角度理解的规制,是由程序启动时的起诉受理、经由程序续行的审理过程、至判决达成三维角度对通过诉讼生成权利进行的规制。     

司法运作中未成年人犯罪预防探析

近年来未成年人犯罪率不降反增的现象仍然困扰着世界各国。在法律的直接作用面临缺位或者虚伪的时候,将犯罪预防理念提前到案件受理和侦查起诉阶段,对非犯罪性行为、虞犯行为与犯罪行为进行合理的区分以及执行期间和刑满释放的特殊干预,可以实现未成年人犯罪的有效预防。因此,未成年人的犯罪预防理念应被纳入到司法运作过程中的各个阶段。     

An Empirical Investigation of Factors Contributing to Item Nonresponse in Self-Reported Bullying Instruments

ABSTRACT

Researchers often use self-reported instruments to collect data from students when investigating the causes and effects of bullying. When completing the instrument, students may skip items despite anonymous data collection. To interpret data accurately, researchers must identify the causes of nonresponse. This study examined the impact of item (types of bullying and position) and student (sex and grade level) factors on nonresponse in bullying items. The sample included 10,681 students from grades 8, 9, and 11 who skipped at least one bullying item in the Minnesota Student Survey. Results showed that students were more likely to skip the items presented toward the end of the survey. The type of bullying had no impact on nonresponse. Male students and students at higher grade levels were more likely to skip the items. To alleviate the nonresponse issue, researchers are recommended to consider both survey length and student factors when administering bullying instruments.     

损害赔偿的方法

恢复原状与金钱赔偿是大陆法系民法中损害赔偿的两种基本方法，二者分别保护受害人的完整利益与价值利益。由于我国现行法将恢复原状中的许多内容独立出来，因此恢复原状不仅被狭隘地理解为对受损物品的修复，而且不被看作是损害赔偿的方法。此外，现行法上赔偿损失的范围过于宽泛，不仅包括了大陆法系的金钱赔偿，还包括了恢复原状的花费。未来我国民法典应取消现行法上对恢复原状各种具体方法的挂一漏万式列举，恢复“恢复原状”应有的涵义。此外，民法典还应当明确地将恢复原状与金钱赔偿规定为损害赔偿的基本方法，严格区分恢复原状请求权、恢复原状花费的请求权以及金钱赔偿请求权。惟其如此，我国民法方能确立真正的损害赔偿方法之平行规范结构，充分贯彻完全赔偿与禁止得利原则，实现损害赔偿法的补偿功能。

大转折年代,文艺解禁成为思想解放运动的重要推力,出现了一个以历史批判为主题的文学潮流。然而与其他领域一样,文艺界也是风波不断,围绕文艺主题是歌颂还是暴露的问题引发出激烈争论。胡耀邦深知文艺界遭受的创痛,力避简单粗暴的文艺批判,倡导以一种新的平等讨论的方式解决文艺界倾向性问题,以加强文艺界的团结,复兴和繁荣文艺。胡耀邦的柔性领导获得广泛赞誉,也受到部分人质疑。
