我国植物新品种行政执法制度的缺陷与完善

我国植物新品种行政执法制度中,存在行政裁决和行政处罚糅杂不清、假种子行政处罚代替品种权行政处罚的现象,影响品种权行政执法功能的发挥。从制度发展的总体走向来看,品种权行政裁决的功能在逐步弱化,而行政处罚日益成为执法重心。理清行政裁决和行政处罚的关系,强化品种权行政处罚制度,明确行政权介入的公共利益门槛,着重打击假冒、套牌等严重损害种业创新和市场秩序的行为,能使行政执法在种业知识产权保护上发挥更大的作用。     

边缘青年情绪心理危机的测量与疏导——基于浙江新生代农民工的调查

近年来,多起恶性事件的发生预警了边缘青年受忽视的情绪心理健康问题。作为主要的边缘青年群体,新生代农民工处于青春期这一特定的人生阶段,其心理状态、社会交往及人际交往中的情绪、情感体验都具有一定的特殊性。通过实证研究,本文调查了新生代农民工在当地人际交往中的情绪心理,研究发现,亲密的人际关系对他们的情绪心理健康最具重要性,但实际可依赖的倾诉渠道比较有限。此外,本研究还测量了交往中潜在的情绪心理危机程度,深入挖掘了造成人际交往的内隐性情绪心理问题的主要诱因,建立了有关外部行为的预测指标,探索疏导这一青年群体在人际交往中所存在的情绪问题,以帮助他们提高人际关系的品质,有效预防情绪心理危机。     

Discrimination of phenethylamine regioisomers and structural analogues by Raman spectroscopy

In this study, the Raman spectra of 21 phenethylamines were obtained using far‐red excitation (785 nm). The distinguishing ability of Raman for phenethylamines, especially for phenethylamine regioisomers and structural analogues, was investigated. Here, the evaluation of a cross section of Raman spectra demonstrated that all types of phenethylamines were distinguishable, even for certain structural analogues with high spectrum similarity. Raman exhibited high distinguishing ability for phenethylamine regioisomers that differ in the substitution position of halogen, methoxy, alkyl, or other substituted groups; as well as for structural analogues containing different groups, such as furanyl, 2,3‐dihydrofuranyl, halogen, and alkyl substituted at the same position. The Raman spectra for homologues with differences in only a methyl group were found to be highly similar; however, their spectra demonstrated small but detectable differences. Four analogue mixtures and 59 seized samples were also analyzed to study the practical use of the Raman method in forensic field. 95% of the seized samples were correctly identified, which significantly validated the ability of Raman method in identifying the correct isomers. Accordingly, this study provides a non‐destructive, high‐throughput and minimal sample preparation technique for the discrimination of phenethylamines.     

在监管中吸纳:官办社团参与城市管理的系统分析——以A市城市管理义务工作者组织为例

针对当代中国城市管理过程中出现的吸纳型监管模式,可以从政治系统论视角进行分析.从输入、输出和反馈的过程来看,吸纳型监管不同于西方自由竞争式的监管内涵,它来源于作为执行输出端的政府职能的折冲,服务于作为支持输入端的政府信任提升,体现出政府存在的需求输入及反馈社会的输出性结果.从监管型国家建设目标来看,以城管执法和官办社团开展的城市吸纳型监管新模式,不等同于社会力量参与治理,难以达到提升监管合法性和有效性的目标.其根源是在城市管理存在政治争议而未经利益博弈的情况下,行政机构的主观性监管很难在管理效率和政治正确之间取得平衡.在此情况下,必须在前端和其他环节嵌入公共参与和公共协商机制,构建协商治理平台,增强政府公共管理活动的政治基础.     

家庭因素对建档立卡贫困大学生就业发展的影响

本文根据"建档立卡贫困人口中高校大学生就业发展研究"调查数据,探析家庭因素对建档立卡贫困大学生就业的影响。研究结果显示,家庭收支状况与理想工作单位性质存在一定的关联,建档立卡贫困大学生更倾向于体制内就业;毕业后更想回家乡所在省份工作;家庭收支状况与创业比例呈正相关;内向等性格特征影响其就业能力。在此基础上建议应从提高建档立卡贫困大学生就业能力角度出发,采取多阶段、早介入、走出去的全方位精准帮扶方式,促进来自低收入家庭的大学生更好地就业。

A Study on Localization Narrative of History Novels in the New Period

Since the May 4th movement, Chinese New Literature localization and nationalization of the task did not complete, narrative from traditional literature presents the obvious fracture. In the new period historical novels and actively explore the localization of narrative: narrative style from the historical biography and kingdoms; the second is the narrative theme inheriting classical motif; the third is the ancient writings in classical style of narrative language use, inheriting and developing traditional narrative construct with national characteristics of the history novels, and becomes art model of in the context of globalization.     

日本裁判员制度及对我国陪审制度之借鉴

日本近年来积极开展司法改革,特别强调人民参与司法,于2004年引进裁判员制度,实施多年已初见成效.它彻底改变了日本60多年来法官一统天下的格局,打破了法官与人民之间的隔阂、加深了人民对司法的了解信赖,同时又提高了司法审判效率.有鉴于日本受中华文化影响,民情文化多相似,因此,日本的裁判员制度对于我国人民陪审员制度的完善具有一定的参考价值及借鉴意义.我国应将人民陪审员制度宪法化,借鉴和反思日本的经验,制定《人民陪审员法》,以促进人民陪审员制度不断完善.

生物多样性预防公益诉讼的制度逻辑及实现路径

随着当今社会风险的不断加剧、不可逆转损害后果的频繁出现,生物多样性保护不应局限于事后的补救性救济,而应当积极拓展其预防功能,将隐患消弭于尚未发生之际是生物多样性预防公益诉讼的应有之义。就现行司法救济体系而言,尚存在法源理论上的不相妥协、立法维度上的事后救济为主、司法实践中的固守谨慎等鲜明特征。因此,应当在风险预防原则与比例原则的引导下,加快推进生物多样性专门立法、明确“重大风险”判断基准、完善生物多样性多元保障体系、打造查、审、执相互贯通的全链条式体系。
