加快济南现代农业由城郊型向都市型转变研究

在市委提出＂拓展城市发展空间,打造现代产业体系＂总体要求下,济南市如何打造具有省会特色的现代农业产业体系？这是一个迫切需要思考和实践的问题。积极推动济南农业由城郊型向都市型转变,逐步建立起与省会城市发展相匹配,与经济、生态、文化功能相协调的都市型现代农业体系,对于完善省会城市功能、推进城乡一体化、促进农业增效和农民增收、改善生态环境、提高城乡居民生活质量、实现省会经济的可持续发展等,都具有十分重要的战略意义和现实意义。     

A Manifesto on Enforcing Law in the Age of ‘Artificial Intelligence’

Building upon A Manifesto In Defense of Democracy and the Rule of Law in the Age of ‘Artificial Intelligence’, we, the Transatlantic Reflection Group on Democracy and the Rule of Law in the Age of ‘Artificial Intelligence’, have reconvened to draft a second consensus manifesto that calls for the effective and legitimate enforcement of laws concerning AI systems. In doing so, we recognise the important and complementary role of standards and compliance practices. Whereas the first manifesto focused on the relationship between democratic law-making and technology, this second manifesto shifts focus from the design of law in the age of AI to the enforcement of law. Concretely, we offer 10 recommendations for addressing the key enforcement challenges shared across transatlantic stakeholders. We call on those who support these recommendations to sign this manifesto. The Fifth Edition of The Athens Roundtable on AI and the Rule of Law will take place on November 30th and December 1st, 2023. It will delve into pressing governance challenges posed by foundation models and generative AI across jurisdictions.

经济国家是指国家受经济属性的嵌入与公私融合的驱动,超越单纯的政治主权组织而成为经济、社会发展的内生因素与主导力量,在促进经济、社会发展的同时亦引发自身的组织及行为变革。于实践而言,经济国家的发轫与勃兴乃是中国经济和社会成功转轨的根本所在,中国经济法的成长也正是得益于契合了经济国家对法律调整的需求。于经济法学理论而言,经济国家的提出代表着一种以经济与社会实践为根本、以增强经济法学理论解释力为核心的实践性总论研究进路。     

论诉讼监督规范的形态构造

在我国司法改革深入进行的现实背景下,我们应以改革为视角重新审视诉讼监督规范,尤其要对诉讼监督规范的结构及其模式进行梳理,透过诉讼监督规范的一般观念与结构基点阐述诉讼监督规范的结构内涵,并结合中外学者提出或建构的诉讼监督规范结构模式,针对我国检察机关在诉讼监督的实际效果,深入探讨诉讼监督规范结构的结构形态,以丰富诉讼监督规范的结构理论证成。

论清代前期对西南边疆的治理思想及治策

清朝前期,统治者仍以传统的"守中治边"、"守在四夷"观念为治边思想。在西南,清廷的认识较前代进一步深化,并采取积极的治理与开发措施,加大了人力物力的投入,使西南边疆民族地区在清前半期得到了较快发展,在政治、经济、文化诸方面进一步密切了与内地的联系,边疆民族的对内认同大为增强,边疆与内地一体化的趋势渐趋明显,并呈加快之势。     

从松花江污染事故看跨界污染损害赔偿问题的解决途径

假定松花江污染事故造成了跨界污染损害,就有了如何对待跨界污染损害赔偿的问题。在这个问题上,有国家赔偿、国际民事赔偿以及外交谈判和协商三种基本的方式。基于法律解决国家赔偿和国际民事赔偿的选择不是最佳的,基于外交解决的谈判与协商应是中俄双方应当采取的妥善的解决办法。     

Married Women's Rights to Land in China's Traditional Farming Areas

Women's land rights are one of the major issues of the rural land contract in contemporary China. Married women in relatively developed rural areas and under marriage misfortune have elicited much academic and public attention. However, less attention has been devoted to studying married women in traditional farming areas where they are still relatively poor. This paper focuses on women's land rights in their maiden village in traditional farming areas, and shows, based on an analysis of a case study combined with a questionnaire survey, that married women's land rights tend to be retained in their parent village with the implementation of new policy and land contract laws, but that they have almost no rights in their maiden families after marriage, due to the influence of traditional marriage notions and customs. Given the situation of the political and legal framework, it is necessary to further probe, by reviewing past practice and experience, how to ensure women's rights through restricted and specific land readjustment, which may be a realistic and valid approach.
