中国人文传统与现代法治精神

不同的文明造就了不同的法律文化,不同的民族精神孕育了不同的法制思想。中国古代法律文化和法制思想以其独特的把握世界的方式,体现着独特的民族精神和文化传统。但如何将传统人文精神中与现代法治相冲突的地方转换过来,加速法治现代化建设的进程,是摆在我们面前的一个重要课题。     

海峡两岸公务员立法技术比较研究

近年来,随着海峡两岸经济、文化、社会、法制等的广泛交流,两岸行政法治方面有相互借鉴甚至趋同之趋向。公务员法作为行政法体系的重要组成部分,海峡两岸的立法进路、立法技术、法律形态等方面存在着较大的可比性,这种比较对大陆日益完善的公务员制度有一定的参考意义。     

It's a Cultural Thing: Thoughts on a Troubled cia

The CIA has recently been the subject of numerous presidential commissions and Congressional committees concerned either with the details of individual operations or with sweeping reforms in structure and organization. One of the repeated themes in these reports is that the Agency must change its “culture.” This article identifies and offers possible remedies for cultural problems in the two directorates (the Directorate of Intelligence and the Directorate of Operations) and Agency-wide, and argues for enhanced accountability.     

Sovereignty as Responsibility

This article examines the development of a new normative principle of international order, sovereignty as responsibility; its communitarian implications; and the ways in which the newly conceived responsibility of the “international community” to protect the people of states failing to live up to their responsibilities as defined by international norms can come to terms with the notion of democratic self-government.     

中国家庭暴力问题实证研究——以福建省为例

近十年来,家庭暴力在我国引起了越来越多人的关注。根据分别针对成年人和未成年人的专门调查问卷的统计分析,绝大多数人知道家庭暴力,并对此持明确否定立场,但大多数有所认识的家庭暴力是身体暴力;逾六成的成年人有被动经历家庭暴力的经验;近四成夫妻有婚姻暴力经历,夫妻冲突行为的频率受城乡、教育程度和婚史的影响,五成半的夫妻通过自身和解化解冲突。三成至六成的成年人有遭受过父母一方或双方暴力的经历。家庭暴力的后果从身体伤害到精神障碍、绝望等,相当严重;但是,绝大多数受害者顾及孩子等因素不选择离开施暴者,而寄希望于对方改正错误。诱使家庭暴力产生的原因,既有社会因素,也有个人原因。父母间频繁的婚姻暴力对未成年人的自我认同有一定影响。制定家庭暴力防治法、采取具体措施救助受害人等才能减少家庭暴力,有效地保护受害人,减轻家庭暴力的社会代价。     

What Is Democracy? Liberal Institutions and Stability in Changing Societies

Is it possible to export democracy? That question underlies current U.S. foreign policy, and answering it requires an operational definition of democracy that distinguishes its essential attributes from circumstantial ones. Liberal representative government under law, sustained by a political culture that accepts open disagreement and demands accountability, provides the only form of democracy that has sustained itself over time. Democracy typically emerges from within a society, and history demonstrates the difficulty of making democracy work. Imposing it externally presents further challenges while risking a backlash. The project of spreading democracy must therefore be separated from the objective of establishing a stable order favoring American interests so that the latter end can be achieved by more modest means.

A Strategy for Success: Innovation Will Renew American Leadership

While the foreign policy discussion in the United States today is focused upon the Iraq War and Islamist terrorism, America also faces other, more long-term challenges to its physical security and economic prosperity: the threats posed by our declining economic competitiveness and our dependence on Middle Eastern oil. As in the past, America's ability to prevail over these challenges will depend on its technological and industrial leadership, and especially our ability to continuously recreate it. The United States needs a national strategy focused upon developing new technologies and creating new industries.
