司法理性与理性司法——以法律推理为视角

司法理性是指法官在司法过程中运用程序技术进行法律推理和判断、寻求结论的妥当性所体现出的一种睿智和能力。司法理性是形式理性、实质理性以及实践理性的统一。法官在司法裁判时运用法律推理的过程,同时也是彰显司法理性的过程。因此通过法律推理促进理性司法,从而实现司法公正是我们追求的法治目标。     

理工科高校文科研究生创新能力培养研究——基于北京航空航天大学的案例分析

文科研究生创新能力培养既是建设高水平研究型大学的总体需要,也是创新人才培养的内在要求.在理工科高校,文科研究生创新能力培养面临很多制约.以北航为例,针对文科研究生创新能力培养中存在的主要问题进行探讨.在此基础上,提出要重视研究性学习,加强跨学科教育,加大科研方法训练,发挥导师负责与集体培养的双重作用,不断完善文科科研平台和实践基地建设,进而推进理工科高校文科研究生创新能力培养.

危害环境行为的刑法规制问题研究

世界上各国均进行了关于危害环境行为的刑事立法。我国虽在1997年刑法中规定了破坏环境资源保护罪一节,但由于环境犯罪刑事立法理念陈旧、罪名体系设置不合理、刑法规制的范围较窄及惩罚力度较轻等问题,导致刑法在惩治危害环境行为时没有发挥出足够的作用,部分危害环境的行为难以得到有效的刑罚处罚。文章通过分析国内外环境犯罪刑事立法的现状,研究我国环境犯罪立法的不足,鉴于环境的重要性及其他国家环境立法的可借鉴性,提出应确立环境犯罪在刑法典中的重要地位,并应从立法模式、罪名体系、刑罚适用原则及种类等方面加以完善。     

尸体心血红细胞ATP降解规律与早期死亡时间的相关性

目的观察早期死亡时间（PMI）与血液红细胞ATP含量的相关性。方法选择具有确切死亡时间的尸体30例,在死亡后6、8、10、12、14、16、18、20、22、24h分别于第4肋间进行心脏穿刺取血,利用生物发光法检测血液样本红细胞ATP含量（μmol／gHb）,并观察红细胞ATP含量变化与死亡时间的关系。结果尸体心血红细胞ATP含量在死亡后1～24h之内呈现非匀速下降趋势,与死亡时间的Pearson相关系数为-0．971（P=0．000）;尸体心血红细胞ATP含量与死亡时间的回归方程及尺。值为：Y=-0．096X＋2．872（x为死亡时间）,R2=0．936,P=0．000。结论尸体心血红细胞ATP含量在死后1—24h之内的变化与死亡时间具有相关关系,可以作为法医学死亡时间推断的生物学指标。     

Policy Deliberation as a Goal: The Case of Chinese ENGO Activism

Since it was first introduced in the late 1990s, the concept of deliberative democracy has had policy appeal for both Chinese policymakers and scholars. The Chinese government has recently introduced various deliberative institutions in a top-down manner to address diverse governance challenges. Deliberation at the level of civil society, however, has remained largely limited under the Chinese authoritarian regime setting. This paper illustrates how Chinese civil society actors have increasingly exerted bottom-up pressure to attain a greater degree of deliberation, transparency, and accountability in policymaking, by using the case of a series of anti-dam campaigns conducted by environmental non-governmental organizations (ENGOs) over the past decade. Throughout their campaigns, ENGOs have urged both the central and local governments to adopt more participatory and transparent policymaking and examine the potential social and environmental impacts of large dams. They have done so particularly by invoking the very laws and policies that the government has recently introduced. This study suggests that future research on deliberative democracy in China should pay greater attention to non-state actors and their roles in practicing and promoting bottom-up deliberation.     

论反贪侦查人员旁听庭审工作机制的构建——以“庭审中心主义”思维指导“侦查中心主义”实践简

反贪侦查人员旁听庭审工作并非新生事物,然而在实践中却始终处于自发、无序的状态,缺乏在机制构建层面上的关注。当前,我国的刑事诉讼构造正在由“侦查中心主义”转向“庭审中心主义”,对于反贪侦查人员旁听庭审工作的讨论也由此被赋予了新的历史内涵。反贪侦查人员旁听庭审工作面临诸如理念滞后、信息不畅、工作冲突、效果不佳的实践困境。实现反贪侦查人员旁听庭审工作的价值,应在系统化、规范化的基础上构建一种相对合理的工作机制。     

Interstate Relations,Perceptions, and Power Balance: Explaining China’s Policies Toward Ethnic Groups, 1949–1965

Why do multi-ethnic states treat various ethnic groups differently? How do ethnic groups respond to these state policies? We argue that interstate relations and ethnic group perceptions about the relative strength of competing states are important—but neglected—factors in accounting for the variation in state-ethnic group relations. In particular, whether an ethnic group is perceived as having an external patron matters a great deal for the host state's treatment of the group. If the external patron of the ethnic group is an enemy of the host state, then repression is likely. If it is an ally, then accommodation ensues. Given the existence of an external patron, an ethnic group's response to a host state's policies depends on the perceptions about the relative strength of the external patron vis-à-vis the host state and whether the support is originating from an enemy or an ally of the host state. We present five configurations and illustrate our theoretical framework on the eighteen largest ethnic groups in China from 1949 to 1965, tracing the Chinese government's policies toward these groups, and examine how each group responded to these various nation-building policies.
