泰国南疆地区暴力袭击活动的特点及成因分析

本文从泰国南疆地区暴力袭击活动的特点着手,对暴力袭击的手法、目标、时间、地点等因素进行归类分析,并与国际恐怖主义袭击的特点进行比较,从多角度探讨该地区暴力袭击持续多年并无法平息的原因。本文认为,泰国南疆地区持续动乱的原因非常复杂,不是单一因素作用的结果,它缘于民族分离主义运动,但却又受制于泰国国内政治、经济等因素。只要泰国的国内政治形态没有变化,国外势力没有进一步介入,南疆动乱仍将持续,但却不会产生从量变到质的变化。

游击将军许国威率领福兵,于万历二十六年二月入朝参战,是万历朝鲜战争第二阶段东征明军的水师骨干力量.在朝鲜期间,许国威坚定支持面临弹劾的明军统帅杨镐,通过促使朝鲜上书陈情、联合明军将领上书等行动,产生了重要的政治影响.许国威将俞大猷系军队的军事技战术介绍到朝鲜,又将大量朝鲜文籍带回中国,推动了中朝的文化交流.朝鲜后期士人认为许国威是高丽士人金澍后裔的看法是一个"美丽的误会".     

Modeling Facts,Culture, and Cognition in the Gun Debate

Can empirical data generate consensus about how to regulate firearms? If so, under what conditions? Previously, we presented evidence that individuals' cultural worldviews explain their positions on gun control more powerfully than any other fact about them, including their race or gender, the type of community or region of the country they live in, and even their political ideology or party affiliation. On this basis, we inferred that culture is prior to facts in the gun debate: empirical data can be expected to persaude individuals to change their view on gun policies only after those individuals come to see those policies as compatible with their core cultural commitments. We now respond to critics. Canvassing the psychological literature, we identify the mechanisms that systematically induce individuals to conform their factual beliefs about guns to their culturally grounded moral evaluations of them. To illustrate the strength and practical implications of these dynamics, we develop a series of computer simulations, which show why public beliefs about the efficacy of gun control can be expected to remain highly polarized even in the face of compelling empirical evidence. Finally, we show that the contribution culture makes to cognition could potentially be harnessed to generate broad, cross-cultural consensus: if gun policies can be framed in terms that are expressively compatible with diverse cultural worldviews, the motivation to resist compelling empirical evidence will dissipate, and individuals of diverse cultural persuasions can be expected rapidly to converge in their beliefs about what policies are best. Constructing a new, expressively pluralistic idiom of gun control should therefore be the first priority of policy-makers and -analysts interested in promoting the adoption of sound gun policies.     

CT在肋骨骨折认定中的价值及骨折的力学分析

目的探讨在法医学鉴定中普通X线片难以确定的肋骨骨折,以CT技术加以显示的方法,并阐明肋骨骨折的力学原理。方法对17例普通X线技术显示困难的肋骨骨折行CT扫描,采用薄层平滑和高分辨率重建、表面遮盖法和多平面重建观察,确定肋骨骨折的部位、数量、形态、移位和骨痂形成情况等信息。结果17例X线平片难以确定的骨折,通过上述CT扫描和后处理重建技术,均得到满意的结果。通过骨折力学分析和影像观察,将间接暴力导致肋骨骨折的力矩分成垂直和旋转两类,从而提出垂直型和旋转型肋骨骨折的分类。结论对普通X线平片难以确定的肋骨骨折,建议采用薄层CT扫描,沿肋骨长轴多平面重建观察,结合肋骨骨折的力学原理,有助于避免将急性旋转型肋骨骨折误诊为陈旧骨折。     

习惯法与国家法的博弈——粤东北乡村治理

对赌协议的法律性质探析

近年来,随着海外私人股权投资基金在我国投资活动的日益活跃,对赌协议越来越多地被运用到投资领域。实践中,有些企业对赌成功,取得了良好的效益,而有些企业则由于种种原因对赌失败,付出了惨重的代价。由于我国目前没有对对赌协议作出明确的法律规定,因此在实践中不断出现由对赌协议引发的纠纷。从对赌协议的内容看,对赌协议属于射幸合同,但是该种协议又具有独特性,目前法律无法做到有效调整与约束。

知识产权刑事案件中,司法鉴定尚存在很多亟待解决的问题,这些问题不仅阻碍了诉讼活动的顺利进行,有的也违背了司法鉴定的基本规律。从长远的角度来看,知识产权刑事诉讼,很多司法鉴定问题更宜转化为专家证人的形式加以解决。     

Total Innovation Management: a novel paradigm of innovation management in the 21st century

Based on an ecosystem view of innovation management and in-depth case studies of firms in China and abroad, a novel paradigm of innovation management—Total Innovation Management (TIM)—is put forward in this paper. This new paradigm draws on three distinct areas of recent research, namely the innovation theory of the firm, the resource-based view (RBV), and the complexity theory. It introduces the theoretical framework of TIM, and presents a tri-dimensional innovation strategy model, which includes all elements of innovation, all innovators, and innovation in all times and spaces, and aims at value added and created.
