论胡锦涛总书记对重庆的"三大定位"暨重庆市第三次党代会的战略响应

胡锦涛总书记对直辖十周年的重庆作出了新的“三大定位”。其一,努力把重庆加快建设成为西部地区的重要增长极,这是对西部大开发战略的进一步深化;其二,努力把重庆加快建设成为长江上游地区的经济中心,这是对长江经济带发展战略乃至全国区域发展战略的进一步深化;其三,努力把重庆加快建设成为城乡统筹发展的直辖市,这是对重庆在全国直辖市中的特点与历史任务的进一步明确。重庆市第三次党代会对的战略响应抓住了实现“三大定位”的关键。

围绕建设“法治浙江”加强领导干部学法用法

民事申诉案件检察和解的理论困境及其解决

检察机关内设民事行政检察部门（以下简称民行部门），负责民事审判监督，对于具有民事抗诉再审事由的案件，可以依法提起抗诉。近几年来，民行部门对于一些案件也主持当事人进行和解，达成和解协议后终止抗诉审查程序，以达到息诉罢访的目的，取得了良好的法律效果和社会效果。关于检察和解，《民事诉讼法》没有明确规定，     

从相互协助到相互承认——欧盟刑事取证立法变迁探析

欧盟刑事取证立法建立在两个不同原则上,一是传统的相互协助基础上的立法,一是1999年坦佩雷会议后,相互承认基础上的立法;这两种立法在欧盟范围内并存。从未来发展看,相互承认基础上的立法将逐步取代相互协助基础上的立法。欧盟理事会2008年12月通过的《欧盟证据令》是欧盟在相互承认基础上取代原有刑事取证立法的第一步,对原有立法进行了制度性革新。欧盟刑事取证立法在取得显著进步的同时,在相互承认原则和公民基本权利保障等方面也面临着诸多挑战。     

The Chinese Model of Human Rights Protection

ladies and gentlemen,
I am very delighted to be here at the Vrije Universiteit Brussels, a prestigious and privileged university in this beautiful country of Belgium, to discuss the issue of human fights pro- tection with you today. Human fights are great, and respect for and protection of them have been a long-cherished common aspiration and pursuit of the peoples of all nations in the world. The Universal Declaration of Human Rights, issued 61 years ago, proclaims the protection of human fights to be ＂a common standard of achievement for all peoples and all nations.＂     

从人民代表到代表人民-由《选举法》的修改说起

一、楔子 在中华人民共和国建国六十周年之际，当改革开放行进三十年之际，全国人大常务委员会公布了《选举法》修改草案。就草案的内容看，其是我们政治体制改革的进一步深化与具体化，是人民民主之法治化的延伸，是人民当家作主的进一步扩大。     

侦查人员出庭作证的法律依据辨析

侦查人员出庭作证已列入我国新一轮司法改革方案之中,但理论界对侦查人员出庭作证的法律依据一直存在争论。有的认为《刑事诉讼法》第48条规定的证人包含了侦查人员,此条即为侦查人员出庭作证的法律依据;也有的认为《刑事诉讼法》第28条关于侦查人员应当回避的规定实际上否定了侦查人员出庭作证的资格。笔者对上述意见概不同意,认为在我国现行刑事诉讼法上侦查人员出庭作证是有依据的,只是不够直接、明确,应当根据侦查人员的法定职责、审判活动的实际需要、侦查人员及侦查工作的特殊性等因素完善侦查人员出庭作证的法律依据。
