2012 marks the 80th anniversary of Donoghue v Stevenson, a case that is frequently cited as the starting-point for a genealogy of negligence. This genealogy starts with the figure of the neighbour, from which, as Jane Stapleton eloquently describes, a ??golden thread?? of vulnerability runs into the present (Stapleton 2004, 135). This essay examines the harms made visible and invisible through the neighbour figure, and compares the law??s framework to Virginia Woolf??s subtle re-imagining and theorisation of responsibility in her novel Mrs. Dalloway (1925). I argue that Woolf critiques and supplements the law??s representations of suffering. Woolf was interested in interpreting harms using a framework of neighbourly responsibility, but was also critical of the kinds of proximities recognised by society. Woolf made new harms visible within a framework of proximity: in this way, we might think of Woolf??s work as theorizing a feminist aesthetic of justice, and as providing an alternate genealogy of responsibility to Donoghue v Stevenson.  相似文献

The Supplementary Vote (SV) was invented as a compromise between the two-round runoff system and the alternative vote. This paper shows that in many ways it is not. Under SV voters rank order a limited number of candidates. If one candidate is supported by over 50% of the voters he/she is declared the winner. Otherwise, all but the top two candidates are eliminated from the contest. Then, all second preferences of voters are taken into account. The candidate winning most first and second votes is declared the winner. SV violates fundamental criteria used to evaluate electoral systems and is difficult for voters. The paper discusses an alternative to SV which avoids at least some of its most apparent flaws.  相似文献

Romantic relationship involvement has repeatedly been associated with the incidence of externalizing behavior problems, but little is known about the nature and developmental significance of this relation. The current study extends previous research by investigating whether and through what processes romantic relationships distinctively predict externalizing behavior problems during adolescence compared to emerging adulthood. Data came from the Minnesota Longitudinal Study of Parents and Children. As predicted, higher levels of romantic relationship security at 16 years were associated with lower levels of externalizing behavior problems during both adolescence and emerging adulthood, but this inverse relation was stronger for emerging adults than for adolescents. This relation was not attributable either to earlier quality of family and peer relationships or emerging adulthood competence. Thus, security of romantic relationships may become increasingly predictive of individual differences in externalizing behavior problems as individuals move from adolescence to emerging adulthood.

This contribution seeks to illuminate the looming phenomenon of demultilateralisation and the return of and to the nation state, i.e. closure. Whereas many reasons for opening and closure have been discussed by Habermas in his eminent essay, we aim at providing an additional dimension, taking a psychological point of view and analysing this proclivity from a behaviourally informed perspective. Following a short recapitulation of the evolution towards postnationalism, we briefly sketch the current phenomenon of demultilateralisation and renationalisation. We then contribute to the current debate by providing cognitive psychological insights drawing on well‐researched biases that offer the greatest potential to explain the current outbreak of closing tendencies, namely prospect theory, including the endowment effect, framing, the availability bias and so‐called hawkish biases. This may add an explanatory dimension to why nationalistic politics have become again the beguiling sanctuary of the people. We attempt to define scope conditions of closure.  相似文献

This article interrogates the assumptions that returned migrants can be agents of change in development and peace-building in the country of origin. In current political and academic debates, it remains under-defined which category of returnees can contribute to what kind of change. This article identifies four ways in which voluntary and involuntary returnees relate to the conflict after return: physically, institutionally, psychologically and with regard to the future. It finds that the only returnees who could potentially live up to the expectations raised in the migration-development-peace-building debate, are voluntary returnees, while involuntary returnees were in no way potential contributors to Afghan peace-building and development. It concludes that, first, the human dimension of returnees' involvement is the most important potential contribution to change. Second, while the international community sees repatriation as the ultimate proof of peace that represents the restoring of normalcy, it is rather continued transnational mobility that could be the basis for Afghan migrants to contribute to change in Afghanistan.  相似文献

The current study examines the intergenerational transmission and concentration of violent offending using conviction data of 3,440 persons from three consecutive generations from the Dutch Transfive study. Violent offending is more concentrated within nuclear families than non-violent offending, and the intergenerational transmission of violent offending is stronger than the intergenerational transmission of non-violent offending. Due to the low prevalence of violent offending by women, only transmission from father to son is studied. Paternal violent offending before the birth of the son does not increase the son’s risk to become violent, while paternal violent offending during the son’s childhood and adolescence does. These results suggest that exposure to paternal violence plays an important role in the intergenerational transmission of violent offending.  相似文献

Rising powers, collectively joined in informal diplomatic groups such as the BRICS, aim to influence the meaning of the international order by means of “strategic narratives.” Together, the BRICS develop strategic narratives that support their aspiration for a fairer and more democratic multipolar world order and which produce a positive perception of the group. This paper evaluates how BRICS’s system and identity narratives combine geostrategic, economic and solidarity narratives. Narrative tension emerges due to their embeddedness in contradicting power constructions, namely a geostrategic perspective and a multipolar perspective. The synchronisation of these three narratives is undermined when there is a fall in perceived power, economic recession or a lack of accountability and transparency practices. Strategic narrative analysis helps to think about and analyze power in global politics.  相似文献

ABSTRACT

Since the advent of democracy in the 1990s, the South African political settlement has ushered into policy a progressive framework for the realization of socio-economic rights, enshrined by the Constitution. However, this political settlement has failed to translate into an economic and social settlement that results in just livelihood strategies and equitable service delivery that addresses historical grievances. Inadequate implementation of socio-economic policies designed to address injustice has contributed to weakening vertical cohesion between state and society. Analysing these two core conflict issues, access to service delivery and livelihood strategies, this article argues that the interaction of the political settlement and the ability of institutions to deliver effectively has negatively affected state-society relations and the legitimacy of the reconciliation agenda meant to support inter-group cohesion.  相似文献

ABSTRACT

Racial bias afflicts police practices across the globe. Police discrimination against and mistreatment of racial and ethnic minorities is indeed difficult to underestimate. While much attention has been thus paid to racially biased policing, fewer studies examine the question from the reverse angle, namely how the police themselves combat racist offences. This article offers empirical insights into the policing of racial hatred in Sweden, a relevant yet relatively understudied case. Drawing on interviews with police officers and crime investigators, I discuss law enforcement perspectives, e.g. perceptions and reasoning in relation to the investigation of racist offences. Findings evince a rather narrow approach as regards the constructions of racist motive that involves a relatively restricted use of bias labelling in identifying hate incidents, especially when the boundaries of racial hostility are perceived as blurred. I argue that while such an approach may reflect a legitimate effort to demonstrate the existence of a motive behind an offence, it may also lead to an underestimation of more mundane forms of racism and their harms inflicted upon racialized individuals and communities. The results have implications for ‘recognition’ and ‘belonging’ as benchmarks of democratic policing, and ‘the promise of inclusion’ associated with combatting hate crimes.  相似文献
