论独立行使检察权的制度保障

宪法规定了检察机关独立行使检察权 ,但由于当前存在着检察权地方化、检察官管理行政化及检察官的法律保障制度不健全等检察管理体制的弊端 ,造成了检察机关不能有效地独立行使检察权。改革现行的管理体制 ,从外部制度上理顺检察机关的领导体制 ,从内部管理上提高检察官的任职条件和业务素质 ,从法律保障上提高检察官的地位和待遇 ,从而建立和完善独立行使检察权的制度保障

National identity and Taiwan's Mainland China policy

Taiwan is a mildly divided society—divided essentially along the lines of national identity. Indeed, there is no doubt that national identity is the dominant factor affecting Taiwan's mainland China policy. Other factors such as business interests and security concerns may enter the picture from time to time, but they often get bogged down in the national identity controversies. As a matter of fact, there is high correlation between people's attitudes toward business and security concerns and their positions on the national identity issue. The key to understanding Taiwan's mainland China policy is thus the distribution of voters on the national identity issue and how it is translated into the political fortunes of various political parties in the electoral game.

Human rights and U.S.-Japan relations in Asia: Divergent allies

The United States has adopted a high-profile approach to pressure Asian governments to improve human rights and move toward democracy. Japan, in contrast, has avoided confronting its Asian neighbors over human rights while balancing between Asia and the West. Japan’s reluctance, in supporting the U.S., except in the multilateral context, has strengthened the position of Asian nations sanctioned by the West. Japan’s approach is explained by its lack of interests and convictions about promoting human rights in Asia, its past aggression in the region, the absence of explicit United States pressure on Japan and the deterrent effect of strong Asian opposition to foreign intervention on human rights. An earlier version of this article was presented at the International Studies Association Conference in Minneapolis in March 1998. 论我国刑事侦查中的留置

作为一项于刑事侦查中应用普遍的剥夺人身自由措施,留置手段一直被排除在我国的刑事诉讼法视野之外。这一现象的存在有损于我国刑事诉讼法作为国家基本法律的尊严。因此有必要从现行刑事强制措施系统内部缺陷及相关外部制度的缺失两方面入手,探讨我国刑事侦查中剥夺人身自由措施的配置问题。
