司法会计企业产权界定浅析

现代企业制度中,由于出现大量国有资本、集体资本和非公有资本等相互参股、交叉持股现象,致使一些犯罪嫌疑人利用企业产权属性不明之机,进行违法犯罪,造成国有资产流失。而对于这些企业产权性质不明的案件,司法机关在定罪量刑时也产生较大分歧。为此,笔者认为在对产权不明案件进行司法会计检验鉴定时运用产权界定来判断企业产权属性,并从产权界定与司法会计之间的关系、产权界定在查办犯罪案件作用等方面进行探讨,从增强产权界定意识,形成产权界定机制等方面来解决司法实践中在查处犯罪案件时所碰到的问题。
