法国审前程序的改革及评价——以2007年3月5日的《强化刑事程序平衡法》为中心

自2000年以来,法国刑事诉讼便进入一段前所未有的动荡期.正是在这一背景下,乌特罗案件将法国的审前程序改革推向台前,并直接导致了2007年3月5日<强化刑事程序平衡法>的颁布.从内容上看,改革主要围绕三大主轴,即以保障自由为主轴的先行羁押制度改革、以发现真实为主轴的预审程序改革以及以提高效率为主轴的审前准备程序改革.法国立法者的初衷是在刑事诉讼中建构某种"平衡",这大抵也反映了法国近十余年来(从1993年起)立法改革的发展脉络.但"平衡"却未必是刑事程序改革最佳的逻辑起点.     

甲基苯丙胺稀土荧光试纸条的研制

目的建立一种检测尿液中甲基苯丙胺物质的高灵敏度检测方法。方法以稀土荧光纳米颗粒为标记物,采用反应杯+试纸条的反应模式,建立了免疫层析法,用于尿液中甲基苯丙胺的定性检测。结果用所制备的试纸条检测尿液中的甲基苯丙胺,肉眼和仪器判读的敏性均为100ppb,与吗啡、亚甲二氧基苯丙胺、氯胺酮、苯丙酮、可卡因等无交叉反应;将制备的反应杯和试纸条置于37℃7d,试纸条的性能没有明显降低。结论本研究建立的甲基苯丙胺免疫层析法用于定性检测尿液中的甲基苯丙胺,具有较高的灵敏性和较高的应用价值。     

人民监督员制度漫谈

作为对检察机关职务犯罪侦察权的一种监督制约机制，人民监督员制度正在全国范围内进行推广，但自该制度诞生之初便争议不断，诸多焦点问题亟待厘清。本文首先从该制度实施现状出发，进而通过与人民陪审员制度的横向比较探讨了立法时机问题，并对该制度的正当性基础进行了分析，文中最后提出了完善该制度的设想。     

Getting China Right： The Chinese World Order and Asia-Pacific Regional Integration

Is a rising China good for the stability and integration of the Asia-Pacific region？ The dominant point of view in the Western world is a resounding no. However, that realist point of view, based on the very different experiences of Europe, is not appropriate in the Asia-Pacific context. Area studies are a useful tool to achieve a better understanding of the Asia-Pacific situation. This paper attempts to prove that a rising China will be good for the stability and integration of the Asia-Pacific region through the lens of historical, economic and security analyses. First, history shows that once China is strong and stable, order of the Asia-Pacific region is preserved. Second, with China＇s economic cooperation with neighboring countries, especially after its entry into the World Trade Organization （WTO）, China＇s economic integration with the Asia-Pacific region has been enhanced. Third, regional security has been assured by a peaceful and strong China. Finally, the paper comes to the conclusion that a stable and strong China is beneficial for the overall stability and integration of the Asia-Pacific region.     

试谈卫生监督与和谐社会构建之关系

随着我国依法行政与构建和谐社会目标的推进,卫生监督的重要性日益显现。不论从渊源、内涵还是从作用来看,卫生监督都与人民群众的健康利益攸关。因此,提升卫生监督的地位,开展卫生监督工作,对于构建和谐社会有着十分重要的意义。     

How Chinese enterprises live in freedom, competition under the rule of law

China has thoroughly amended its corporate law and hastens to formulate an anti-monopoly law. To rebound then deny the planned economy once adopted, China firmly practices marketization reform. However, common-recognized rules haven’t taken shape without sufficient gaming and, lots of quick introduced legislations are only superficial provisions. As the trend of corporate legal system in developed countries, freedom and responsibility are the two contraries but not contradictory directions during the recent reform of China’s corporate law. One is deregulation, e.g., introducing one-person company and the transition from approval system to registration system for the establishment of a company; while the other is adding various provisions of responsibility and liability to the Company Law for controlling shareholders, actual controllers, directors, supervisors and top managers. The Anti-Unfair Competition Law of China not only prescribes unfair competition but also counters monopoly. In general, it mainly focuses on anti-monopoly provisions, to popularize the concept and value of free market, making systematic regulations on any kinds of monopoly. This article reviews its background, process, meaning as well as the problems encountered. As there remains somewhat a mystery that China rapidly develops, it may also reflect a fringe of the reason. 镇江市首例恢复性矫正案例报告

对检察机关办理未成年人犯罪案件司法实践的分析和思考

未成年人犯罪逐年增长和犯罪低龄化是当前严重危害社会治安的一个突出问题,预防和减少未成年人犯罪已引起世界各国的重视。对未成年人犯罪案件的执法理念、审理方式、处罚方式和量刑幅度直接关系到他们将来的前途和命运,也是一直以来包括检察机关在内的司法机关不断在探索的方向,应该慎之又慎。从检察实践者的视角,以体现人性关怀和司法进步为理念,对检察机关在办理未成年人犯罪案件过程中应该如何贯彻宽严相济的刑事司法政策、采取怎样的审查起诉方式办案、检察机关如何参与建立预防和减少未成年人犯罪社会化体系三个方面,进行分析和阐述,以期对办理未成年人犯罪案件的司法实践有所裨益。     

China-Japan Relations： How China Needs to Change Mindset and Strategy

In 2005, then Japanese Prime Minister Junichiro Koizumi＇s visits to the Yasukuni Shrine--where Japanese war criminals are honored--threw the Sino-Japan relationship into unprecedented crises. Since then, ties have been troubled and it can be said that relations with Japan are China＇s top foreign affairs issue, particularly after two fierce confrontations over the Diaoyu Islands in September 2010 and September 2012. Most recently, relations have been hurt by the current Japanese Prime Minister, Shinzo Abe＇s flagrant visit to the Yasukuni Shrine. The situation looks bleak with Abe＇s stubborn efforts to deny history, radically adjust the nation＇s constitution and military confrontations with China. The Japanese right wing is gaining power and Japanese public opinion is shifting ever more to the right.
