Society of Hair Testing guidelines for drug testing in hair

The Society of Hair Testing (SoHT) Guidelines for Drug Testing in Hair provide laboratories with recommended best practice guidelines whether they are currently offering drug testing in hair, or plan to offer a hair testing service in the future. The guidelines include reference to recommended sample collection and storage procedures, through sample preparation, pre-treatment and analysis and the use of cut-offs.     

Medicare and Medicaid programs; reform of hospital and critical access hospital conditions of participation. Final rule

This final rule revises the requirements that hospitals and critical access hospitals (CAHs) must meet to participate in the Medicare and Medicaid programs. These changes are an integral part of our efforts to reduce procedural burdens on providers. This rule reflects the Centers for Medicare and Medicaid Services' (CMS) commitment to the general principles of the President's Executive Order 13563, released January 18, 2011, entitled "Improving Regulation and Regulatory Review.'     

TRICARE; off-label uses of devices; partial list of examples of unproven drugs, devices, medical treatments or procedures. Final rule

The Department of Defense is publishing this final rule to revise the definition of ``unlabeled or off-label drug' to ``off-label use of a drug or device.' This provision codifies the coverage of those medically necessary indications for which there are demonstrations from medical literature, national organizations, or technology assessment bodies that the off-label use is safe and effective and in accordance with nationally accepted standards of practice in the medical community. Additionally, this rule removes the partial list of examples of unproven drugs, devices, and medical treatments or procedures proscribed in TRICARE regulations. We are removing the partial list from the regulation but will maintain the partial list in the TRICARE Policy Manual at www.tricare.mil.     

Pre-existing condition insurance plan program. Amendment to interim final rule with request for comments

This document contains an amendment regarding program eligibility to the interim final regulation implementing the Pre-Existing Condition Plan program under provisions of the Patient Protection and Affordable Care Act. In light of a new process recently announced by the Department of Homeland Security, eligibility for the program is being amended so that the program does not inadvertently expand the scope of that process.     

Specifications for medical examinations of underground coal miners. Final rule

This final rule modifies the Department of Health and Human Services (HHS) regulations for medical examinations of underground coal miners. Existing regulations established specifications for providing, interpreting, classifying, and submitting film-based roentgenograms (now commonly called chest radiographs or X-rays) of underground coal miners. The revised standards modify the requirements to permit the use of film-based radiography systems and add a parallel set of standards permitting the use of digital radiography systems. An additional amendment requires coal mine operators to provide the National Institute for Occupational Safety and Health (NIOSH) with employee rosters to assist the Coal Workers' Health Surveillance Program in improving participation by miners.     

Medicaid program; eligibility changes under the Affordable Care Act of 2010. Final rule, Interim final rule

This final rule implements several provisions of the Patient Protection and Affordable Care Act of 2010 and the Health Care and Education Reconciliation Act of 2010 (collectively referred to as the Affordable Care Act). The Affordable Care Act expands access to health insurance coverage through improvements to the Medicaid and Children's Health Insurance (CHIP) programs, the establishment of Affordable Insurance Exchanges ("Exchanges"), and the assurance of coordination between Medicaid, CHIP, and Exchanges. This final rule codifies policy and procedural changes to the Medicaid and CHIP programs related to eligibility, enrollment, renewals, public availability of program information and coordination across insurance affordability programs.     

Medicare program; revisions to the durable medical equipment, prosthetics, orthotics, and supplies (DMEPOS) supplier safeguards. Final rule

This final rule removes the definition of "direct solicitation' and allows DMEPOS suppliers, including DMEPOS competitive bidding program contract suppliers, to contract with licensed agents to provide DMEPOS supplies, unless prohibited by State law. It also removes the requirement for compliance with local zoning laws and modifies certain State licensure requirement exceptions.     

WTO规则与我国民用飞机产业发展立法

WTO规则对中国民用航空产业特别是我国民用飞机产业的发展有着巨大的影响和积极意义。从目前来看,中国的法律体系尚不完善,现行的民航法规和规章,要么在一些方面规定阙如,要么不符合WTO规则的要求,法治观念还没有完全树立起来。在这种法制环境下,中国民机产业必须规避入世风险,其核心问题是处理好政府的行政管理行为与民机产业法制之间的关系。对此,中国民机产业要建立健全法律法规制度,才能使我国作为WTO成员按照WTO规则和国际惯例保障和促进民机产业的发展。同时,通过典型国家民机产业发展立法的经验借鉴,也能为我国民机产业发展立法提供有益的启示,从而加速我国民机产业的可持续发展。     

互联网侵权交易的政府监管

伴随中国互联网产业的快速发展出现了网上商品侵权交易的突出问题,政府部门开展互联网侵权交易监管不但存在着理论上的困境,还要面对政策支持不力、外部机构协调困难和内部组织不适应等三方面的难点,因此,围绕网上侵权交易的特点,政府需要进行适应性的变革,在有限的监管空间中寻找可行的路径,达到互联网自由发展和侵权交易有效监管的平衡。     

NGO在公共卫生服务中的角色分析

公共卫生服务是公共服务的内容之一。虽然公共卫生服务主要是政府的职责,但也是可以通过多种组织形态来提供的。本文分析了国家级NGO参与公共卫生项目的数量、比例和领域,提出了公共卫生服务中NGO的补充角色及其具体体现,包括在人力资源、资金、特殊领域和内容、特殊地区和人群以及服务模式探索等方面的补充作用,并从筹资和服务两个方面总结了NGO参与的方式。基于此,作者提出NGO和政府在公共卫生领域良性互动的模式。
