行政法理论基础的中心点与基石保障公益、授权与控权

<正> 行政法学的理论基础问题涉及到对行政法产生的原因,对行政法诸要素的理解等,可以说是行政法学最基本的问题。行政法学研究中观点各异、分歧诸多,皆源于对这一基本问题的认识的差异。这也从一个侧面反映出我国行政法学的不成熟,从而有必要认真探讨。 一、单纯主张“控权法”观念 关于行政法学的理论基础,一个最为常见,而又颇有市场的观点是:认为行政法是对行政权力进行控制的法。 笔者认为,单纯的“控权法”观点,于行政法制实践是不足取的,这是因为:     

“Flashburning” — Interpreting the presence of heat damage to a suspect's clothing and footwear in the investigation of fires

When volatile flammable vapours are released, they can mix with surrounding air and form a vapour cloud. Ignition of this fuel/air mixture will produce a flame front that will flash through the vapour. Items exposed to the flame front, including a suspect's clothing and footwear, may sustain superficial heat damage. At The Forensic Science Service Ltd this is referred to as flashburning. This paper describes the concept of flashburning, the laboratory methodology used to identify it and how an assessment on the overall distribution of that damage may allow a scientist to evaluate its evidential significance. Two anonymised casework examples are used to demonstrate how this information has been interpreted and used in evidence in United Kingdom courts of law.     

刑事证据制度发展中的阶段性进步——刑事证据两个规定评析

刑事证据两个规定针对司法实践中的重点与难点予以规范,初步确立了现代刑事证据法中的一些基本原则和规则,标示着我国刑事证据立法取得了阶段性进步。但是,从比较法的角度看,在两个规定中．对于正当法律程序、直接言词原则的体现并不充分;非法口供排除规则未能强调“任意性”标准,只是一种最低限度的排除;而对非法获得的实物证据采取宽容态度,不利于对公民财产权、隐私权的保护;大量的关于瑕疵证据可以进行补正和解释的规定,大大降低了刑事证据的可采性标准。目前有必要进一步完善具体的制度规范,积极改善司法环境,促进两个规定的贯彻实施．推动我国刑事法治向前发展。

"看病难""看病贵"一直是社会各界关注的焦点和热点。铜仁地区存在的"看病难""看病贵"等问题尤为突出,在对表现形式和成因分析的基础上,提出了解决的办法。     

宪政文化与中国宪政模式的建设

民主宪政是人类政治文明的重要成果.尽管宪政的文化基础具有共同的文化基因,但各国宪政模式的选择与确立无不建基于各国的本土文化传统之上.回顾百年中国宪政史,自晚清政府颁布<钦定宪法大纲>以来到1982年的宪法颁布,中国前后有十几部宪法,但这十几部宪法包括最近这部宪法都没有得到实施.然迄今宪政始终却未能在中华大地上实现.究其两者的原因,固有多端,然宪政文化之缺失乃为其深层次之原因.因此我们在推进当代中国宪政制度建设时,应当科学对待中国传统文化与西方宪政文化,改造传统文化,奠定宪政文化的文化基因;加强宪政理念的宣扬与宪政知识的传播,打造宪政制度实践的民情社会环境;推进市场经济进一步发展,夯实宪政文化的经济基础;培养公民的宪政意识和宪法精神,构建宪政文化的思想基础,以此来构建宪政文化进一步推进宪政制度的建设和完善,以及作用的发挥.     

基于引力模型的云南与南盟国家贸易关系研究

本文从云南省的角度,收集整理了云南与38个主要贸易国家2000--2010年的基本数据,运用引力模型进行回归分析,研究云南与南盟经贸合作对云南与南盟成员国贸易的影响程度,结果表明云南与南盟经贸合作对双方出口贸易有显著的影响,对双方进口贸易的促进作用并不明显,有待进一步发展;并通过对比分析预测值与实际贸易值的不同,预测云南与南盟的贸易发展潜力,提出促进云南与南盟贸易的相关政策建议。     

Expressions of IL -1α, IL -1β and IL -13 mRNA in Lung Tissue and Serum of Rats Drown in Fresh WaterCSCD

Objective: To detect the changes of (interleukin, IL)-1α, IL-1βand IL-13 mRNA in lung tissue and serum of drown rats, and to explore the potential value for the diagnosis of drowning in forensic practice. Methods: Eighteen SD rats were randomly divided into drowning group, blank control group and myocardial infarction group (as control group). The serum of right ventricular, the inferior lobe of right lung and the myocardium were taken from the rats in different groups. The expressions of IL- 1α, IL-1βand IL-13 mRNA in the lung tissue and the serum of right ventricular were detected by TaqMan probe method. Results: The expression differences of IL-1α, IL-1βand IL-13 mRNA in lung tissue between drowning group and blank control group, myocardial infarction group were not statistically significant (P>0.05). The expression of IL-1βand IL-13 mRNA in serum of right ventricular increased (P<0.05). The expression differences of IL-1α, IL-1βand IL-13 mRNA in serum between blank control group and myocardial infarction group were not statistically significant (P>0.05). Conclusion: The changes of cytokines IL-1βand IL-13 mRNA in the serum of right ventricular of drown rats are statistical significance, which are highly correlated with drowning. © 2018 by the Editorial Department of Journal of Forensic Medicine.     

Life in the Chinese hinterlands under the rural economic reforms

Abstract

Some of the poorest peasant households in one of China's inland provinces are being hurt by current government policies toward agriculture. This is the distinct impression obtained during two months of travel and research in Yunnan Province during mid-1988. As consultants to an international development project, we had an opportunity to explore the hill districts of northern Yunnan in a four-wheel drive, free to conduct interviews with grass-roots officials and peasant families. A total of thirteen villages were investigated, selected largely by ourselves.     

皮肤烧伤愈合过程中磷酸化c-Jun的表达

目的观察烧伤后人皮肤磷酸化c-Jun(p-c-Jun)的变化特点,初步探讨烧伤后创面愈合的分子机制。方法取12例烧伤后住院植皮患者的烧伤周边区皮肤为实验组;另取正常皮肤12例为对照组。应用免疫组织化学方法和常规HE染色检测p-c-Jun在皮肤烧伤周边区和正常皮肤组织中的变化情况。结果对照组p-c-Jun阳性颗粒主要定位于表皮细胞和内皮细胞中,阳性细胞率为(13.9±2.7)%;实验组p-c-Jun阳性颗粒主要定位于表皮细胞和部分炎细胞中,阳性细胞率上升至(47.2±8.6)%,明显高于对照组(P0.01)。结论烧伤后人皮肤p-c-Jun的表达可能与创面愈合有关。     

专利药品差别定价制理念与适用

《TRIPs协议修正案》的出台有一定的历史背景。它的诞生也会对差别定价制产生显著的进一步影响。该《修正案》的出台促使了全球差别定价制的发展。差别定价制中的发达国家完全补偿类型、发展中国家支付专利使用费补偿类型和最不发达国家零补偿类型也会受到该《修正案》的影响。这些影响的构成有一定的政治、经济和法律原因。
