两岸建构性关系中的知识和文化研究——基于“施动者—结构”机制的分析

从社会建构主义的角度来看,两岸关系是一种建构性关系,其实质是大陆和台湾两个施动群建构的不同层次的群际结构的总和。本文以施动者—结构机制为视角,深入阐释两岸关系中的知识和文化,并以社会进化的逻辑探索两岸文化结构转化的可能性及其路径。本文希望通过这种理论化的尝试,为两岸关系理论和分析框架的发展提供有益的补充。     

对抗下的合作:当事人主义刑事证明模式再思考

传统上将当事人主义刑事证明模式理解为对抗式,事实上,证明过程中控辩审三方的关系既有对抗,又有合作.合作既体现在实质上的合作需求,又体现在形式上的程序设计.合作机制与对抗机制共同构成当事人主义刑事证明模式.刑事证明的合作模式体现了正义与效率的价值,可以促进正义有效地实现.同时,对抗与合作又是对立统一的关系,对抗机制是主导,合作机制是补充.

主席女士,各位同事:很高兴代表中国政府向联合国人权理事会第46届会议致辞。人类正在同新冠肺炎疫情进行艰苦卓绝的斗争。病毒是我们共同的敌人,战胜疫情是我们承担的使命,团结合作是我们唯一的选择。这场世纪大流行给全人类带来巨大灾难。1亿多人染疫,200多万生命消逝,1.3亿人口返贫。全球不平等加剧,南北差距拉大,发展权受到新的挑战。

With nearly 100 gardens and parklands, it is no wonder that Glasgow is known as the Dear Green Place, the perfect place to host the 26th UN Climate Change Conference of the Parties, or COP26. Delegates from some 200 countries are gathering in the British city to discuss ways to upgrade the global response to the world's increasingly profound climate crisis. UN Secretary General António Guterres expressed particular concern over slowing collective action ahead of the meeting. "We need to make sure we reverse the trends, not maintain them. It is now clear we are coming to a point of no return," he said.

No country or region is immune to ravaging diseases. With the global spread of the novel coronavirus disease (COVID-19), it is urgent to strengthen solidarity to fight the pandemic. Many international organizations have called for unity and cooperation among countries. There should be no beggar-thy-neighbor thinking, selfishness or indifference.     

美国司法如何规制公众抗议——“公共论坛”原理及其启示

美国司法规制公众抗议的经验主要是在"公共论坛"原理的框架下充分发挥法律和司法的作用:一方面基于宪法和法律为公民的公众抗议表达提供充分的公共论坛;另一方面通过司法判例确立公众抗议表达和政府规制的边界与规则。文章详细阐述了"公共论坛"原理的发展脉络、主要内容和实际应用,美国经验对规范我国民众群体表达行为的启示在于:须开放制度空间为公民正当的诉求表达提供"公共论坛";以法律为依据实现应对公众抗议的分类治理;应充分发挥司法在规范公众抗议中的规则形塑功能。     

实验使用例外制度的反思与完善——兼评《专利法》第69条第4项

实验使用例外制度作为一种公共利益考量,既可以防止专利权抑制后续研究与发展,又可以实现更彻底、更有效的专利信息披露,具有重要意义。虽然早在1984年我国专利法即已确立该项制度,但规定过于抽象与严格,不利于充分发挥该制度的价值优势。通过对国际条约及欧美国家相关规定的利弊分析,并结合我国实际情况,建议我国直接用"与发明主题相关"限定科学研究和实验,并将《TRIPS协定》第30条作为实验使用例外适用的兜底性条款。
