论社会治安服务的多主体供给

随着我国市场经济主体活动的日趋频繁和复杂,原有的单一中心的治安服务供给体制所具有的局限性使得治安服务供求矛盾日趋凸现,引入多元化的供给主体是缓解这一矛盾的现实理性选择.一般而言,某一社会产品(社会服务)的提供方式在一定程度上取决于其属性特征.本文从公共经济学的视角,在对社会治安服务的属性进行细分的基础上,探讨了不同类别社会治安服务的供给主体选择问题.     

新时代岭南文化的创新发展

岭南文化是生长在中华文化百花园的艳丽花朵,具有开放兼容、务实进取、敢为人先的独特品格。在近现代,岭南文化不断推动中国社会的变革和发展,在改革开放中更是发挥了重要的"火车头"的作用,引领我国改革开放不断前行。在新时代,为了使广东更好实现"四个走在全国前列",极大地满足人民群众对精神文化的需要,推进粤港澳大湾区文化融合发展,岭南文化应着重在五个方面创新发展:一是创新岭南文化精神,二是加强历史文化遗产保护,三是深化文化体制改革,四是文化产业发展提速,五是推动文化对外合作。     

我国儿童早期照顾政策框架构建——基于资源平等理论视角

我国儿童早期照顾领域存在照顾责任公私分担失衡、照顾资源分布不均、照顾劳动性别分工和代际分工不合理等现象,亟待公共政策干预。立足我国现实,以德沃金的资源平等理论作为伦理基础,可提出儿童早期照顾政策的伦理依据,即以保障儿童与母亲权利为核心原则,以保障父母工作-家庭平衡、祖辈老年权益为辅助原则。在政策分析中,首先基于政策网络模型,阐述政策行动者的网络定位及他们在网络间的互动关系,厘清不同行动者之间的资源与权力交换机制;然后利用图尔敏结构模型,提出具有开放性和包容性的政策方案,并最终形成旨在保障儿童和照顾者权利、促进家庭和社会发展的我国儿童早期照顾政策框架。     

法律移植的理论与实践

近代以来,许多亚洲国家伴随着宗主国或占领国的殖民统治而进行了大量的法律移植;中国从晚清到民国政府,也对西方法律进行了大量的主动移植,使传统法律实现了现代意义的转变。历史表明,规则的稀缺和社会政治经济发展对规则的强烈要求,使得中国的法制建设必然首先是改变“无法可依”的状态。在需要通过立法创造某些制度以实现政策目标时,法律移植是最有效的手段,成为创造法律秩序和促进社会进步的方式。然而,移植规则的深层含义在于移植文化,也即规则和制度的移植必须要有文化的支持,否则,法律移植很可能仅仅是立法者的游戏。
