试论行政相对人程序性权利的设定原则

随着程序权利观念的不断深入,世界各国对行政程序越来越重视,相对人在行政程序上的权利,已成为现代行政法学研究的重要课题。目前法学理论对行政相对人程序性权利的研究颇多,但由于程序性权利内容广泛并处于不断变化发展之中,所以笔者认为明确相对人程序性权利的设定原则最为关键。文章从行政相对人的性质、地位着手,提出了信息交流畅通原则、操作简易性原则、事前保护为主和事后保护为辅的原则、保护基本权利的原则等设定行政相对人程序性权利应遵循的原则。     

A partnership approach to successful,cost-effective technology transfer

The U.S. government, which funds virtually all types of basic research and development, can maximize its investment and best support technology transfer by focusing on R&D at its “budding” stage, and by involving large corporations, small businesses, and researchers in formal three-way partnerships to refine promising technologies and find suitable markets for them. This approach has the added benefit of requiring no additional, special funding for technology transfer. I propose a three-way technology transfer approach based on these concepts: the creation of a three-way partnership among researchers (the innovators), small business (the product/market developers), and industry (the end users of technology), with close liaison from day one for each project, and government serving as the facilitator; the selection of projects that will produce research and development results convertible to prototypes for testing in the end user’s environment; and the selection of projects that complement each other for building a critical mass of technology transfer from the bottom up. This type of approach utilizes the best attributes of each member of the technology partnership; focuses technology transfer efforts at the level of basic technology, where there is maximum flexibility and opportunity; and utilizes existing program funding to accomplish technology transfer objectives.     

当前中国司法改革的三大误区

当前中国司法改革存在着三大误区,即司法机关中心化、突破现行立法进行改革、司法机关各自为政.论文分析了三大误区在实践中的表象、成因及弊端,提出了应确立"法律至上"与"以民(人)为本"两个基本理念,同时应尽快成立全国统一的司法改革委员会.     

Asian values revisited

  With Asia's economy still booming in the second half of the 1990's “Asian values” were announced by some politicians (Lee Kuan Yew, Mahatir, Ishihara, Mahbubani etc.) and contrasted with “Western values”. Soon a controversial debate within Asia ensued (Kim, Fidel Ramos ea..), into which also the western democracies joined. The “West” however reacted rather defensively to the new assertiveness of some Asian statesmen, inspite of the fact that the authors of this debate put into question the western dominance in global value setting which has been in existence since the French revolution. But has this debate withstood the test of time, the challenges posed by the recession in Asia and by the ever increasing globalization? Hardly. The crisis has destroyed the notion that “Asian values” had been the main cause and guarantor of Asia's exorbitant growth rates. While in the West Christianity forms the essential basics of culture, in Asia there is a multitude of coexisting - and frequently confronting world religions. There is no other continent which in cultural and political terms is so contradictory and potentially conflict ridden like Asia. “Asianism” as a concept was surely also intended as an instrument to integrate multiethnic Asian societies with weak internal cohesion. At the same time it served to neutralize the human rights issue. In the meantime the debate has become quieter and more dispassionate. In the developed West the notion gained acceptance to abandon “Eurocentrism”. At the same time there is recognition that “Asian values” are not exclusive. Also in Europe the family plays a special role. A debate on values is needed for societal integration – also in the “West” which should become more aware of the need to reassert the origins of its own spiritual foundations. Following September 11th the west is well advised to continue the dialogue on values with Asia. 锐意进取,整合共荣——从宿务峰会看东盟一体化建设与内外政策发展

受台风影响而被推迟的第12届东盟首脑会议和第2届东亚峰会终于在1月13-15日在菲律宾第二大城市宿务举行.会上,东盟10国领导人做出三大历史性决定:提前5年建成东盟共同体、启动东盟宪章制定进程和通过《东盟反恐公约》.从中不难看出,东盟在深化合作、长远规划和制度化建设方面正在迈向更快、更紧密的一体化新层次.     

人民陪审制的价值及改革

人民陪审制是法治与民主的一个连结点,有助于司法程序和裁判结果的正当化,有助于公民对审判活动直接有效的监督,也是法治精神向社会渗透的有效途径。但是我国人民陪审制度的适用和发展欠缺一个平稳的社会环境,法律对人民陪审制度的规定缺乏连续性,法律对陪审员的职权设定同其专业素质要求存在内在矛盾,法律对人民陪审制度规定不完备,导致目前人民陪审制度在法律地位上的可有可无。应该完善人民陪审员的产生过程,优化陪审员的结构,增加参加合议庭的陪审员人数,加强人民陪审员的管理和培训,从而完善人民陪审制。
