在未成年人民事司法领域,离婚父母因抚养、监护未成年子女问题引发的纠纷占到一半以上。此类纠纷因特殊身份关系而引发,与普通经济生活中的财产类民事纠纷相比,有着伦理性鲜明、权利主体特殊、涉及利益复杂等特性,致使司法实践面临法律空白多、矛盾易激化、取证难度大等困境。故以更好地适用法律、预防纠纷为出发点。通过对苏州法院近三年的抚养类纠纷进行专项调研,针对当前司法实践中普遍存在的问题,努力寻求一些更为妥善处理此类纠纷的方法和对策,希望对此类纠纷的预防、对规范今后离婚父母抚养监护未成年子女的行为均具有积极意义。  相似文献

Studying dipterans at the scene of a death can provide essential information for interpreting the evidence and help to reconstruct the events happened to a corpse in the past. Molecular tools have been employed for identification at specific levels in the cases of cryptic species or poorly conserved specimens. Identification of specimens is essential in forensic entomology since each species has a specific growth rate, which determines the calculation of the minimum post mortem interval (minPMI). In addition, phylogeographic reconstruction within a species can help to differentiate the haplotypes from a geographic area, thereby helping to clarify the possible relocation of a corpse. The morphological identification of Sarcophagidae species is often difficult, especially for the females. This is an important Diptera family since some of its species are among the first to reach a corpse, especially in warm areas. In this study, we compared the sarcophagids found in human corpses in forensic cases in Alicante (southeast of Spain) with specimens collected from baited traps in the same area and surrounding provinces. In total, 189 specimens were collected, comprising 72 from forensic cases and 117 from baited traps. Molecular identification was conducted by sequencing the cox1 mitochondrial gene and analyzing the sequences using ABGD, GMYC, and BIN species delimitation methods. The median joining algorithm in the PopART program was used to construct phylogeographic networks. Eight species in the family Sarcophagidae were identified. The most widely collected species were Sarcophaga argyrostoma and Sarcophaga tibialis. The haplotype networks obtained for these species did not indicate a clear geographic distribution of haplotypes. The S. argyrostoma samples from Alcoy were clearly isolated. The results demonstrated that this method is useful for identifying Sarcophagidae samples in forensic investigations and it can be employed for minPMI estimation.  相似文献

Chinese development assistance, raw material exploitation, investment and trade increases in their region are causing Pacific Islanders to ask: ‘Why are the Chinese interested in Pacific Island states?’ and ‘Why has there been an upsurge of the Chinese influence in the Pacific?’. This article seeks to add to the debate on that issue by examining the nature and the evolving purpose of Chinese engagement with the small island states of the Pacific. Only a small proportion of China's outbound investment goes to the Pacific Islands, but it has a considerable effect on the region's economically dependent states. Pacific Island nations have a pressing need for overseas investment and are highly dependent on development assistance. They are, therefore, particularly vulnerable to external players.  相似文献

Theories that explain post-Mao China's economic success tend to attribute it to one or several ‘successful’ policies or institutions of the Chinese government, or to account for the success from economic perspectives. This article argues that the success of the Chinese economy relies not just on the Chinese state's economic policy but also on its social policies. Moreover, China's economic success does not merely lie in the effectiveness of any single economic or social policy or institution, but also in the state's capacity to make a policy shift when it faces the negative unintended consequences of its earlier policies. The Chinese state is compelled to make policy shifts quickly because performance constitutes the primary base of its legitimacy, and the Chinese state is able to make policy shifts because it enjoys a high level of autonomy inherited from China's past. China's economic development follows no fixed policies and relies on no stable institutions, and there is no ‘China model’ or ‘Beijing consensus’ that can be constructed to explain its success.  相似文献

In 2013, the Laos Ministry of Education and Sports (MoES) commissioned a mid-term review of the Education Sector Development Plan 2011–2015 (ESDP, Lao People's Democratic Republic, Ministry of Education and Sports 2010). Plan International, a United Nations Girls Education Initiative partner, worked with MoES to lead a gender audit for the mid-term review. The gender audit strengthened the mid-term review and contributed to the design of the new ESDP. A MoES gender and inclusion working group was established, providing an institutional structure to support focused policy dialogue and address recommendations. This note recommends the inclusion of gender audits within mid-term reviews and final evaluations of sectoral plans to ensure that investments adequately address gender equality.  相似文献

Turning out for elections can be treated as an indication of long-term support for a political system, if citizens perceive that system as legitimate. Applied to the level of the European Union this would suggest that levels of participation in elections to the European Parliament are crucial to the legitimacy of the EU's political system. Due to the multi-level character of these elections, however, causes for relatively low levels of turnout may be located at the national as well as the European level. We will use individual-level survey data to analyse the reasons for voter participation at European elections in Germany. Based on system-theoretic arguments we develop a model of voter participation including both European and national factors. The results of our binominal logistic regression models suggest that participation at European elections depends on individual characteristics like political interest on the one hand and perceptions of the performance of both the EU and the national government on the other.  相似文献

Despite the 1994 genocide there has been annual growth in Rwanda every year since 2000. Poverty has decreased; while the MDG target of 23.8% is unlikely to be met by 2015, the future looks hopeful. The goal of reducing hunger is measured by underweight children – already down to target – and extreme poverty – likely to hit the target. Key to success is reducing dependency on the land, but a majority of the population still depend on their farm or plot. However, hitting targets for reducing poverty is not the same thing as abolishing it, and achieving targets does not necessarily solve problems.  相似文献

This article explores “the political” of political economy through an analysis of neoliberalised care. Borrowing Glyn Daly's metaphor of the political economy as a disorganised household, where the “political” disrupts the neat order of the oikonomia, we argue that in neoliberalism care is a central site of the political. Through Foucauldian biopolitics we define commodification as a central logic in the governance of care, and situate it in the wider context of neoliberal governmentality. Conceptualising care as a corporeal relation, and following Annemarie Mol's logic of care, we show how, despite the constant attempts to domesticate it, the hegemonic discourse fails to fully subsume care within the “order of the household”. Examining the ruptures produced when care resists its governance, the article demonstrates how the corporeal relatedness of care continues to open up spaces for the political, hence ensuring that the economy remains political.  相似文献
