欺诈性抚养问题的三维解构

欺诈性抚养问题,理论上探讨的重点在于对其法律性质、构成要素的认定。司法实践中,由于我国对欺诈性抚养问题没有明文规定,不同时期不同法院对涉及此类纠纷的裁判思路存在较大差异。通过对现有裁判路径的梳理以及法教义学解读,选择侵权法规范作为被欺诈方寻求法律救济的请求权基础,同时将请求权的基础权利界定为一般人格权,契合理论上扩大保护范围的趋势,符合实践中司法裁判的逻辑,有助于积极倡导正确婚姻家庭观念,促进社会和谐稳定。     

保护、惩治与预防——我国少年司法制度变迁七十年(1949—2019)

新中国成立以来,以保护青少年权益为核心目的的少年司法制度经历了从无到有、从初步架构到日趋完善的阶段。其中,以《未成年人保护法》《预防未成年人犯罪法》为代表的专门立法文件,确立了我国"教育为主、惩治为辅"的少年司法原则,同时设置了具体的未成年人特别司法程序和审判要求,以契合少年司法制度的整体价值取向。少年法庭、少年检察机构的相继设立与发展,为实现上述司法干预措施提供了组织保障。但现有的依托于刑事案件的单一处理模式具有一定的局限性,未来应当在区分式的独立少年法体系中,将多元的保护处分、分级处遇程序和关注于事先预防的临界预防程序纳入现有的司法干预体系中,"以教代刑",以更好地实现对青少年不良行为及触法行为的矫治和预防。

当前我国营养医师处方权范围问题研究

营养医师是临床上为住院患者开展营养咨询、诊断、监测、调配饮食并协助临床疾病治疗的营养科在职医师。营养医师作为"医师"本应拥有营养药品处方权,但实践中由于营养医师的类型不同,导致了相应处方权范围的差异。为更好地服务临床,建议设置过渡期、严格营养医师转岗条件,修改临床营养师考试内容,在临床医学和中医学下开设营养学专业。

The Balkan Entente in Turkish–Yugoslav relations (1934–41): the Yugoslav perspective

By discussing the role of the Balkan Entente within Turkish–Yugoslav relations, this article endeavours to reflect the extent to which the Entente guaranteed security to Turkey and Yugoslavia. It deals with the 1934–41 period, which starts with the formation of the Balkan Entente and ends with the German invasion of Yugoslavia. The article is written mainly based on Yugoslav archival documents and aims to provide an alternative narrative that contests the conventional Turkish view. It also demonstrates that although the political leaders in Turkey and Yugoslavia became more optimistic about the future of the region after having signed the Balkan Entente, their perception of threat changed over time during the period of increasing instability in Europe.

Huawei and ZTE in Malaysia: The Localisation of Chinese Transnational Enterprises

ABSTRACT

While much research has been undertaken on firms’ internationalisation, much less has been written on internationalisation’s other side, localisation. Yet with the rise of emerging economies, especially Chinese transnational corporations, localisation has become an increasingly significant. This article examines the localisation experience of two Chinese telecommunications enterprises – Huawei and ZTE – in Malaysia. By holding these factors constant (the ceteris paribus assumption), several dimensions of localisation are revealed. They are product, workforce, technology, organisation and management. Firm-specific factors matter both in accounting for inter-firm similarities and differences in the manner they localised. Enterprise ownership is also important in explaining firm performance and host countries’ perception of these firms. Leadership styles of these enterprises’ founders also matter. Together, these factors affect the differential pace of firms’ internationalisation and localisation.

非洲经济增长与减贫发展的悖论——兼论非洲从贫困化增长到益贫式增长范式的转变

20世纪90年代中期以来,非洲经济呈现中速增长态势,但增长的质量不高,贫困化并未缓减,反而有所加强。这主要源于非洲经济增长具有的资源投入和出口需求驱动、投资拉动、农业增长低质量、不适于穷人分享增长的低度经济结构等内在特性。当然,它还与制约非洲减贫的长期结构性因素密切相关。益贫式增长范式关注穷人在经济增长中的受益性,强调经济增长不仅要减少贫困,而且要改善收入不平等状况。从长远看,非洲国家若要使总体经济增长有益于减少社会贫困,需向益贫式增长范式转变。
