民国刑事诉讼法上的微罪不起诉制度

20世纪20年代，起诉便宜主义逐渐在大陆法系国家法律中得到确认，也很快被民国立法者所接受。在民国刑事诉讼法上，微罪不起诉制度是起诉便宜主义的集中体现，这项制度于1928年《刑事诉讼法》中首次得到确立，此后历经多次修改，在检察官作出微罪不起诉处分的考量因素和具体程序等方面得到了完善，但其适用范围则一直比较有限。在实践层面，微罪不起诉在民国时期的适用率始终偏低，因此很难充分实现其应有的价值。     

社区志愿者的态度及影响行为的因素分析——以北京市A街道为例

社区志愿者的态度与行为不仅会影响到社区公共服务的提供,也会影响到社区的治理与发展.本文以北京市A街道为案例,首先描述了A街道志愿服务的现状,其次分析了社区志愿者的态度及影响社区志愿者行为的因素.文章发现,目前A街道的志愿者参与志愿活动更多是基于互惠心理,而街道办事处的组织动员等结构性因素是影响社区志愿者行为的重要因素.同时,体制内的组织动员能够强化居民的“认同”和“互惠”心理.最后,文章针对研究发现提出了改进体制内组织动员志愿者的方式和激发社区社会组织的活力等建议.

论公共性的回归与重塑

公共性与私人性作为个体存在的两种形态,是异常复杂地糅合在一起的,但在人类社会尤其是西方社会由传统走向现代的进程中,却出现了私人性超越并侵蚀公共性的现象。究其原因,传统公共性的剥削属性、浪漫主义发展、科学技术进步和工业革命的兴起都在不同程度上推动了私人性对公共性的侵蚀。这虽有利于个体理性发展和人性解放,但同时也导致了公共性的衰落,从而引发信仰缺失、私人性膨胀、合作失灵等一系列公共危机,给社会发展带来无法预测的风险。故应以西方现代化发展中的这一弊端为鉴,重新审视公共性对我国现代生活的重要性,并从公共价值观创造、公共道德培育和公共秩序规划入手,努力构建公共性与私人性和谐统一的现代生活。

血瘀型动脉硬化闭塞症血清代谢物和炎症反应相关因子的变化及意义

目的探讨血瘀型动脉硬化闭塞症(ASO)血清中代谢物和炎症反应相关因子的变化及意义。方法血瘀型ASO患者15例,健康对照10例,酶联免疫吸附(ELISA)双抗体夹心法检测血清中VEGF、TGF-β1和IL-1β水平,基于气相色谱-质谱联用技术(GC/MS)的代谢组学方法分析血清中内源性代谢物的变化。结果与对照组比较,ASO组血清中血清中IL-1β的含量明显升高,差异有极显著性意义(P<0.01);VEGF、TGF-β1含量轻度升高,差异无显著性意义;ASO组血清中的糖类、氨基酸类、脂肪酸类物质的代谢水平均发生了明显的改变。结论炎症反应和血清内源性代谢物的变化与血瘀型ASO的发病密切相关。
