20世纪的法兰西玫瑰潮--法国社会党100周年札记

以"拳头和玫瑰"为标记的法国社会党于2005年4月22日和23日,在巴黎举行了盛大的纪念活动,庆祝法国社会党成立100周年。回眸20世纪的法国史,我们可以看到,法国社会党是法国和西欧社会主义运动的一支重要力量,其百年史是一部玫瑰潮在法兰西大地涌动的历史,是一部不断探索社会主义理论和实践的历史。

本文是我们于2004年在湖南省西部农村地区进行的乡村子女受教育情况的调查报告,通过实证研究和统计分析的方法,展现了目前农村地区子女受教育情况的现状,以及家长在子女教育问题上的态度倾向。     

FROM COPENHAGEN TO DURBAN: ON INTERNATIONAL CLIMATE CHANGE NEGOTIATIONS

Copenhagen Climate Change Conference began with high expectation but ended in despair. It reached the so-called Copenhagen Accord with some dissenters. The Copenhagen Accord calls for deep cuts in global emissions, but it has not reached a binding goal of greenhouse gas emission reduction commitment and is not a legal effective agreement. EU played a limited role in Copenhagen Climate Change Conference, while the US and China were crucial to achieve the Copenhagen Accord. The subsequent Cancun negotiation reached the Cancun Agreements, but many substantial issues remained unsolved, such as the second commitment period of the Kyoto Protocol and other core issues. Durban Climate Summit successfully managed to include the main polluters of the globe, especially the US and the main emerging economies (including India and China), to commit their obligations for the first time to reduce greenhouse gas emission reduction under the international framework, and all the parties of the conference agreed that they would negotiate new mechanisms of greenhouse gas reduction which will be implemented by 2020 before 2015. Durban Climate Summit has also reached a package of agreements on climate change. Among them, an important one is about the Global Climate Fund. But some key issues including quantified GHGs emission reduction goals among countries have not been solved.     

Rapid Separation of Organophosphate Pesticides using Micellar Electrokinetic Chromatography and Short‐end Injection,

Organophosphate (OP) pesticides are highly toxic substances and are frequently represented as poisons. In order to qualify and quantify the selected OP pesticides (methyl paraoxon, ethyl paraoxon, methyl parathion, fenitrothion, and ethyl parathion), micellar electrokinetic chromatography and short‐end injection were investigated. This is the first time that this combination has been used to separate OP pesticides. A capillary with 8.5 cm effective length was used, and the analytes were separated within 2.1 min. Separation conditions including buffer (type, pH, and concentration), sodium dodecyl sulfate concentration, and separation voltage were optimized. The limit of detection (LOD) was estimated in the range of 10–20 μM. The OP pesticides spiked in artificial saliva and drinking water gave superior peak profiles, and good average recoveries 95.6% and 62.3%, respectively. Overall, a rapid method with excellent resolution and efficiency was developed and successfully applied in the analysis of potential sample matrixes.     

Response to Criticism: Police Legitimacy,Beyond the Entrenched Niches of Expertise

The purpose of this article is to first re-state the key points of the rejoinder by Cao and Graham. It then proceeds to defend and clarify the arguments that we have made in our article by raising a few misinterpretations by the two reviewers. I end this article with an advice from John Braithwaite 30 years ago that we should nurture the new endeavors in criminology instead of being united against such undertakings.

MicroRNA在心血管疾病方面的研究现状及应用前景

MicroRNA(miRNA或mi R)是一类21~25nt大小的高度保守的内源性单链非编码RNA,在生物体内广泛存在。近年来,在临床研究中与心血管疾病相关的mi RNA不断得以证实,但其在法医学鉴定方面的研究尚未有报道。本文就mi RNA的研究进展及其在心血管疾病中的应用,以及在心源性猝死法医学鉴定中的应用前景进行综述。     

社会转型与经济犯罪

在我国社会转型期 ,经济管理中的缝隙和漏洞、经济生活中的失范和无序现象将在一个较长时期内存在 ,加之市场经济负效应的影响 ,国际犯罪的渗透 ,滋生经济犯罪的土壤和条件将广泛长期地存在。据此既要重视微观防治 ,也要重视宏观社会控制 :(一 )深化改革 ,完善市场经济体制 ,逐步消除经济犯罪的土壤和条件。 (二 )健全法制 ,营造遵纪守法的外部环境。 (三 )加强对权力的制衡 ,完善监督机制。 (四 )综合治理 ,打防结合 ,以防为主。 (五 )建立一支能够适应形势需要的经济犯罪侦查队伍。     

论如何构建我国行政诉讼和解制度

《行政诉讼法》明文规定人民法院审理行政案件不适用调解,但实践中的高撤诉率却从另一种意义上规避了这一法律规定。要更好地解决这种矛盾冲突,就需要在法律上设计一种行政诉讼和解制度去弥补无依据的实践。从传统法律文化成因、传统理论的质疑、调解与和解的比较等角度进行分析,可以发现解决行政诉讼和解的必要性与可行性,从而构建出一套行之有效的行政诉讼和解制度。     

尾随抢劫犯罪案件的特征及其侦查对策

从现实中发生的尾随抢劫犯罪案件来看,这类案件在犯罪行为、犯罪人心理、犯罪侵害的对象和犯罪方式等方面具有不同于一般抢劫案件的特征。侦查此类案件时,在侦查对策的运用上应注意从快速反应、现场勘查、心理痕迹分析、询问被害人、布控守候、调查摸底、并案侦查等方面加以全面考虑。
